  1. You don't need to get married in US for getting suppose visa.

    1. Travelling on tourist visa and then getting married may not be a good idea. It can complicate things. Probably this is best answered by other members here in this forum.

    Just so you know your fiance cannot travel to US on B2 visa once her IR1 is filed. It would be a violation.

    2. Counselor will verify you marriage certificate and interview you when applying for IR1 visa. It's on this basis that spousal visa is given. You can get married in US or abroad.

    3. IR1/CR1 is the visa, for this first step is filing form I-130. Process for this is explained in detail on US government website and is best source for reference. You can file I-130 by mailing to Chicago lock box, overall it takes about 10 months to get IR1 this way or file I-130 to USCIS office abroad which takes about 3 months.

  2. Ok The process will definitely work but you need to understand it in whole.

    DCF is just a name for filing I-130 with USCIS abroad instead of filing it with Chicago office.

    USCIS has only few offices abroad. New Delhi has one, but unfortunately Singapore does not have

    So if you want to file in india. Since you can apply to Delhi office overall time line reduces, but paperwork remains same

    If you want to do from Singapore you will have to mail it to Chicago lock box and wait for USCIS to respond.

  3. Check out the DCF process on visa journey's guides page. It should be a good start.

    And yes you can do DCF from Singapore. Police clearance is basically a check to see if all is well and you don't have any cases etc

    it's needed from all places lived in past one year and is only for your fiance. For Indian one visit passport Seva Kendra website.

  4. Ok so the consulate looks for 2 things

    1. Whether you are in india legally

    2. Do you meet residency requirement

    OCI can prove the first and sometimes seeing OCI they don't ask for more. But it's always better to prepare. Anything which proves that your stay is for longer than 6months that can help for 2nd point

    Eg work related documents that show you are working in india. Tax documents which show you were in india and paid taxes. Leave for more than six months applied to your office in US etc more pros the better

    You can also c check with FRRO if they can issue a resident permit. They issue for only foreigners who stay for more than a month but it's not required for OCI holders. But you can check.

  5. I had a few questions on filing the DCF from New Delhi.

    -I am USC(naturalized) for the past 12 years living and working in the United States. My fiance is from India(living and working in Singapore for the past 3 years). We are planning to get married in Oct 2016 in India. Would the DCF apply to us if I take an internal transfer and work in India for the next 6 months and then apply?( I would still get paid in U.S dollars and the salary would be deposited in the U.S bank accounts)

    - Do I need to work in India on an Indian payroll to be eligible for the DCF visa option/ Do I have to work at all in India?

    - What kind of documents would I need in my position to make sure that there is a strong chance to get the DCF?

    Any help or advice would be appreciated.

    I don't think you will be eligible for it. DCF requires residency criteria. You need to have lived or have proof that you will live for six months or more in india continuously for being eligible

    If you have OCI then probably you can try your luck. Since OCI is considered residency proof. TTY hey will ask before they accept your application on residency.

    When we had gone there were 3 couples including us who were applying. They asked us but didn't ask the next couple as the consulate official looked in a hurry.

    So my employer is not going to change. So my income will continue from same employer. But current Indian income is based on Indian cost of living and my employer will calculate what I will get in US after relocating based on US cost of livig.

    Is it OK if I mention my Indian income on i864/and have a relocation letter which will mention my US income post relocation

  7. Hmm what I understood was we need to show house hold income and sponsor can use household members income for showing income requirement.

    So basically we will either be able to show both our Indian income or my US income (as a household member) to show income requirement.

    For domicile issue, we are planning to take steps he ch can show the intent. We have talked to banks for opening account as first step.

    I am also filing for i130. I don't think there will be an issue for you with intent to domicile. Since you are here in India temporarily and can show the employment details to prove that.

    From i864 instruction form

    . You are living abroad temporarily.

    If you are not currently living in the United States, you must provide proof that your trip abroad is temporary and that

    you have maintained your domicile in the United States. Examples of proof include:

    A. Your voting record in the United States;

    B. Records of paying U.S. state or local taxes;

    C. Having property in the United States;

    D. Maintaining bank or investment accounts in the United States;

    E. Having a permanent mailing address in the United States; or

    F. Other proof such as evidence that you are a student studying abroad or that a foreign government has authorized a

    temporary stay.

  9. Hi all, First off thanks for all the treasure trove of information on these forums

    Still need some help in my case. My wife is a USC and we are planning to file for DCF at newdelhi. Both of us have been living in India for past 25 years. She travelled to India as an infant along with parents.

    Recently we got her first time adult passport renewed. She has an SSN.

    Now, we are married for 3years now and are working in India. My employer recently agreed to relocate us to US. We are trying to plan for the same.

    Individually neither of our current indian income matches the i864 requirements but together it does. My employer has issued relocation letter and my US income will alone satisfy the requirement. What should I put in the i864 our Indian incomes together or my US income alone?
