You have to submit I-90 by mail for fee waiver under:

    Filing Fees by Application Reason:

Filing Your Form I-90 Form By Mail

Some people recommend that you make an infopass with the local USCIS to get a temporary I-551 stamp on your passport in the meanwhile.

hello again merrytooth . can you help me make a letter of explanation for error ... im fixing my i-90 now ...

  2. Your attorney is outright dumb and wrong.

You can believe him/her and do nothing. Your choice.

Here is the office USCIS website about 2 year conditional green card:

    https://www.uscis.gov/green-card/after-green-card-granted/conditional-permanent-residence/remove-conditions-permanent-residence-based-marriage

You are married in february 2016 and sent in AOS april 2016.

Obviously you are not married for more than 2 years.

hello merrytooth thank for the reply ... do i need to call the uscis first or i immediately send my green card with i-90 and letter of explanation for the error ?

also what address i will be sending . i think the nearest uscis local field office here in our place is jacksonville.

sad to say my husband not cooperating he keep in tell that its right green card and he believe to our attorney.

looking forward to hear all your advice . thank you ....

  3. Listening to that attorney will net you nothing but serious consequences, it would probably be best to sever ties with that attorney as quickly as possible.

You need to send the card back to USCIS with an I-90, since it's a USCIS error, you will pay no fee to receive the correct card.

  4. Your permanent residence status is conditional if it is based on a marriage that was less than 2 years old on the day you were given permanent residence. You are given conditional resident status on the day you are lawfully admitted to the United States on an immigrant visa or adjustment of your status to permanent residence.

hi . i ask our attorney but this is what she say .... i really hope you can help me .....

  5. Has it been 2 years since the date you were married till the date they approved your AOS(like your interview date if you had one or the date on the approval letter if your interview was waive)? If so, yes, it's possible to get a 10 year GC. Otherwise, USCIS made an error on your GC, -'d you should contact them to get it fixed. I remember there is another similar case like yours here on VisaJourney.

hello eric1225 thank you for replying back ... im married february 2016 and we sent my AOS april 2016 . then they never interview us . after we response RFE, after a week my case status in USCIS website : " case approved " . and just received my green card today with 10 years expiration ....
