  1. Hi

Today Dec 9, 2021 I had my Green Card adjustment of status interview at USCIS Detroit - MI office. The counselor who interview just asked the information provided in AOS application form. first he asked my spouse and then from me. Interview took approx 60 minutes and at the end of interview she gave us a paper and she said we will notify you our decission on your application within 30 to 60 days.

Can anybody share what does it mean. if it is approved or not. when i check my case status it says your application is under review.

    ...

    Thank you

  2. Hi

I am Green Card and applied for my spouse Green card application in May 2021. My spouse is on F1 student visa so we applied for Adjustment of status, EAD and Green Card application. Biometrics are already done on August 12, 2021 and now her case status is ready for interview. I received emailed that case is ready to schedule for interview.

Can anyone tell me how long it will take to schedule the interview and after interview how long it will take to issue GC and EAD.

    ...

    Thank you

So authorized stay period is just about up?

you didn’t answer, when did you file i130?

I did not file i130. someone told me that I-485 is to adjust the status of spouse of Green Card without exit the US. so i was wondering that if i can file the I-485 to keep my spouse here in US.

    Thanks

What was the date of last entry - assuming spouse is actually currently in the country? If not already in country right now - no way you can do this, it will be clear immigration fraud.

its already looking like spouse is trying to live here on visit visa from what you said ...

    when did you file i130?

Last entry was in last week of june 2019

In my opinion, it’s problematic entering on a visit visa and then adjusting as spouse of LPR, it raises questions about misrepresentation of immigrant intent on entry.  (If the person was here on a student or work visa, that’s not problematic as the purpose of entry is clear.) When did this spouse enter the country?

The spouse entered on visit visa in 2016 and then frequently traveled the US because of the 6 month restriction he entered and exit the US.

    Thanks

  6. Hello

I heard that Spouses and minor children of Lawful Permanent Residents can file for I-485 Adjustment of Status starting July 1, 2019.

Generally, the Adjustment of Status is the process by which an eligible foreign national already in the United States can apply for permanent residence without having to return to their home country to obtain a visa through consular processing. Adjustment of status refers to the change of the foreign national’s legal status from a non-immigrant (temporary) category to an immigrant (permanent) category.

Please if anyone can let me know if this is true information.

    Thanks

You would need to be a US citizen before you can even start the K-1 (fiancee visa) process.

The K-1 visa process is taking only a few months less than the spousal visa process. The 2-3 months you heard of has not been accurate for a couple years now. There have been short periods where ~3 months start to finish was possible, but expect 8+ months on the low side now.

There's virtually no way the fiancee visa process would be faster even if you could apply for naturalization today.

You mean i can’t sponsor fiancee visa as i am LPR not a Citizen..?? Can’t i sponsor fiancee visa having GC.?? Please share your knowledge.

    Thanks.

If she tries to re-enter the US shortly after leaving, she could be denied re-entry. You guys need to be aware of that.

Lot's of folks on this website spend 1 or 2, and in some cases longer, away from their spouse while awaiting visa processing overseas. That's just how it is. The time apart is the same for all, and no different for a pakistani national.

If i sponsor her fiancee visa..?? Is this expedite her visa process. for fiancee i heard it took 2 to 3 months to get fiancee visa. Please suggest

    thanks

If she is in the US already she was given a period to stay on entry .  It isn't until the visa expires ( to be here now would make December of this year a unlikely I94 date )   Please check how long her stay was permitted for. IF she overstayed that she will have trouble visiting you in the years you have to wait for your spousal visa to process.

Is she exit US before the overstay period on tourist/visit visa then after how many days she can renter to US..??

    Thanks

You can't. Entering the United States with a visitor visa with the intent to marry, stay and adjust status is visa fraud and comes with a lifetime ban. You're not a US citizen so she MUST return home after marriage and before her allowed stay on her tourist visa expires and wait for the CR-1(spouse visa) to process and interview in her home country. Do not allow her to overstay her tourist visa because she will incur a ban, the length of the ban will depend on how low her overstay is.

Can she renew her visa before expiry to again tourist or visit visa so that she can travel and stay in US for 6 months till spouse visa process completed

    thanks
