    Im a little shaky about this question. I was told one thing and now I am reading the other. My wife and I married on December 3rd and had a child on December 29th. Natash's (wife) K1 Visa has a date of January 26 07 on it. With all the business of having a child and running around we didnt file AOS in time. We were told by someone at the district office that she does not need to file AOS until she is going to need an advance parol to go home.

    We plan to go in June to see grandma. I am filling out this paper work and I dont know what her status is. So I looked it up. Am I to belive she is "out of status."

    Now that I have hurdled the NOA2. I have a new problem to solve. I project Natalya's Interview to be at or around Thanksgiving. She will be 8 months pregers. Not the best time to fly. I anticipate the Consulate to recieve her packet at the end of this month. Can we ask for a Early October Interview date because of our pregers? What are the rules on this?

  4. Dude, you are getting a 2nd RFE, this can actually expedite your case. Take it from me (look into my timeline), you get the RFE, turn it around quickly and Whammo, approval.

    When you send the RFE evidence back, send it USPS express. On the front and back of the USPS provided document Envelope, write the following: ATTN:RFE in red marker. This is the information on the RFE envelope supplied by CSC. It will then move through CSC like a madman!!!

    2 days after CSC acknowledged my RFE, approved. Try it. Plan for success!!!

    I agree that our representatives have little clue as to how bad the processing has become. And, it doesn't help that we have a lame-duck senator to boot.

  5. I am watching my fiance's visa like a hawk. I am having nothing but trouble getting her here. Any words of advice or encouragement would be helpful.

    I contacted a Visa Attorney in January. Papers sent February. Never received an NOA1 because he never sent it. Received a RFE in July. Now I am being sent another RFE (August 14th) and I am waiting to see what the attorney forgot.

    I have contacted all my senators and congressmen and they have sent it an Expedite for processing. The congressmen have not received a reply. He and his staff had no idea how bad USCIS had become, and too are powerless. I have been to my local office, and I am considering going to CSC and personally flying the information to VSC. This is getting beyond ridiculous when others are getting approved in 50 days. If I would have reapplied in May she would be here now.

    By the way... she is due in January. And she is ordered to bed rest.

    What can I do?

  6. I have a fiance. We are expecting a child and this whole process is killing me.

    It is likely that my child will not be born in America.

    For July and August I have been trying to get the attention of my sentators and congressmen. They made inquiries and Requests for Expedition, but they were getting snowballed as well.

    Yesterday, I would not stop calling them untill they found my file. The inital customer service rep was very professional, the second could not operate a computer, and the third was again very helpful. It had been misplaced (in transit) for several months. I recieved all my recipts for NOA1 and the MBRA RFE, but still they lost it. Now my divorce decree is missing. I think someone took it. This is my current nightmare.

    Do you have any suggestions?

  7. It been so long and I havn't got anything. I filed 130 on 03/07/06. Please advice me on following:

    1. What are the chances that my 130 will be approved soon, I saw some one got it today from Jan 06?

    2. I filed 129f on 07/31/06 ( ya i know stupid me waited too long) how soon that will be?

    3. Or should I pack my bags and choose DCF in India?

    Pls drop few words for me. Or tell me what should I do if there is anything I can do to bring my love sooner?

  8. The insctruction pages on I-130 clearly state that only a money order on personal check is accepted. Also, each service center has their guidlines,on USCIS webiste, as what kind of payments they accept. Sending personal check is recommended cuz that way you can see reciept number on back of it when the check is cashed. Good luck.

    I forgot about that... I used the personal check cashing as a sign, showing things were progressing.

  9. I'm not an expert but, I sent a personal check. You could do the same. Send a new personal check tomorrow and bring the recipt for the Certified Check to Bank of America and get the Certified Check cancelled. You might have to pay a fee but you will get most of the money back. If the Certified Check has been cashed. Then... make a new post... because I dont know what do do for that.

  10. Anyone wonder where their cable bill is or a Credit Card bill is. You wonder when it is coming in the mail. You want to make sure you pay it so you don't have any late fees or finance charges. So you wait a week... Still no bill. You call and ask where it is... and the operator says "its coming." So you wait a little longer. As the sweat builds on your forehead, you go and do something ridiculous to find the bill. You might dig through the trash or ask neighbors if they have seen your bill. And then the next day its in your mailbox.

    This immigration process seems similar. You wait and wonder. You call and get a robot. You flip out and do something rash. Congress and Senators are trash and you have to dig through them.

    I hope this post is my ridiculous attempt at finding my NOA2 and my mailbox has good news tomorrow. Keep smiling everyone.

  11. Hi Everyone,

    I have officially lost all hope. I really, really, really, REEEAAALLLY, thought that I would be getting my NOA2 sometime this week. Tomorrow is Friday and I haven't received a thing. I've contacted both senators (filled out the authorization form when sending letter the first time) and haven't heard anything from them. I contacted my rep. in congress and haven't heard from her either. I've contacted UCSIC to get the same "call back in 30 days" bull.

    I've seen people with NOA1s of April and May, but yet I who have an NOA1 of March 10 get nothing. I know, I know, I should get this depressed, but every night when I speak with my fianceé it just seems like she is farther and farther away. Our relationship has grown as have we and yet it seems we are prisoners to this process and our relationship cannot progress.

    I am seriously on the verge of just simply giving up. Lord knows what I will do if I am denied. Most likely I will just give up. At one point or another we must admit that we are doing ourselves more harm than good by staying in this sort of relationship. Obviously every bone in my body tells me that breaking up is just simply not an option, but I don't know how long that can last. 2 years, 3 years, 4???

    Maybe I will cheer up once the processing times change, but even then it will only mean that I have to wait until the processing date reaches 30 days after I got my NOA1. :crying::(

    Your frustration is noted. I'm stamped with receipt date of March 21st and I am waiting for NOA2. I watch these Vermont people getting fast approvals and others in California with all the luck. I am extremely happy for them, but very jealous.

    Try to imagine getting a text message at 2:30am saying, ”I'm going to the hospital,” from your four month pregnant finance who is trapped in a country and cannot leave because USCIS is undergoing reconstruction.

    Would you ignore the text message and give up? Remember, she is depending on you.
