  1. Hi all,

    I am currently not working and haven't been since 2010, and so for Part 6 on the I-864, regarding total income for the past three years was 0.

    I have a joint sponsor (my Dad who makes above the poverty guidelines) who is filling out their own I-864 form to help me out with sponsoring my husband.

    The question is, for Part 7, do I leave this blank since I have no assets, or do I just put down 0 for all these fields?

    All the stuff regarding income will be on my Dad's (joint sponsor) I-864 form.

    It's so confusing!

  2. Hi all,

    We are currently at the AOS stage of the visa. This is our situation:

    • I am the US citizen currently petitioning for my husband's green card.
    • He is currently living in Australia and I am living in the US with my parents who are retired (I recently moved back from Australia).
    • I am unemployed (and have been since 2010), and so my parents (specifically my Dad) have agreed to be joint sponsor.
    • There are just 3 of us in the household (my Mom, Dad and myself) where my husband will be joining us should he be approved.
    • Both of my retired parents file joint tax returns as both of their income streams are combined.

    So what I thought I needed to do was file an I-864 for myself (even though I don't have an income), and my Dad - as joint sponsor (as he makes slightly more than my Mom) would also file an I-864, and my Mom would file an I-864A.

    But from the questions (particularly the one about Sponsor's Household Size), it seems to indicate that I have to file an I-864, but BOTH my parents file an I-864A.

    Also the question 16 in Part 6 (Sponsor's Employment and Income) says : "The people listed in Item Numbers 3, 6, 9 and 12 have completed Form I-864A. I am filing along with this affidavit all necessary Form I-864As completed by these people" - this also seems to suggest both my parents do an I-864A.

    This is so confusing. :cry:

    Any help for clarification would be much appreciated.

    Sorry been a silent follower here.

    I'm a kiwi, living in australia with my USC husband. So like you both we filed from abroad. My NOA1 was 24th March and was sent to Nebraska so I have a while to wait yet ... estimated end of July for my NOA2.

    On where we are in our Visa Journey, we received our NOA1 on January 26th and NOA2 on March 25th. So roughly 2 months waiting time. Our case was at the Potomac Service Center and is now at the NVC, We already paid our fees and now we are at the "fun" part of the journey...filling out the DS-260 and gathering documents to be submitted. So far the whole process has been easy. The NVC basically will send you letters/emails throughout the process, telling you what to do next. Oh, and btw, I am the USC and my hubby is the Aussie! If you have any questions, just ask and I will do my best to answer them. :)

  4. Funny you should ask, as we just received our NOA2 via mail yesterday!

    The date on it was 5 May, so it was almost exactly 2 months from the NOA1. As I understand it, we're supposed to get contacted by the embassy here for the next steps...I'll have to read up a bit more on what happens now. I was so focused on getting to this stage, I hadn't paid much attention to what comes next. lol

    Congrats Josh K!! Once you get your welcome letter from the NVC, you should call them and give them both yours and your wife's emails so you both get messages from them. Then you chose an agent that could be you, your wife or both of you. I went with the latter. (I believe this process is called the DS-261). Then you'll get another letter from the NVC about the two fees for the DS-260 and the AOS. They must be paid separate from each other and must be a US checking account. You only need the checking account number and the routing number. Then in about 3 -5 business days it should go through and once it says paid on your NVC page, then you can get access to the DS-260 to fill it out. Hope this makes sense to you....lol!

    So far the process has been very easy. My husband and I are now filling out the the DS-260 and collecting documents and paperwork for the AOS. :)

    So about how long was it between your NOA1 & NOA2?

    Here is some news you would be interested in....On April 12th, I received two emails (one for me and one for the hubby) from the NVC. It was the Welcome letter with our case # and what steps to take next. Just letting you know I didn't have to call the NVC for the case #. Glad because I didn't want to be put on hold for hours on end! lol!!! So just give about 2 weeks give or take to receive emails from the NVC from the date printed on the NOA2. Hoping you get your NOA2 soon! :)

  6. Nice to "meet" you! Sounds like our situations parallel quite a bit, then. :-)

    So, if you're a month ahead of us, it sounds like we have at least another month+ before we can even hope to hear anything. I'll be interested to follow your journey to see how ours might go! Best of luck!

    Hello there JoshK!! Just wanted to let you know that my husband and I received the NOA2 today. It had the "Notice Date" as March 25, 2016 and it took 17 days to be mailed to AU! Just wanted to let you know and hopefully yours will be coming soon! Oh, and I never received an email for the NOA2. so be aware if you are checking your email for the NOA2. :)

I'm the USC living in Australia with my partner, we've got the interview scheduled and very nervous/excited! Whilst I know people say you need to prove domicile, nothing in the process has mentioned this and the Interview documents didn't say anything either. I'm moving with relatives so hopefully that will be fine.

  8. From what I understand, the Potomac center was newly opened around 2015 or something? Maybe that's why?

    I'm just guessing, though. Perhaps someone else can shed some light on it.

    Let us know when your NOA2 comes through. Will be interesting to see if it's in line with the others in that thread...around 30 days + or -.

    Oh, okay, guess that explains it. Hopefully the Potomac is quick in processing and I will definitely let you know when our NOA2 comes through! :)

    I am just wondering where I can find step by step instructions on filing for a CR-1 visa? Where can I find checklists for each stage of the visa process? OMG this is all so confusing. Thank you in advance.

    Do I send all the supporting evidence when I send my I-130 in? Do I send it to the NVC? I know my husband will take it with him to the US Embassy in Casablanca but I am not exactly sure of what to send to USCIS and NVC. I really appreciate any help!

  10. No, they were like timeline graphs I found on this site, but I don't remember how I found them..so nm on that.

    However, I have notice on the processing page that they mention all the centers except the Potomac. So how in the world can ppl assigned to the Potomac Center know when Potomac is processing?

  11. Sorry to spam with something completely pointless to everyone, but couldn't help it...we sent off our I-130 to the Chicago lockbox today!

    Got all the paperwork together at the end of January for my wife & stepson (I'm the USC, and we all live in Australia together, so filing from abroad). I had to get my dad to send me checks as I no longer have any US checks, and the "overnight" envelope with the checks took about 10 days to get here, give or take.

    So that's it...just excited to finally be "on the path" after staring at the completed paperwork sitting in a nice, neat pile on the desk for the last 2 weeks!

    My husband and I are on the same visa journey, just a few weeks ahead of you and your spouse. Our Priority Date is Jan. 26, 2016 and we are assigned to the Potomac Service Center. We are currently awaiting the NOA2. Btw, I'm the USC and my hubby is the Aussie! :)

  12. You only got legally married once. The other was just a party. You would need a copy of the government issued marriage certificate from the legal marriage proceedings.

    You do need to give evidence of establishing a US domicile. You will need to meet the affidavit of support requirements. This FAQ can help >>>

    Assuming that you do not want to separated from your spouse for a year +/-, why not file from Oz and then move to the US together once the visa is issued?

    Read through the guides here on VJ and become familiar with the forms and what documents and evidence will be needed to secure the visa.

    Thanks for the useful advice - you have been very helpful, especially the link you supplied on the affidavit of support requirements.

    We plan on submitting the I-130 petition while we are both in Australia to the Chicago Lockbox address (seems that Australia does not have DCF).

    I, as the USC and petitioner, plan on travelling back to the U.S. for a few months in February, is this likely to be a problem? Do I need to be in Australia when the I-130 is approved?

    My husband will remain in Australia throughout the entire process though.

    New to VisaJourney and the entire process of immigrating my spouse to America. It's good to be part of this community.

    Just some background stats first:

    I am a U.S. Citizen currently living in Australia. I do not currently work. I am residing here as a permanent resident (not Australian citizen), but now wish to move back to the U.S. with my husband.

    We got married in 2011 in Australia (and again in the U.S. so that my relatives could be part of the ceremony). We initially went through the Australian visa process to get residence for myself in Australia, but now wish to move to U.S. to be closer to my family.

    So given that we both are living in Australia:

    1. Is it better to file the I-130 petition from Australia, or would it be easier for myself to move back to the U.S. and do it from there? I notice there doesn't seem to be a USCIS office here in Australia.

    2. On the application where is says place of marriage - which marriage location should I quote? We got married here in Australia in early 2011 and again in America later that same year. And is there any advantage on submitting photocopies of both marriage certificates?
