  1. As far as utility bills... we didn't think of adding her to the bill (plus I am not sure it would show up there anyway). Ugh... what to do, what to do...

    I think in some cases you need an SSN# for that.

    I dont have one yet,we are only going to add me on the bank account and I am on my husbands health insurance.

  2. Hello everyone,

    I didn't find the guide for K-1 interview, so here it goes.

    We got response for FORM I-485 (Adjustment of Status for K-1 fiancee). First of all, it is called "Request for applicant to appear for initial interview" - does it mean there's going to be more than one?

    Second, it says if you (i.e. my wife) does not speak ***fluently*** (which she does not), we must bring an interpreter. Does it mean that I can't be the interpreter for her?

    Third, it asks for the list of documents which we submitted already once or twice. For example,

    1. Medical examiniation (I-693) and vaccination supplement (submitted before)

    2. Completed Affidavit of Support + 3 yrs tax return, w-2, etc (submitted before)

    3. All documents establishing your eligibility for Lawful Permanent Resident status. What documents do they mean?

    4. Birth certificate (submitted before)

    5. Petitioner's Birth Certificate (i.e. mine) <-- this was never asked for before, I am naturalized so it is not in English. I guess I suppose to translate it and get notarized?

    6. certified copy of marriage document (submitted before, do we need to bring it again?)

    7. divorce decrees of prior marriages (submitted before, do we need to bring it again?)

    Should we try to get all of the documents again? Thank you!

  3. You've been so great at answering all of our questions, so we came up with few more :whistle:

    1. Clarification: we need to send certified copy of "Marriage Certificate" not "Certified Abstract of Marriage", right? We got both of them from the Recorder.

    2. Part 3a states to give name as on I-94 form, but there is no middle name. Actually visa also does not have it. So do we list it as on the form? First and Last only?

    3. Part 3b - Relationship. Is it better to put "husband" or "spouse" or it does not mattter?

    4. Part 3b again - I am naturalized citizen, should I find and put my old A# there?

    5. Part 1 - Expiration of current USCIS status - do we put expiration date from I-94 form or from K-1 Visa from the passport? They are different...

  4. 1. First of all, many forms which are filed with I-485 require "2 passport foto" - does it mean we have to submit JUST 2 foto or 2 for each document where it is needed?

    Two for each form, so if you're filing I-485, I-765 and I-131, send 6 photos.

    In practice, people have gotten by without the adequate amount of pictures, because they take your picture at the biometrics appointment anyway. That picture is used at least on the employment authorization card and -- I assume -- on the green card (I don't know because I don't have my green card yet). On the other hand the Advance Parole document bears the picture you send them.

    2. One has to provide birth certificate - is copy of the translation is ok? Original translation with translator's stamp, etc was filed with 129-F.

    USCIS no longer requires originals with the initial application, but they may ask to see the originals at the interview, if you have an interview.

    3. Also, Form I-94 should be attached. Do they mean the original from the passport or just a copy from passport page with stapled I-94?

    NEVER separate the I-94 from your passport until you have your green card. Therefore, yes, send them a copy of that page. Send them a front and back copy of the I-94 but do not separate it from your passport.

    3. What's "Address C/O" in part 1?

    c/o means Care Of. Only applies if you live at someone else's. You can leave it blank.

    3. I-94 number that's the 11 digits number on the I-94, right? 9 digits, space, 2 digits - right?

    They're not silly, actually they're among the most common ;)

    Thank you for the clarification! Strange that they want the back of I-94 too, there's nothing there except for some instructions. But if they want it, they'll definitely get it :)

  5. US Citizen is filling this out. If US Citizen's income exceeds 125% when counting self, immigrant and any dependents, then no assets are needed to be listed.

    USCIS even provides a version of I-864 for simple cases called I-864EZ (Good Income (No Assets), No joint sponsor, single immigrant).

    We used the I-864EZ.

    1 A is US citizen doing the sponsoring.

    2 Assets must be in the USA

    3 US Citizen should be employed.

    Thank you for the suggestion, but I am a little bit confused. I-864EZ says it is only for filing I-130 petition.

    As far as my original questions - we are not relying on assets outside of US, but my wife believes that "the more - the better". So she wants to list it. We do plan to provide tax returns for the past years because in 2006 I was below 125% poverty due to being in wife's home country for the whole year. 2005 and 2004 way above poverty; 2007 is too - but unfortunately it can't be used yet...

    Questions about I-864...

    1. Question 1 - "a" I am petitioner, right? Just double checking...

    2. Our assets here few thousand dollars smaller than our assets in my wife's homecountry (because we have easier access to them here... sigh) - would that look strange? Should we even list our assets in my wife's home country?

    3. Form had Employment Eligibility Verification papers attached... why? Do we need to fill them out as well?

  9. Only thing in part 7 needing to be done is single trip or multiple trips, you are not having the AP sent to a foreign address, or overseas office.

    If we check multiple trips, is there less chance we'll get AP? We might have to visit her elderly parents every year and getting green card obviously will take more than a year...

    Questions about I-765 filed with Adjustment of Status.

    Question 16: (a)(6) K1 fiancee right? For wife it is (a)(9), but it is not correct?

    Question 10: We have both A# and I-94 - should we try to squeeze them both into the field or just A#?

    Question 14: "Manner of Last Entry" - "K-1 fiancee", right?

    Question 15: "Current Immigration Status" - also "K-1 fiancee" or "wife" or what?

    And of course - we should file in CHICAGO address right? Even though instructions say that it should be filed to California Service Center?...
