I just got confused of the date "when" I could apply for my citizenship with my son. We became a PR of October 2007. Am I correct that I could submit my application 6 months or more prior to the 5 years of being a PR? My son and I would be 5 years PR by 2012. So that mean to say, I could apply and/or submit my application by 2011???

BTW: I became a PR through a waiver. So, I am counting on the 5 years not 3 years PR in regards to applying citizenship.

I mailed my wife's and stepdaughter's I-751 to Vermont 2 weeks ago. I received the packet back today with the check I had written for $625.00 ($465 & $80 & $80).

USCIS said the check was not the proper fee. My wife came over on a K-1 and my step-daughter on a K-2 visa at the same time - both were listed on the I-751 - my wife on Part 1 and my step-daughter on Part 5 of the I-751 -they both received their green cards at the same time.

I am confused - I thought the fee was correct?

Your amount was right. I think the USCIS got confused or I do not know how they process their calculations/procedure with regards to payments/check...anyway, what I did was I made two checks, one for me a total of $545, then one check for my son - $80-- in that way they will not be confused. And my paper work went well...

My suggestion, make two checks , one for your wife a total of $545, then one check for your son - $80 for her daughter for her biometrics...then re-submit your papers asap. Hope I help you in anyway...

Hi mooninlove congratulations to you guys approval, did u submilt a lot of evidence ? because i did filed with waiver last December of 2008 and after that within 10 days i did my biometric, so now iam still waiting and i sent a lot of evidence... how long it will take me to hear something ? thank you very much .

I submitted that I think were necessary (e.i., bank statements, employer's verification of my account - salary went to Ex-husband, address that shows we did had lived together, Tax returns of 2006 & 2007, a letter stating why & what happened to my marriage, affidavit of closed friends who knew my ex and then who knew me, emails, pictures,) my documents were huge and thick. And of course, I sent them a copy of the proceeding of the divorce and the final divorce.

I think, it takes CSC time to process our case (on a waiver base) coz of the necessary documents and background checks versus that applied as joint.

Just hang on there and your time will come soon. As the saying goes, "Patience is a virtue"

I did our lease, a joint bank statement, insurance showing both names (car & health), joint tax returns, photos, a few cards addressed to both. I think that's it?

I have read some others are getting touches after their biometrics. I am just wondering why mine has no touches till this date. I had my biometrics last 26th of September...is this common?

Case online status is still last August 21, 2008 - case received and pending. Is this common too? Does it take them so long to update USCIS online status lately?

i have a it of a problem

on october 31 2007 i filed a petition to remove the conditional basis of my permanent status

since then i did the biometrics and everything

on november 19 2008 i receive a letter stating that my i-751 has been denied due to failure to appear for the interview concerning the marriage fraud amendment.

only i didn't receive that letter

therefor by november 12 2008 all my privileges are terminated

have two options

file a i-290b to re-open the case knowing that its hard to prove that i didn't received the notice

or

re-file for i-751 all over again

what should i do beside seeking a lawyer

i also have two jobs right now so is it illegal for me to even show up?

any help is appreciated as i am hopless

Where did you file? CSC or VSC?

With regards to you work - just continue showing up and/or go to work - Let your employer know that you are still in the process with your green card. It is your employer's call now if they still want to keep your job or not with regards to your legal status.

I think, it is best to get a lawyer if you can...

So heres a question...

I'm coming up on the expiration of my conditional residency (4/13/09) so Im mentally preparing myself to start working on the application.

Previously, we hired a lawyer to help us with the paperwork, simply because I felt it was too important to make a mistake.

There were just alot of different things to file and I was overwhelmed (this was before I found VJ). I just didnt want to chance anything.

Ofcourse the lawyer himself made THE mistake when he *FORGOT* to mail in the application...

I reminded him a month later when I informed that I was worried no letter had been received nor had the check been cashed (oh Im sorry my paralegal forgot to mail it) WHATEVER!

I also remember the bad lawyer made me fill out a removal of residency conditions when we filled everything out, which I only found out after the fact that you cant submit till the end of the 2 years.

Yes, he left a bad taste in my mouth.

So this time around, Im wondering if I should hire a lawyer again to help with the paperwork, or do it all myself...

Im still very afraid of gooffing up and getting thrown out of the country cuz things expired and such...

It seemed like I did all the work for the lawyer anyway...

The list of things to do still look long, but it *looks* like just the one application triggers everything (is my assumption correct?)

SO, my long winded explanation to my question is:

You already had a bad experience with a lawyer. It’s still your call if you wanted to hire again or not after all that you went through.

I applied without a lawyer and things are going well so far…

Anyhow, the application and instruction for I-751 is quite straightforward. Just submit whatever you have for evidences.

Most important docs I know of are:

• Joint Tax returns

• Joint bank accounts

• Any insurance documents – both names on it

• Utility bills – both names

• Birth certificate of the baby if you have one

• Joint lease agreement/rent if you rent a house or anything that has both your names on it.

Just apply at the right time and/or 90 day window (90 days before the expiration date of CPR).

Well it depends. Sometimes it'll be less than 6 months or it'll take longer, nobody knows. you'll receive the same NOA's like the "regular" filers and will go through the same routine, file, bio's, wait etc...you don't need to get stamp as long as u have the extension and have filed accordingly. some of us including me got RFE for more evidence...Best of luck.

Just like you said you have lots of evidence you could provide. Since you are hiring an Attorney he/she will help you all the way. Just submit what you have and take it from there. Read again the 751-I instructions especially on the evidences you need to submit. I submit a personal letter explaining what happened to my marriage - as to why I had to file on a waiver...

You can file anytime after you are granted your conditional residency if applying through divorce. You will get your NOA1 - extension letter a few days after to a week - once application is receive...usually a week after...Your extension letter is good enough - you don't need to have a 1551 stamp unless you wanted to...

Just what I thought would be the processing time now. CSC is really doing a good job.

I will just wait...it's just that my boss ask me about it too you know. That's why I'm concerned.

Yesterday, my Fiancee had her interview at the US Embassy in Manila. She arrived at 6am for her 7am interview. She went through the screening process and finally spoke to the Counsul at 12pm. Everything went well, but the Counsul asked for a "certificate of no marriage."

My Fiancee had heard that we may need this document, but we were not able to obtain one before her interview. We called the Embassy asked the day before her interview if we needed this document and they said no. They told us that this is the reason we pay for document verification.

After she finished her interview with the Counsul, he asked her to go to a different window. Again, they asked about the certificate of no marriage. My Fiancee let them know that she did not have it and was told that we did not need one. The person at the window said not to worry and handed my Fiancee a pink and a white paper.

What do these colored papers mean? From what I understand, a blue sheet means denied or come back with more proof, pink and white means - passed but still requires documentation verification, and pink only means totally passed. Is my logic correct? Has anyone else experienced this before?

It makes me nervious, because I want her here in the States as soon as possible. Can anyone help? Btw...this is for the Embassy in the Philippines.

First off, yes you do need a "certificate of no marriage". You fiancee could get this from NSO. But since she had already her interview, i think, there's no need for her to get that.

As for the colored papers she get, the pink one is from Delbros that will deliver her passport with Visa on it. The white paper - if it's like that of a regular 8 x 3 1/2 size paper - then she has to comply what was written on there - or requested from -- before the US Embassy proceed the paper work. If this the white paper that goes with the pink receipt from Delbros - this kind of just a copy of the pink one.

Had my biometrics in Naperville, IL yesterday. My husband and I left the night before and got a hotel and decided since we both worked really late that night that we'd just sleep in and go in at my appointment time (10:00 am) instead of when it opens, and if we wait for a while we wait (we took the day of our jobs). Well I'm happy we did cause I was the ONLY person in there when I arrived! Last time we went it was a Saturday and it was PACKED at 7 am, so I was quite surprised lol. Quick and smooth, as usual. We went to Woodfield Mall afterwards and had a fun day!

The same way here with my son and my biometric's experience. We were the only one in there and within 5 minutes we're done. We had a good chat with the guy who took my biometrics.

I'm sorry it took me long to respond again.

Part 6 signature is from your son. Then on Part 7 who ever prepared the form must sign also. No need to sign for signature of spouse for Part 6 since you check "b" on Part 2. Am I clear?

Again, only your son's signature and your daughter's signature to sign on Part 6. Since they both are applying on each application.

Hi again! My documents for my two children has been returned to me for the following reason:

My filed an incomplete I-751.I have to complete Part 6 of the petition.

And my I-751 was not properly signed.

How I must to complete it?

You must print your name and your husband's name and both of you need to sign with the corresponding dates. Always review your application as much as you could.

Take note below of the I-751 instruction:

3. Answer all questions fully and accurately. State that an item is not applicable with "N/A." If the answer is none, write "NONE."

Again make sure you answer all the Parts and questions and leave no blanks (see instruction above).

Submit your application again - with complete answer to all questions.
