  1. My fiancee left the USA for Brazil in January, but her I-94 says she's still in the USA. How do we correct it?

    Long version:

    I proposed to my fiancee when she came to visit the US last winter. She went back to Brazil at the end of January, and we've been preparing her K-1 Visa application since and are now just about ready to send it in.

    She checked her I-94 from the Customs & Border Protection website and there is no departure listed for January 2016. She has arrivals and departures for every other visit, but the most recent entry is Arrival, December 2015. We suspect it is due to her return flight being rescheduled, but her boarding pass for that return trip even "DOCS OK" stamped across the front.

    What are potential causes for this? What's the best way to fix it, and how long will it take?

  2. My fiancee (Brazil) and I are preparing our I-129F. This year's W2 puts me below the 125% line, but as a graduating student I will be working full time by the time of the interview, earning well over the minimum yearly requirement.

    1) For the I-134, is it acceptable for my W2 to be below the requirement if my current employment exceeds it?

    2) Can we apply before I begin working at my new job if I have an official job offer/contract?
