I know au pairs receive very little $$ since most of their expenses are paid by their host families. Are you even sure you are required to pay?  I recommend that first you contact the au pair program, if they say you need to do it I think you should fill up the forms and find out how much you owe. If that is the case you should take care of it as fast as you can.

    shameful but so true! hahaha I read up a lot on the NVC stage before I sent out the I-130 back in January and assumed I knew what to do except for some details here and there (and apparently have forgotten all of it)... but I could never imagine NVC not requiring translations, even reading what you sent me it seems like it can't be true... lol

    lol...well, It's a very long and annoying process and there is just so much to worry about. I'm telling you how I did and I didn't get any RFE so I think I did it right.

    I sent all the required documents in the same email, and I forgot to send the checklist (but don't make the same mistake). I had for example RDJ....MyName_I864_JointSponsor (it was a 12 page document). You just have to make sure that you scan it in a medium quality so it doesn't get bigger than 5mb. I sent an email with about 20 files total.

    At the NVC stage they will not check the details of your documents, they will check whether you have enough income and if you are able to provide all the required supporting documents. One thing that I want to point it out is that if your joint sponsor is married and file taxes together with his/her spouse, the spouse must fill I864a.

    There is no need to translate any document that is in Portuguese!! You can trust me on that one, I was surprised too! I actually called NVC to ask about it. But it's written in here: https://travel.state.gov/content/visas/en/immigrate/immigrant-process/documents/Supporting_documents.html

    "All documents not written in English, or in the official language of the country in which you are applying for a visa, must be accompanied by certified translations."

    It looks like you haven't gone through the official website ;-p

  4. I did it recently. Each file you attach cannot be more than 5mb. However, the total size of attachments on your email does not matter. If you have a document, say birth certificate, the birth certificate translation should be another file.

    If your birth certificate has more than one page, you still need to put it on the same file, don't do birthcertificate_page1 and birthcertificate_page2.

    Keep in mind that if the docs are in portuguese there is NO need to translate.

  5. I just went to the same process as you so I think I can give you some advice. First, you need to fill all your past tax returns (right now) if you haven't been doing it in the past years!! Your income will be zero in the tax returns so you won't have to pay any late taxes. Second, you will absolutely need a joint sponsor. Your salary in Brazil will not help because even if you made more than enough, you would still have to prove you would be receiving that money after moving back to the US. At last you would have to worry about domicile. Bank accounts, IRA, voting ballots, and a letter with your intent of moving back, everything counts!!

  6. We have finally received our interview date, but we live in the south of the country. Does anyone have experience with either the Dr. from São Paulo or Rio? We called the office in São Paulo and they said it could be done in one day and then the packet would be available 10 days later. The office in Rio said we should expect at least 3 days to get the tests and receive the packet.

    Any advise or others experiences would be great.

    I went to the São Paulo doctor. It was easy and fast. However, they only accept the lab exams to be done in the Fleury lab, which is more expensive than other labs. They have an agreement with the lab, so your results go to the doctor's office. My package was ready in about a week. You can choose to pick it up or to be sent to the consulate for an extra fee.

  7. He's going for a k1, so there's no delaying at the nvc. Better to delay applying for the i129f

    Can't he delay sending the documents to NVC? Are people not required to send documents at the NVC stage for K1 visa? I am not sure how the k1 process work, but if there is any document to be sent, he could just delay sending them. This was actually an advice from my friend's lawyer. She also applied for k1 and also had to fulfil the 2 year home requirement.

    I'm going throught a k1 visa process, my first package was sent on 22th february to California center (WAC). On 9th may I received my approval notification from the USCIS. Everthing looked to be going on a normal process, 2 weeks after my approval I got my RDJ number (Brazil) by contacting the asknvc. Since then, I've been waiting to have my package transfered to US Ambassy in Rio de Janeiro. Yes, Exactly 3 months. It's driving me mad, as it seems to be very unusual. I thought the dealy could may be because the Olypmics in Brazil, but others are still having the cases sent to Brazil. I tried to contact the NVC, but the only answer from them is that I will be notified once my case is forwarded.

    Does anyone have the same delay issue? What could may be the reasons my package is taking too long? Anything to calm me down, please!!!!

    What doe it say on your ceac status? Is your case ready? My advice is to call NVC every other day.

  9. A No-Objection statement from CAPES is not enough to guarantee the waiver. However, you can apply for the visa at any time. The only time you are required to show proof of 2 year rule fulfillment is at the interview. At your interview you either has the 2 year completed or provide a waiver.

    You can try the waiver and if it doesn't happen you can delay sending the documents to NVC so you delay getting an interview date. In my case, I completed the 2 year rule in July 28th. They had scheduled my interview (despite my request to do it in the end of July) on June 16th. I was able to reschedule it for July 29th, and they didn't even look at my proof of fulfillment during the interview.

    No, not at all. It was concerning to my divorce certificate, there was an issue with the registration (Averbação), long story short: figured out (after the interview was over!!! She said: Ok, we're all set, BUT :( ) it was only de consensual separation and I didn't have the official divorce decree, so i had to run like crazy but, thanks God, it ended up being quick, they received last Monday and issued my Visa today

  11. To get the semantics out of the way first, you are interviewing for a visa, not a green card.

    To answer your question, all your husband needs is his passport. Just be aware that he may not be allowed into the interview area itself, most Embassies and Consulates do not allow this; however, it does vary from country to country so someone familiar with how this is done in Rio de Janeiro can answer definitively.

    Ops...you are right, I'm interviewing for the visa. Sorry about that!

    He will be allowed, they actually recommend the USC presence during the interview.

    I'm sorry if I'm posting it in the wrong place. I have my green card interview (CR1/IR1) this Friday in Brazil. My husband, the USC is coming with me. He was not born in the USA but he has been a citizen for very long.

    Is it enough to bring his passport? Or should we bring his birth certificate and his naturalization certificate? You are actually not suppose to make copies or your naturalization certificate and we really don't want to bring it with us to Rio, since it's crazy in there with the Olympics approaching.

    Interview: June 28, 2015

    They are leaving Brazil August 12! I miss them so much! 6 weeks since I have seen them! Can't wait for their arrival!!!!

    Congratulations!! I'm glad everything worked out and that your step daughter is going to be able to get there on time for school.

    My interview is this Friday, I'm a little nervous. I have a job to start on September 6th, so I can't really afford to go to AP. Hopefully everything will work out!

  14. Since your husband will be moving to the USA his current income will be zero if the job is not continuing.

    So you think we should put 0 in part 6 item 2 (current income)? His tax return says 0. However, when we submitted the I-864 we put the current income (not zero) and attached an explanation of why the discrepancy on tax return and current income. Because if we think about it, he already had an income this year because he is working so current income is obviously not zero. When we read the instructions for the form, is not 100% clear what to put on that item number.

    For us it doesn't make any difference because we are not using his income to qualify, since we have a joint sponsor whose income is more than enough.

    I am just thinking of bringing many different I-864 to the interview, one with the mistake (but that we sent to nvc), another one with current income corrected, and another one with zero income. Since we are not 100% sure.

  15. I think a lot of people are making a mistake here for Part 6 Item 2. This is your CURRENT income which you THINK YOU'LL EARN in the current year. There is no where to get this number except your BEST GUESS. This is copied from the I-864 instructions: "Enter your current, individual, earned or retirement, annual income that you are using to meet the requirements of this affidavit and indicate the total in the space provided.

    You may include evidence supporting your claim about your expected income for the current year if you believe that submitting this evidence will help you establish ability to maintain sufficient income. You are not required to submit this evidence, however, unless specifically instructed to do so by a U.S. Government official. For example, you may include a recent letter from your employer, showing your employer’s address and telephone number, and indicating your annual salary. You may also provide pay stubs showing your income for the previous six months. If your claimed income includes alimony, child support, dividend or interest income, or income from any other source, you may also include evidence of that income."

    I am aware of that. However, if you had no change on your job and is making about the same amount, a good guess would be your previous tax return.

    Thanks for your reply but the amount itself is not my main concern. I'm concerned about the differences in part 2 and part 15 (since part 15 should be the sum of the specified lines) and we clearly made a mistake.

    I am only wondering if they already entered the form in the system and by bringing the corrected form would take the case to administrative processing and delay the issue of my visa.

    I see some people talking about calling NVC to get the RDJ number to schedule interview and medical. Is that a thing? Its also on the timelines here at VJ.

    The doctor in São Paulo doesn't allow you to schedule unless you already have an interview date and letter. I've tried to do so. My results from the doctor were ready in less than a week.

  17. Yes, my husband earn in Brazilian reais because he lives here. He is not the joint sponsor. The I-864 from the joint sponsor is correct. My husband is the primary sponsor because he is the petitioner and his I-864 is the one with the mistake.

    He reported his current income in the I-864 and it's different from the tax return income (in the tax return his income is 0, because all his income in Brazil is taxed in Brazil and tax return formulas make it zero), but we explained the difference in the tax return income and the reported income in the I-864. Note that we are not using his income to sponsor me and that is the reason we have a joint sponsor.

  18. Hi everyone,

    I found a small mistake on the form I-864 of my husband. He's only the primary sponsor because he is the petitioner, but his dad is our joint sponsor since my husband is currently living with me in my home country. The joint sponsor form I-864 is correct, I checked many times. The mistake is on the income (page 5, part 6) and the individual current annual income (item # 2) is correct, however, the current annual household income is higher by mistake and we sent it wrong. The problem was the currency exchange rate that we were using, we corrected one field but forgot the other.

    Is this going to cause any delay in our process? Should I bring it out immediately at the interview?

    I am bringing the I-864 with the mistake because it is the one we sent to NVC, but I'm also bringing the corrected version of the I-864 form.

  19. It's actually not. I864 is the form my petitioner had to fill as my sponsor for my CR1 visa application. And we are applying from Brazil! I-864 is the Affidavit of Support form.     But he is doing a K1, I just saw that. I can't really tell much about the k1, apparently I134 is for K1 and I864 for IR visa.

  20. For immigration purposes it says to not call the consulate but only email them (include your case number in the subject line). You should be polite and ask them about the birth certificate. Also, explain that your visa was approved but they are just waiting for this copy to issue it. Don't say too much on the email because from my experience they only give short answers. It takes about 4 days for them to reply.

    Since there is no immigration section phone number it's likely that the person who picked up the phone only gave a general answer.

    I've dealt with them by email and I can say I got what I want, It just requires a lot of patience and politeness.
