  1. Which relatives may I petition for? A U.S. citizen can file a petition for the following relatives:

    • Husband or wife;

    • Children, married or unmarried.

    A U.S. citizen who is at least 21 years or older may also petition for the following relatives:

    • Parents;

    • Brothers or sisters.

    When you submit your petition, you are required to provide evidence to prove your relationship to the person for whom you are filing.

    I would highly recommend to you to contact NVC as well and verify this. The general rule of thumb is to bring originals (and photocopy) of all documents you submitted to NVC. But please do call NVC too.

  3. When you submitted all your documents through EP, how long did it take for you to receive a confirmation email from NVC saying they have received your document? Did you have to call or was an email sent?

    I did EP for Rio. I scanned each individual page and attached each one to the Email. Had no problem at all. Each attachment under 5MB.

  4. Name the files as: CaseNumber_FirstName_LastName_XX_File_Description.pdf

    • CaseNumber - in your case, it should begin with SYD, followed by numbers
    • FirstName and LastName - are the Beneficiary's first and last names
    • XX - Numbers (00, 01, 02, 03, etc.) to keep all files in order
    • File_Description - Description of what document the file contains (ex: Petitioner_Form_I-864_Signed, Petitioner_Tax_Transcript_2014, Marriage_Registration_Certificate, etc ).
    • Example of complete filename: SYDxxxxxxxxxx_FirstName_LastName_07_Petitioner_Tax_Transcript_2014.

    Ok leaning towards the electronic filing and just scanning to PDF the other Boni fides I wan to include....In the naming file do you add the number in from NOA1 for example YSC 169+++++++ that I got at the Potomac service center or does NVC give you a different number?

  5. You don't need to send relationship evidence as that was established at the USCIS stage. On the NVC site it clearly states to provide evidence if you have submitted I-864A (sponsor): https://travel.state.gov/content/visas/en/immigrate/immigrant-process/documents/Step_4_Collect_Financial_Documents.html

    If you completed Form I-864A, submit evidence that proves your relationship to the sponsor (the person who filed Form I-864). You can prove your relationship by submitting a photocopy of one of the documents below:

    • Birth certificate;
    • Marriage certificate;
    • Adoption certificate;
    • The petitioner or joint sponsor’s most recent Federal Income Tax Returns, if you are listed as a dependent; or
    • A signed, written statement describing the relationship.

    I'm wondering the same thing......I want to send in some more relationship evidence ect. and didn't want to send in so many files and emails. Does anyone know if there is a big time difference over FEDEX or email filing besides the 2 days to get there?

    i did all mine after paying the fees online

    it directs you to the site to fill out online and submit

    I sent nothing by mail or email

    all was online


    And they still processed your case? Didn't reject it or asked for RFE or anything?

    How did you compress your files in one email?

    did you try compressing the files ?

    mine was around 12 mb , compressed to 9 mb and sent it to the NVC

  7. Thanks appreciate your inputs. Some people on the forum in previous threads say they have sent email with an attachment of 11MB. So assuming its ok but yeah hard to know exactly.

    I would think so but im not sure how big of an email they can recieve. Typically anything over 25mb for an entire email would be rejected by an email provider, but as its the US government im not sure if the restriction is on email size or attachment size.

    I would think just attachment size. Im no where near my husband to ask either! Sorry! (He works for the FAA.)

    you will be filling in the support document and visa application online and submitting them that way directly to NVC after receiving the 2 different notifications to pay the fees

    Print out the documents before you send them for your own records

  9. A few questions:

    • Email vs Post processing (sending documents to NVC): which is faster/recommended? I have the option of choosing either one of the two.
    • I-864: If I were to choose email processing, how do I send an 'original' I-864 to NVC? I can see everyone recommending to send only one package to NVC, so how do I go about this?
    • Proof of relationship: As part of USCIS stage, we sent our honeymoon air tickets and stay details at that time. Do I have to re-submit that again?
    • Cover letter: does anyone have an example, they are willing to share, on what they wrote in their cover letter in relation to all the documents being sent (different to the stock standard NVC cover sheet).
    • Birth certificate: I have an affidavit stating my DOB but it references the details of a very old passport that I no longer hold. Do I need to submit a copy of this very old passport as well?

    Background: my husband is a US citizen and I am an Australian citizen. My husband has filed for 1-130 and I am the NVC stage.

    My husband has filed for his state and federal tax returns. He (US citizen) filed as 'married filing separately', as I am a non-resident alien. He applied for my ITIN (W7), and submitted a copy of my passport plus his state tax return copy, as I believe that is required to file for federal taxes. He filed, on my behalf, from the US in the second week of April and now its June and we've had no response from IRS.

    Today, I called IRS and they told me:

    (1) My ITIN application is in suspense as I left the "date of entry to the US" field blank. I explained to them that I don't live in US and I haven't entered the US, as I am awaiting for my green card application to be processed.

    (2) The IRS team transferred me to Tax Law dept and asked me to ask them if I am eligible for ITIN

    (3) The Tax Law dept guy told me I am ineligible as I am a non-resident alien, who is about to get my green card.

    (4) The person at Tax Law dept (IRS), said my husband needs to enter "NRA" in the Social Security number field and file the federal taxes. I said ok and kept the phone.

    My husband told me that on US "turbo tax", in its instruction says that if filing for NRA (non-resident alien) you need to input an ITIN number.

    Question: Is there anyone in a similar situation as me and their spouse filed tax returns? If yes, how did you file?

  11. You should be contacting your nearest US Congressman who would help you in investigating as to where your case is. Also, have you spoken to a Tier 2 officer?

    It's been more than 10 months since I applied and I'm still waiting!!!! Anyone with PD from August2015?!???!

    My husband and I are already working on the next step nvc I have requested my tax transcript and will be pre filling out aos tomorrow .. Can that be done online? And will check stubs work as well?

  12. Thanks LinJoe. I am an Indian by birth but an Australian citizen (moved here when I was 5 y/o), hence the consulate of Australia. SYD seems to have both email and mail processing. So do I have to call NVC and tell them I want to send docs via email or would it ask on the DS-260 form?

    When your IV bill status shows "Paid" then your DS-260 will unlock. you can complete and submit it anytime after. your profile pictures shows the American and Indian flags, but your consulate is Australia? I know India doesn't allow online submissions. I'm not sure about Australia. check this link. https://travel.state.gov/content/visas/en/immigrate/immigrant-process/documents/Submit_documents.html

    If your case number begins with one of the prefixes listed on that page, then you can submit online. you just have to follow the process for that. if it's not listed on there then you have to physically mail it in. best to use a courier services so you can track where your sensitive documents are.

  13. both packages should be submitted together yes. it really is beneficial to you. Sending one package at a time will be prolonging your case from being completed. They need both AOS and IV packages to review along with the DS-260 (IV Application) before they can issue a Case Complete. so if you want this process to move quickly, then send everything in one package.

    Thank you for your advice. When you paid your IV bill. How long did you have to wait before you could complete DS-260 and submit the documents. Also can you submit documents online or does it have to be the NVC US postal address.
