My office is Milwaukee. As of November 2016 they were processing case of May 6, 2016.

We're almost 2 months from ther so I'm hoping to here some news soon.

I got a RFE, they received it in October. I'm guessing a RFE starts the clock again right?

I am in the same situation, different office though.

Returned rfie in October, so assuming it reset the clock as it were.

  3. Okay, done some digging, and this now makes more sense.

The employment letter side, is fine, can see where they are coming from with that, so we can evidence income etc, that's all fine.

The IRS returns though, we appear to have sent a 1040a from 2014, with a received date of 2015, so not 2015's returns... So this makes sense also.

In our situation with having no income from 2015, is this the only form we need to send to cover the tax period?

  4. Hello,

Can I trouble yourselves for some help with a RFIE I received concerning the I-864.

The parts in red below are annotations added to the letter in red ink. (Which is causing some confusion)

    Some background,

The income is 60,000 so meets poverty guideline. Only been working for 2 months, so only 4 pay stubs (fortnightly pay)

Letter of employment was submitted, however did not include information of future prospects/advancement, so fair enough.

We sent the IRS tax transcript, which given I know nothing about the IRS I now believe was not the correct thing they were looking for.

What is the 1040/W25/W-2's/2555/1099's this has gone completely over my head.

Lastly, the form states we 'need' a joint sponsor, I'm confused... why would they write in pen, 'Need' next to joint sponsor?

    1.

The petitioner/sponsor on form I-864, affidavit of support, must submit a complete federal income tax return submitted to the internal revenue service (IRS) for the most recent tax year. (2015 = 1040 & W25)

If you were not required to file a Federal income tax return under U.S. tax law, attach a written explanation of why you are not required to file. See 'filling requirements' in the IRS form 1040 filing instructions to determine whether you were required to file

    2.

The petitioner/sponsor lists their current income on Form I-864 as an amount to be considered as sufficient, however no evidence has been submitted as proof of current income.

Submit evidence of the petitioner/sponsors current income. Such evidence should include:

Pay stubs or other documentation of pay for the previous 6 months.

Evidence of other income such as tax exempt interest, etc.

Letter of employment containing the following:

    Dates of Employment

    Nature of Job

    Yearly Salary earned

Number of hours per week worked

Prospects for future employment and advancement

    3.

Submit all supporting tax documentation (W-2s, 1099's, Form 2555 and all supporting tax schedules) submitted to the internal revenue service for the most recent tax year (2015)

The petitioner/sponsor must submit all supporting tax documents for the most recent tax year.

    4.

Based on the documents submitted with form I-864, affidavit of support, the net value of the assets do not make up the difference between the income and poverty guideline.

    <list of acceptable assets>

It then states Need next to the section on joint sponsor.

  5. They didn't give you much advanced warning? I suppose a week and a half isn't hugely bad. I worry mine will clash with my husbands work as can't apply for a licence until I have EAD.

On another note my hard copy of NOA1 arrived yesterday. My husband was so excited he wouldn't let me open them and then was disappointed when it was just a bit of paper lol.

Yea, but it's fine. I figured it'd be in the next 2 weeks or so.

I applied for my permit, and should have my full NY licence by then, last part of the road test is next week. I am still able to drive on my UK licence though, so easy enough getting there. Though it is 100 miles away haha.

Spoke with the DMV, since my licence will lapse on 10/5 from temp visitor status, but apparently that will just mean I can't use it as ID, I'd still be valid to drive, though, I am still valid for 120 days after I arrived 7/8, so covered anyway on UK licence. Then just need EAD to reconfirm the ID part?

    Seems strange, but whatever.

  6. Hello,

Can I double check I'm reading the requirement for I-693 correctly; that K1 visa holders who have had their vaccinations already, and have the I-485 filled in the last year. Do not need to submit form I-693 at all?

Below are the two excerpts causing the confusion.

    Thank you.

check.gif If you are a K-1, K-2, K-3 or K-4 visa holder the I-693 instructions state that you are not required to have another medical examination as long as your Form I-485 is filed within one year of your overseas medical examination. Regardless of if you are exempt from a medical exam, you are still required to complete certain portions of the I-693 and have a Civil Surgeon certify the form (and seal it in an evelope). Specifically, you will complete Part 1 (Information about you) of the I-693 and provide both the form and your DS-3025 (if you have it, proving your vaccination history) and any proof of required vaccinations that were completed prior to entering the US. If you do not have a copy of your DS-3025 you will need to provide sufficient evidence of your vaccination history to the Civil Surgeon (talk to the civil surgeon's office to discuss what vaccination records they accept as proof). If you do not have proof of your vaccination history the Civil Surgeon may insist on re-administering all the required vaccinations prior to completing the I-693. Once the Civil Surgeon has has verified that all required vaccinations have been performed, they will complete form I-693 Part 2 (the vaccination section) and Part 5 (the Civil Surgeon's Certification). They will then seal the form in an envelope and return it to you.

I-693, Medical Examination of Aliens Seeking Adjustment of Status.I-693, Medical Examination of Aliens Seeking Adjustment of Status. If you are a K-1, K-2, K-3 or K-4 visa holder the I-693 instructions state that you are not required to have another medical examination as long as your Form I-485 is filed within one year of your overseas medical examination. If you are missing any shots from your overseas medical a I-693 vaccination transcription is required to be completed by seeing a Civil Surgeon to have certain portions of the I-693 completed and have the Civil Surgeon certify the form (sealing the original in an envelope and giving you a copy)

  7. What was approved and when? Was the I-129F approved and then the couple decided to get married without waiting for the K-1? Seems an odd thing to do since after the USCIS approval the process to visa issuance is relatively fast (compared to other visa paths). If the couple were free to marry when they filed the I-129F and circumstances changed, although they can no longer continue with the K-1 they haven't lied and need to withdraw from K-1, load up on patience and nerves of steel and set themselves off on the 1-year-plus journey to CR-1. Unless they both lawfully live in the UK and can file by DCF at London embassy.

It's quite something else if they were already married and lied on the I-129F and this has been approved. They've got some explaining to do...

It was the former. And the NOA2 approval.

And assuming it was K1, a misunderstanding of the type of visa needed I would think.

Hopefully they have already filed I-130 and its a k3 they are now working on, and I've just misunderstood their circumstance.

I've pointed them here at any rate, so hopefully they can get a steer from the thread/guides here.

    Thanks for the replies.

  8. Can I ask a hypothetical question relating to a K1 applicant.

(I'll preface this by saying this isn't me...)

I think I know the answer to this, but would appreciate others confirming.

Would being legally married in the UK, cause any issues for a K1 visa applicant, either in getting approval, or in future at AOS filing.

Current state is Approved with USCIS.

    Thank you.

  9. Question for those who have filed the DS-160 -- is the visa fee payment confirmation included in the appointment confirmation page? I'm trying to figure out how to prove I paid the fee...

If it's the same as the UK, we pay the fee when booking the interview after the DS-160, our receipt is emailed to us, and can be accessed through the site linked above as well.
