is that your question at the top? about conviction or just arrested?

i am not sure like i said i know he went to jail for 90 days. i have the letters he sent me while being locked away.

Coz being arrested is different from an actual conviction. If he was convicted, it has to be declared on your petition coz it falls under IMBRA. but if he was just arrested, then after court and his time being in jail, his case was dismissed by the court, then he is not convicted which means, it doesnt need to be declared on the petition although you have to still have the full knowledge about it just in case they ask you about it.

With my case, my husband  was just arrested but not convicted. It was just an allegation and false accusation. The ex wife was practicing her best actress piece for OSCARS when she called the police just so she can send my husband to jail. But after the arrest and investigation, they found out her wounds were self inflicted.

My husband was then released from jail.

We didnt declare it on our petition and they never asked anything about it.

Thats why make sure if he was convicted or just arrested.

I actually have something similar.....my partner was charged with domestic violence by his ex wife, who from my understanding kept changing the story of what happened, but he went to jail for 90 days anyway. I am just wondering if he needs to include his full record or just the domestic violence record?

i will be hopefully *fingers crossed* be sending the whole package by March. I have gotten really into a swing of things and getting things organised. I am actually feeling really positive and excited about my future. :D

  3. I did know anything about it...no one told me along this ridiculous process. I found out today when scheduling her interview in Manila.

Again, these forms are very confusing as to who is who in this process. The receipt is labeled:

    Session:

USA - AM (SESSION 2) 9AM-12NN. This looks like the appointment takes place here, or am i fricking batty?

I can't get anyone on the phone at the CFO office. How do i know which office this seminar will take place? There are two only: Cebu and Manila.

I am filling this out for her, but i am wondering why she is considered the "fiance" on the form and i am the "petitioner" for this interview? CONFUSING!!!!!

    USA: AM SESSION (9am-12nn)

This means, she will have a morning session and it's Philippine Time coz the seminar will be here in the Philippines. It just says USA because she will be attending the USA seminar and will be inside the USA room..

Everyday, they do seminars for different countries too. Japan, Australia, New Zealand, Korea, etc.

  4. Good God! What is her next requirement? must she follow the yellow brick road, defeat the wicked witch, and then get a frickin' balloon ride to america? This whole process at the Ph end seems just one big scam. Why is there only ONE "qualified" hospital in the whole GD country giving visa exams? $250??? Every filipino must fly to St Lukes, wait at least a week in a hotel, or else fly back to home (my fiance is in GEnsan) and they fly back to Manila for the interview? ANd she must someone fit in this frickin' seminar offered in olny two locations? So, you have the manila embassy, the airline companies, St Lukes, and now this CFO company linked and dipping into the foreign money pool. SCAM! SCAM! SCAM!

This is how the process goes here in the Philippines and we have no choice but to follow it. The whole visa process gets really expensive and not just that, very stressful too... but then again, it is what it is and whining wont be of any help.

If you have Problem with Philippine Government, find another fiance' who's not from Philippines. Coz if you intend to spend the rest of your life with your filipina fiance, then you will have to deal with the Philippine Govt. For the rest of your life too... :) Unless you never plan of coming here ever again. :)

  5. Hello everyone! As promised, I am back to talk about how my interview went... :)

Thanks to our good Lord, i was approved! No questions were asked. I just tried to be very confident answering all the personal questions about me, my fiance, about our relationship and the whole time, it never felt as if i was interviewed but felt as if we were just having a conversation and laughing the whole time coz we were throwing some jokes too in between questions.

I am so happy today and it will never be possible if God wasnt there to help me. He was with me all the time and silent prayer helped me to be calm and be very focused...

Thanks everyone! I really appreciate all of your inputs! All worries now gone and just waiting for our Visa on Hand. :)

    God bless us all!

  6. This is kind of telling to me. Its saying there was some sort of religious ceremony ''two years ago'', in her home country which would probably be a big no-no in wanting to obtain a K1, right?

Supposedly entering on the K1 in July 2014.

    So kind of fraudy.

Secondly it seems according to other reports that they ''married'' this spring, when the baby became a complication. But if police can't confirm the nature of the relationship it implies that they never married in any civil way or had any proof as to the marriage that would of fulfilled the legality of the K1 in the first place.

Whatever the case may be, it kind of sounds like the visa was not only obtained via fraud but if the timeline is correct she may have been still residing here illegally.

Yes you're right... most probably she's been residing illegally if she entered the US july 2014 and if police cant tell the nature of their relationship, it means they were never married in the US after entering coz if they did, they would have been registered and their relationship could have been known right away.

  7. https://gma.yahoo.com/san-bernardino-shooting-know-female-perp-185328424--abc-news-topstories.html

    Quotes:

"Tashfeen Malik reportedly married Syed Rizwan Farook two years ago, according to Farook's brother-in-law. Police have still not confirmed the nature of their relationship."

"The FBI said today Malik was in the United States on a Pakistani passport and a K1 "Fiance" visa, meaning Farook would have petitioned for Malik to enter the country and they would have been required to marry within 90 days of her entry, pursuant to U.S. regulations. Officials said Farook had left the country and then returned to the United States with Malik in July 2014."

    Yeah, liars and murderers.

    And totally psychotic...

  8. Where did you get this information? The man was born in the United States and tightening the K1 visa process would only have prevented one potential shooter. The VWP is actually what needs to be reworked immediately.

I read it from an online news. Yes, the man was from US and brought his wife/fiance to the US through a k1 visa. Im really not sure about the entire story as to how long has she been living in the US but they only emphasized about her holding a Pakistani passport and entered US through K1

  9. It's crazy how this one was overlooked and how terrorists are really doing everything they can to enter US and perform their evil deeds.

It would be sad for us especially for those people who are living in middle east coz it will surely have bad effect on their process.

But at the same time, it is a good thing that they will be more strict and maybe this time they will conduct more background check for applicants. It's for the benefit of the many.

  10. I had my interview today. These were the exact words of the CO that interviewed me "ok, everything is good but i need to see the court records of the case in 2006, go to window 5 and they'll give you the instructions" then they sent me thru email a 221g and they did not give me my passport. My fiance said he'll get the court records tomorrow and send them to me. So what do you think? I was totally honest during the interview and answered every question he even said that at least im aware of his past

Hi... if you dont mind, i just like to know what was the 2006 case is all about... was it something that falls under IMBRA? my interview is soon and i'm looking onto things about what they may ask me about his court records and arrests... i have his criminal records on hand and if ever they would ask me for it, can i just give it to them directly?

Hoping for your response. Thank you!

  11. It will all go smoothly as long as you have everything on the embassy instructions letter.

Don't forget to get CFO on your schedule also, not leaving the country without the CFO sticker.

Yes, CFO is on the list...

    Thanks Hank! :)

  12. It is not a stupid question. This processing is very un-nerving at best.

Follow the embassy instructions letter I linked to you earlier, use it as your checklist.

Helpful info in the link in my signature... follow the flashing arrow.

Exactly! Hope i'll stay sane after all these process is over! Haha!

Thanks! And yes, using your link as a guide. It's very very helpful! Sheds a lot of light for all of us who are in the dark. Lol... Thank you so much! :)

    God bless you! :)

  13. That is NOT residing IN a foreign country for 6 MONTHS or more.

    a. OTHER COUNTRY POLICE CERTIFICATES. Applicants aged 16 years and older must also present police certificates from other countries where they have lived for six (6) months or more after reaching age 16. As with NBI clearances, foreign police certificates should be obtained in any maiden names, aliases or nicknames used while in the country in question, including different spellings you have used of those names. Country-specific information on how to secure police certificates is available on the State Departments website at http://travel.state.gov/content/visas/english/fees/reciprocity-by-country.html.

I knew it! I knew it was a stupid question... lol...

Sorry hank, sometimes too much thinking leads to confusion... and this process definitely has gotten my brain twisted...

Thank you so much for your answer... i appreciate your help a lot! :)

  14. Hello everyone...

This may be a stupid question to ask but it just got me thinking....

I'm confused if during my interview they will require me for a police clearance for all the countries that I have been to during my employment working in a cruise ship...

My agency is locally based in the Philippines, the company is Malaysian Owned and we travel to 4 countries every other week, depending on which ship we are at.

For example, During my last contract, the home port of our ship is in Singapore so basically, we are there 2 to 3 days a week. And my contracts lasts 9 to 10months each time...

Do you think they will require me police clearance for that? We never lived on land but we are living inside the ship basically...

    Thanks for your responses....

  15. Ya they have that printed wrong from what USEM states as required. You only need copies of ONE or the OTHER; NVC letter or the Interview Confirmation Page from scheduling your interview.

Not sure what IN Transit has to do with anything, the letter from NVC is sent to your fiance (USC) once the package ships to USEM, he needs only to email you a copy when he receives it (trouble is NVC is slow mailing those at times - still no worries), but it is not vital for getting the medical done.. forget about it if you don't have it. Bring copies of you INTERVIEW CONFIRMATION page, write your MNL # on the copies and if the guard tries to give you BS about the NVC letter simply tell him the Embassy says ONLY one or the OTHER is required (not both), and the instructions letter is the OTHER requested document.

If you don't have the NVC letter don't worry about it.

Yes continue to complete your medical, for sure do NOT wait for a letter from NVC, it is not necessary.

Thank you so much! I will now go schedule my appointment for interview and medical right away.... :)

    Thanks again.. :)

  16. No, you do not have to wait. Once you have your MNL # you can move forward.

Pay your visa fee at BPI

Schedule your interview (I always suggest 4-5 weeks out from when you got your MNL#), print copies of the confirmation page for the medical at SLEC and the interview.

    Complete your medical

Hello again Hank! One of SLEC'S requirement is a copy of the NVC Letter with the case number on it, or if we dont have it by mail, a copy of he screenshot of the case number with "READY" status in it... they will ask for it when i go for my medical exam...

So, our case is not ready yet and still IN Transit and im afraid it will stay in Transit until up to my medical exam date to which i wont be able to provide them with that specific requirement...

Do you think i should still continue and pursue with setting an interview and medical appointment?

Sorry if i have to ask again... i just want to make sure about it. Every step is crucial... :)

    Thank you!

Thank you so much! We are just worried that somethin was wrong with our case thats why it was not ready yet and still in transit to CO.
