  1. Hi All,

    Looks like my husband's namecheck is cleared.

    Today I recieved three emails from USCIS that " On August 30, 2006, a welcome notice was mailed for this case."

    I am really happy and I still can't believe its ture specially after hearing so many horror stories.

    BTW funny thing is just today my husband had an infopass appointment and he was being told that his case is still pending and they can't tell him how long woudl it take to get resolved.

    Anyway I pray for everyone that thier cases would get resovled soon.

  2. No, there is no change in the message yet, nor have I received an email, but I've read that for some people it has taken a few days to have a change in the message and/or an email sent to them. But since 07/11/06 I've had a 2nd touch on my I-485 and on my I-130, so I hope it is good news.

    My husband had his AOS interview on 6-29-06 and his NC was pending. However he got a LUD on his i485 and approved I765 today(7/20). I am hoping its a good sign.

    BTW where did you read that it will take few days to get the approval email after a LUD. Did you try calling 800 no to ask abt it?

  3. Its been 260 days since our interview!!.

    Received another letter today from congressman...same wording the senator gave us....nothing they can do...sent a reprint about namechecks thats on the fbi web site and also from the uscis site.

    Lawyer pondered lawsuit and said....do you really want to sue the goverment???...

    makes you wonder! :huh:

    still might try the mandamus; just feeling so exhausted over all of this like somethings got to give........ :(

    HUH strange. On what grounds your lawyer said you shouldn't sue USCIS? Filing writ of mandamus seems to be the only solution of this name check pending problem.

    Sorry to hear that rebecca. Can you not file a lawsuit as it has gone over the 120 day mark now.

    WEll I guess this 120 days rule is only apply to naturalization cases. In AOS you can certainly file writ of mandamus to sue uscis, but you can't do so on the basis of 120 days. It has to be on the basis that you have exhausted all of your resources to resolve this matter and suing is the only option left.

  5. I have to disagree that the country of origin has anything to do with this, lookin at other websites, this is a pretty rampant *glitch* and can follow you all the way to naturalization....but I'll play along:

    I agree that it could be random , but I've been told by a lawyer that when they do your namecheck they would collect info from all of the countries you've ever lived in.

    So that in your case, they have to gather information from Egypt and as well as from Canada.

    Though I don't 100% agree with the lawyer but I guess it might be a factor in some cases.

  8. Hi,

    I recently married an American citizen and sent in all the forms. On the I-485, it asked when the last time I entered the US was and if I was "inspected". For someone reason I thought inspected meant that they pulled me over and searched me. But after reading some blogs, I learned, I think, that it just means that I entered legally (ie showed my passport and student visa). Now, I was "inspected" in this sense, and it is clear from my I-95 (which is stamped). Will this cause any problems or delay my application?

    This is such a frustrating process! I read the forms a million times, read everything on line that I could, called the USCIS for help a dozen times, but still feel like I didn't get it right. Any help is greatly appreciated. Thank you very much

    Don;t worry! and relax. People do make mistakes all the time. You'll be ok as you can always correct this info at the time of your AOS interview . You have your passport as a proof . If you really being paranoid , make an infopass appointment and tell them of this error. You can't mail any stuff to USCIS now, regarding your filled i-485, unless they would ask for any info in a RFE.

  9. Hi All,

    We have our AOS interview on june 29. I just recieved an email from USCIS that my Husband's EAD is approved on June 22nd, and will be mailed to us "as soon as it is ready". I am pretty sure we will not recieve it in time to take it with us for the interview. Does anyone knows the implication of having the EAD approved, but not recieved by the time of the interview????? As our interview letter indicates that we have to bring the EAD with us.

    One thought can I call 800 no and ask them not to mail it ????, but again I don;t know what's the outcome of our interview gonna be , If he don't get approved on the spot then we'll be needing this EAD card eventually.

    Any suggestions or input???

    I'm new to this forum, and its good to know that ppl are able to adjust their status(marriage based) w/out going through the intreview process.

    However I am a bit confused, Is this only ture for cases in which spouses have entered USA on K visa?

    we have filed for my Husband's AOS. But he is already working here on L1 visa.

    I understand nobody can tell for sure what criteria USCIS uses to waive the interview requiremnt. But had anyone being approved w/out interview who was not come here on K visa??????
