  1. Hello,

I have a Green Card interview for me, my wife, and 9 year old daughter coming up in Fort Smith, AR.  On the interview letter it specifically says no kids are allowed in the office.  However, my daughter is part of the paperwork that was filed.  We received a notification for an interview for both me and my wife but no letter for my daughter.

Is it safe to assume that my daughter will be allowed in the office for the interview with us?  Will she be allowed in the office?

If anyone can share their experience with the USCIS office in Fort Smith, AR regarding kids I would greatly appreciate it.

  2. My finace's K-1 visa was approved on December 7, 2016.  She has the visa in hand.  The visa expires on June 3, 3016.  She is a Libyan citizen.  The muslim ban should technically end in 90 days, around 1 month before the visa expires.

Are all visas revoked now?  Do I have to go through the whole process again?  Or would there just be extra questioning at the first POE?  Please help, I'm so confused I do not know what to do.
  3. Filling out the DS-160 for my fiance, I noticed that her passport has the wrong date of birth (it is off by one day). The I-129F and the documents that was sent were sent has her correct date of birth.

    My question should I either:

    a) fill out the DS-160 with the wrong DOB that is on the Passport

    b) fill out the DS-160 with the correct DOB that is on her birth certificate and I-129F

    c) Try to get a new passport with the correct DOB (this will take 2-3 months because the passport process in her country is very slow)

If I went with "A", would there be any problems during the interview?

    Please advise.

    Thanks

  4. On May 23, I received my NOA2 for my K1 application. Around 2 weeks ago I received my NVC case number by calling them. According to the travel.state.gov website, my first step would be to "Choose an Agent", which is me, the petitioner. The second step would be to pay the fees. I logged in to pay try to pay the fees and the AOS fee says "Exempt" and the IV Application Processing Fee says "Not Invoiced". It's been like this for a while.

How long does it take for the fee to show up? Am I missing something on my part?

  5. Yes you will get a RFE. I got an RFE because the passport photo was one inch off. They didn't specify in the RFE letter what EXACTLY they wanted or what was wrong with the original application. Just that they needed passport photos. So I sent it in again and they denied my WHOLE K1-visa because the passport picture dimensions were off. So unfortunately, expect an RFE. While you wait for the RFE letter, just get the passport pictures with the correct dimensions ready so you can send it in immediately after you receive the RFE.

  6. Hi everyone, I sent my I-129F last week and am realizing that my finance's photo is the UK size and mine is the US size... what should I do?? Will this definitely mean that I will get an RFE or might the USCIS not care? Please advise!

  7. Ok what I have gathered from reading people's previous experiences on this forum and elsewhere is to just reapply again. It is cheaper and less time consuming.

But what about this waiver form that I need to include in the petition now? Because I applied for a K1 already and it was denied and I am not allowed to apply for another? May I get some clarification please from an experienced member?

  8. OK guys I am opening this post again. The RFE that they sent me on December 9 said that I need to provide a passport style photo of me and my fiance. No details were given on what exactly was wrong with the original copies. Therefore, I sent the RFE with the two photos attached.

On February 23, I received an email stating my petition was DENIED . I received a letter today stating that the reason for denial is that my passport photos were too large (Instead of 2x2 they were 2.5x3). A little trivial if you ask me to deny a whole petition because the passport photos were an inch larger. I wish they told me the exact reason for the RFE instead of being so vague. Anyway, it is what it is.

So my questions to this helpful community

    1. Should I file an appeal along with the correctly sized passport photos and cough up the $630 or should I start a new petition?

    2. What are the benefits of filing an appeal vs. starting a new application? Is it faster?

    3. What is the probability that the USCIS will come up with something else to RFE if I go the appeal route? Or is this issue the only issue with my petition.

  9. Is it at all possible that it was sized or aligned wrong or not on white background? If you got them done professionally it's unlikely, but if you tried to recreate it on your own it's possible they just weren't up to criteria.

Also, when you say you attached them to the g-325a form, what do you mean by this? According to the guides, you are suppose to:

"Write the full name of the US citizen on the back. Place in a plastic bag and label the bag "Photo of <Insert US Citizen's Name>". Attach the bag to a sheet of paper and place behind the corresponding G-325a."

If you physically attached it TO the g-325a maybe they either missed them or, depending on how you fastened it, they were damaged when they tried to remove them.

This is all just speculation by the way, your best bet is just to send new copies in as soon as you can. Calling USCIS to get more info may help you figure out what happened, but you are most likely going to need to send new photos in anyways.

Thanks for the helpful replies. I did exactly that, I placed each corresponding photo in a plastic bag and wrote the names on the back of each. I then attached the plastic bag via a paper clip to each corresponding G-325a form. I guess I'll just do it again. I'm thinking they may have misplaced the photos.
