A girlfriend of my wife is here in the US on a tourist visa that doesn't expire until 2012 but her I-94 expired about 5 years ago. Can she fly domestically (like from Los Angeles to Dallas) with her valid passport? I don't want her to get deported by trying to get on a flight with an expired I-94.

When I starting watching the Adjustment of Status forum, I somehow checked a box to receive emails of updates. Now, I can't find how to turn it off. Can someone help me? I am contstantly flooded with emails.

If you file together with AOS I don't think you need an explanation.
If I understand you corectly, you didn't supply an extra sheet of paper and didn't offer any explaination of how you qualified for an advance parole document or what circumstances warrant issuance of advance parole, and didn't include copies of any documents you wished considered??? You just ignored that portion?? If that works, great. I just want to make sure that is what people are doing successfully.

I was married in 2000 to a K1 in the US. I sponsored her for AOS. We are divorced and she is remarried. I would like for her new husband to file an i-894 and take her responsibility off me. He is willing. Can it be done simply by filing a new i-894 by him with a cover letter?

This is exactly correct....no written time limit as to when you have to file for AOSyou are out of status once the i-94 expires but there is not a time limit for when you file aos only that you must be married within the 90 day time frame. we waited a year and were approved for the conditional green card last week. some people wait for 2 years so that they can just receive the 10 year straight away.

There is a time limit for filing AOS if you don't want to accrue out of status time.

There is no time limit to file AOS if you get married within the 90 days on the i-94. Are you not still out of status if you do file within the 90 days but don't get your GC for one year? What status are you until you are approved for GC? Everybody is out of status for some period of time. You just can't travel or work legally until you get your GC/EAD/AP and you may be deported if your spouse dies before you are approved. I have seen cases where the spouse died after they filed the AOS but before they were approved and the immigrant spouse was still deported (she was out of status and no longer met the criteria for approval). They can't expect you to get married, file for your GC and get approval within 90 days; it can't happen.

I am a US citizen married to a Filipina who will have a green card shortly. If we retire to the Philippines after she has a GC and have a baby born in the Philippines, how can the child become a US Citizen? Any info is appriciated.

If we file after two years of well documented marriage, is it possible to get a 10 year GC rather than a 2 year card? What are the pros and cons of doing this?

My wife and I got married August 30, 2008 and we applied for the I-485 and received notification in October, 2008. She currently has her EAD and a driver's permit for Texas. This morning, I drove through the border patrol and showed the agent her Visa and he noted that it expires in 4 days and we need to apply for an extension. I let him know we applied for the green card, but the process is currently a 6-month wait so there's no doubt any K-1 Visa issued in the U.S. is going to expire before the green card is received. I'm worried if we go through the border patrol checkpoint again, if they would try to deport her due to the date on the Visa?
Any clarification on this? My guess is we should at least carry copies of her AOS papers just in case. Either that, or she just can't come to the border with me until she gets her Visa.
The AOS papers won't be adequate. You are in essence asking for her to travel internationally without a green card or AP document. She will be out of status until you get GC or AP. It is just the same as if I took my wife to the Philippines without AP before GC arrived. They wouldn't let her back into the US. Your country is just closer.

Thanks to everyone for the information. It is really helpful. My wife is originally from Maao, south of Bacolod. I would love to live in Baguio but probably too expensive. Likely, we will live close to Bacolod. I will not have a lot of cash and my Social Security won't be much, but we plan to buy land and build our own home. We can live pretty well on 55,000 Php per month. I am looking for business opportunities and sure we can find something to augment our retirement.

Relatively cool location for home, e.g. 2000' elevation and trees.
It sounds simple but not in the Phils. Any ideas? Bacolod is not carved in stone.

I am married to a wonderful filipina. We are thinking of retiring to the Phils. Is there a forum to discuss this with other Expats? There are so many questions about shipping household goods, building a home, visas, etc.

I am still in the early stage of the journey (my fiancee just got her K1 visa approveD), but have already looked forward based off current USCIS processing times (which I know can vary). Regardless, with these estimated times I found that I would apply for AOS August 1, 2008 and would receive the conditional green card around 5/1/2009. I would apply for the I-751 to remove conditions 90 days before the 2nd year anniversary of the conditional green card, or on 2/1/2011. The I-751 at Vermont is estimated to now take 14 months, which would mean I would have my then-spouse apply for naturalization 90 days before the 3 year mark of her becoming a conditional permanent resident, or 2/1/2012.
I know the estimates are only estimates, but under this scenario, she would apply for citizenship (2/1/2012) before the conditions would be removed from her conditional 2 year green card (4/1/2012).
Can she apply for naturalization before the conditions have been removed on her conditional green card? I don't know if the 14 months that is estimated to remove conditions would pose a problem since I thought green cards were generally extended for a year, but I could be wrong.
Anyones thoughts?
Try to relax. You will get gray hair at this rate. Things will likely change before then.

My wife's sister just entered on K1 last week in DFW. No problem. Very nice people at DFW.

Guys, I need your honest opinion on this matter. I have asked my fiance to change his mattress but I am feeling funny about it.
The only reason i am asking him to change it is because he's had if for a few years now and I know his ex slept there many times. Do you think i am being childish, has any of you felt like that too?
We think it is unreasonable. It is necessary to change the sofa too? The kitchen counter too? The carpet? You are just "peeing on everything" establishing your dominance and ownership.

1. Do we file an Employment Authorization with the AOS?
2. She came here on K1. What is the fee we send with the I-485?

What is the window of time for filing the I-485 and all the other forms e.g. I-693 and I-864? My wife entered the US on K1 in March. Her I-94 is only good until June. We have recently gotten married but because of tax filing and "extensions" may not be ready to file the I-864 for another month or two. Can someone please enlighten us?

When filing the I-485, on the very first blank, do you use the married surname or maiden name?
What is the name of the EAD form to be filed with the I-485?

Delbros delivered Tita's visa today.
SHe attended the class this morning so she will need to go back and get her sticker on Monday.
My flight arrives Thursday and we will be back in USA on Saturday March 17th.

Just a note to those of you who are divorced. Be sure to take your divorce papers to the CFO. Lilia received her visa from Delbros at 7AM and went to the CFO on Friday. She had a Sunday flight to Dallas. The lady at CFO demanded to see divorce papers before she would give the form to Lilia.
Now, Lilia has to go back to CFO on Monday to get stamp (with divorce papers). We had to change her flight to Tuesday.

PW, one last update before you go. Lilia was notified her visa is out for delivery tomorrow (Mar 2) in Manila. She is catching a Mar 4 flight to Dallas. Thanks so much everyone. Without you, it wouldn't have been possible. I am sure we will see most of you in the AOS forum.

I was wounding if anyone has tryied to schedule a k1 visa appointment useing "Visa Point". You have to pay like $10 to join the system but after that you can make a visa appointment. Im sure its too good to be true but it doesnt hurt to ask to see if not why??

Yep, I paid the $10. They don't tell you in advance, but it doesn't work for K1.

PW, finally you can change our status to approved. Lilia saw the CO write "K1 APPROVED" on her file as he sent her to pay Delbros.

One thing interesting. Since I am self employed, I sent a year's worth of ORIGINAL bank statements (both company and individual accounts). I expected to get those back when Lilia arrived here for use in filing taxes for 2006. The USE KEPT all my bank statements! The Filipina screener told Lilia they would just keep them. Now I have to pay the bank to get copies generated. I should have made copies. No big deal, but noteworthy for the self employed.

Yes, I agree. Depending on the airline agent, someone might feel compelled to alert an immigration officer. Just knowing this could make her very nervous.
