  1. UPDATE ON THE CASE:

    Here we are - fresh from the interview with nice-looking stamp in the passport :) . We got lucky with the interviewer - cute young lady with cheering attitude and friendly smile, so the interview - the whole 15 minutes of it - was a breeze! We gave her statement on joint account and non-notarized statement from my husband's parents - that's all we had. No questions asked how we met, nothing on our plans or financial situation... I even had to force her to look at the pictures - she ignored all except with our beloved cat :) . She said that I was done with the security clearance so I could expect my GC in couple of weeks. I checked my on-line status: they sent me welcome letter! Wow!

    Something worth mentioning: we look very much alike with the husband - same height, body type, same origin etc. so when you see us you're pretty much sure we are true couple. To emphasize this, I matched our outfits for the interview - maybe it added some points for us. And of course we did our best with the paperwork right from the application.

    Thank you all, guys, on this forum for helping, and cheering, and answering the questions, and for just being here for us.

    Finally we got invitation for the AOS (from J-1) interview for February 22, 2007 in VA (priority date June 23, 2006). We are both graduate students (exp grad May 2007), living with his parents. For the interview in February we will have NO evidence of relationship, mentioned in the invitation - no joint tax returns, no joint bank statements, no insurance, no property, no rentals, no utility bills, no credit cards in common, no contracts etc. So far there was no reason for us to change our separate pre-marriage bank accounts and credit cards for joint ones, and we planned to do so after moving out this summer.

    But in this case how we can prove our relationship to the interviewer? Only photos? Parents' statement that we are indeed in matrimonial relationship? Maybe smbdy already dealt with it, but I couldn't find it through Search button...

  3. Yesterday I realized that my DL is going to expire by the end of August. I went to DMV to clear the issue and they told me that:

    - they cannot renew it, because my 2019 Form for J-1 visa covers the period till August 31, 2006 and I am going to be illegal after that date;

    - the fact that I married USC and applied for AOS did not matter to them;

    - neither NOAs, nor Employment Authorization are going to satisfy them and I have to wait for GC approval to renew my DL.

    That's awful! I have no other means to get to my university than by car! AOS can take up to 2 years, but even 6 months of home arrest are bad for my career and personal life... My professor even offered to give me extention of 2019 but I believe that after filing for AOS I am not eligible for that. Any ideas?

  4. Btw, they sent me NOA the EXACT DAY when I started to worry and posted my question - July 13!!! Coupled with their ability to make appointment without touching the case - that makes them psychics!!! So, people who still wait - start to worry, they will feel it.

    Sukimi, I don't know if we can try to bring smbody with us. Maybe we should ask people who already got through this.

  5. Whew! I got mine today, too! With the Notice Date of July 13, 2006.

    Three points to mention: first, there is nothing for July 13 on USCIS site. The last time I was touched, according to their site, was on July 5. Thus, they made an appointment without touching my case! Second, it was one NOA for both I-485 and I-765. Third, there is a notice on the NOA "If you fail to appear as scheduled, your application will be considered abandoned". So easy for them to deal with people...

  6. I sent I-485, I-130, I-765 and I-131, but got only NOAs for the last three. What does it mean? Is the I-485 NOA just got lost by the USPS or there is chance that they did not send it? Why? Is that a denial of petition? Are they preparing to send RFI? Or they transferred it to local office?

    BTW, even though the notice day is June 28th, my receipt numbers are still not in the USCIS system. Is that a bad sign, too?

  7. Thanks to this site and forum help I am ready to send my AOS papers. Some issues are still unclear, though. I couldn't find the answers in the Guides section, but maybe somebody knows...

    1) ... where I should file my papers? I am applying for AOS based on marriage from J1 visa, not K1. Does it mean that I should file to my District office or I have to file to Chicago anyway?

    2) ... should I include the check for fingerprinting fee? How much is it? It is mentioned in the AOS Guide on this site, but I couldn't find it in the USCIS instructions for I-485 and there is no mentioning of it on the USCIS page with Immigration Forms and Fees.

    3) ... may I file application for Advance Parole concurrently with all the other papers or I have to file it separately via e-mail after I get confirmation that my AOS is in process? There's only e-filing option for AP on the USCIS site, so I wonder if they are going to accept the paper version.

    4) ... is there real advantage to apply for Work Permit and AP via e-filing? Less problems? Speedy processing? Some advice from experienced e-filers?

  8. I am currently in the process of gathering all my papers for AOS and I am lost in three of them: I-485, I-130, and I-864A.

    I am currently in the US on J-1 visa without 2YHRR, graduate student, not out of status and never have been, marrying UScitizen, who is graduate student, too.

    a) Do I need to file I-130?

    B) If I do not need to file I-130, what should I write in I-486, specifically Part 2 "Application Type"? There is no bullet for my case and in the instructions for the form there's no mentioning of AOS from valid status, only AOS while out of status.

    c) Since we are both students, we don't have any income so far, only outcome... Thus, my fiancee's father agreed to sign Affidavit of Support. Should they both also sign I-864A "Contract Between Sponsor and Household Member", since we all live at the same address for the time being? Or it is supposed to be signed only in case if sponsor claims household member's income as part of his own without having the joint sponsor? And who will be sponsor and who - household member in my case?

    Hopefully somebody knows the answers... Thanks in advance.
