Hello everyone,
Is there any update on the denial issue going on with AOS based on filing chart dates?
please advise as I feel I would be going through same situation
Describe your case.
-
For Tampa, FL -> Nov 2015 is on the move.
-
You might wanna look at a similar case being discussed....
http://www.visajourney.com/forums/topic/595944-i-485-denied-based-on-priority-date/
Thanks for the reply... But my questions raise after reading that page only...

Completed AOS Interview under F2A, Officer did not approve on the spot, as would like to check priority date (We wondered, why officer did not check at the time of Interview). In end, we did not received any paper work at the end of interview nor my case updated.
My PD 05/12/2014 was current under Nov 2015 visa bulletin (F2A, 05/15/2014, INDIA).
My I-130 approved on Sept 2014. I have sent my AOS (i-485, i-765,i-131) on Oct 23 2015, received on Oct 27 2015 & Notice dated on Nov 3 2015. Check got Cashed on Nov 4th 2015.
Under what month (Nov or Oct) my AOS case filling registered? or I should have sent my file?
Did we made mistake by sending file a week early?
Will officer denied my case after Interview, due to file received in Oct15 not in Nov 2015? -
In bottom of that USCIS Additional Information page link. As per below, F2A applicant can file but only get approval if visa number is available. am I correct interpreting ? (Thats what I was trying to explain before, this time double checking with USCIS website)
****************
New Visa Bulletin ChartsThe Visa Bulletin will now have two different charts because of the revised procedures. DOS will post two charts per visa preference category in the DOS Visa Bulletin. The charts are:
- Application Final Action Dates (dates when visas may finally be issued); and
- Dates for Filing Applications (earliest dates when applicants may be able to apply).
When USCIS determines there are immigrant visas available for the filing of additional adjustment of status applications, the Dates for Filing Applications chart may be used to determine when to file an adjustment of status application with USCIS. Otherwise, the Application Final Action Dates chart must be used to determine when to file an adjustment of status application with USCIS. USCIS will determine which chart is effective for the following month approximately one week after DOS publishes and we will post that chart on this page.
In coordination with the DOS, USCIS will monitor visa numbers each month and post the relevant chart on this page under When to File.

Any update on this post about Priority date Issue? What USCIS has to say about Oct 2015 Bulletin.
-
My F2A i-485 for my spouse was denied because of priority date. But I want to know whether this decision was right or not.
My priority date was Sep, 12 2014. I filed i-485 on October 2015.
USCIS has rejected my i485 after interview based on the reason that visa number was not available based on October 2015 filing.
http://tinypic.com/r/2eaqtfb/9
http://i68.tinypic.com/1iijbd.jpg
I filed in October 2015 based on Section B of USCIS Visa bulletin of October 2015. Based on that visa bulletin, my cut off date for application was March 01, 2015
https://www.uscis.gov/visabulletin-oct-15
Please tell me whether this rejection was valid or not? Should I filed motion for re-open the file or file a new i-485?
Two more people has same problem and they resolved this issue via info pass. See link. There is positive outcome on your case.

Ohh... 3 weeks... Its just a day for me and I am worried with mine. Now more, as officer did bring this topic in Interview.
what did officer told you as outcome of interview, that case needs addition review, pending or will received notice in mail?
-
ofcourse I am trying to schedule an infopass which is near impossible as I don find available dates. But I will try as much as possible.
But I did quote that from section B from visa bulletin. I am confused what is going on and want to research as much as possible before talking with USCIS.
Yes, You have point here. You are right as they accepted you case at first. just stick with it that if PD was not current they why accepted the case. I am sure this will bring positive outcome.

After how may day of Interview that have updated this status?

I agree what you saying but the link you are claiming is not visa bulletin.
In note they says that clearly. every one must follow visa bulletin. It clearly mention that below table is for reference. Please see again.
""
Note: The Department of State (DOS) normally posts the new Visa Bulletin the second week of the month before it will take effect. The DOS Visa Bulletin is the official source of these charts. For ease of reference, below is the current chart (posted within two days of DOS’ new Visa Bulletin).
USCIS will determine which chart is effective for the following month approximately one week after DOS publishes the Visa Bulletin and we will post that chart on this page.
""Below is the OCT 2015 bulletin. If you read your link, it also clearly states the following in Section B
USCIS has determined that this chart may be used (in lieu of the chart in paragraph 4.A.) this month for filing applications for adjustment of status with USCIS. Applicants for adjustment of status may visitwww.USCIS.gov/visabulletininfo for additional information.
First of all, Its visa bulletin published by DOS not USCIS.
This link you are pointing is additional information link, on that webpage, they have specifically make a Note and clear that current page is for reference not a bulletin.
Its as simple as you ready.
I understand your position, but claiming that link to be true on Visa Journey website not going to make your point for i-485.
You should discuss that with USCIS, Ask them that if PD was not current then why they accepted i-485. You can also discuss that additional information page show the way PD was current.
I also finished my interview yesterday, and as i am in F2A category, officer informed me that he has to check the PD before he make decision. I am still waiting to outcome.
-
But how come it is not current in October 2015? It clearly states on their October 2015 to use those charts. My priority date is earlier than those charts. And that is the thing. Why did they accept my fees and accepted everything including issuing EAD and right now after interview, they rejected me based on this ........ this is so weird ........ I am super frustrated right now.
That page you are claiming as visa bulletin is not that actual bulletin.
-
Yes I did go to that link for USCIS website for October 2015.
Please see the charts for October 2015 and see what they guided .......
https://www.uscis.gov/visabulletin-oct-15
I dont know how they rejected this i 485 based on their guidelines published on their website ........
yap but see this page for USCIS October 2015 visa bulletin .......... which showed what dates they were using ......

I have used this visa bulletin published for October 2015 on USCIS website.
Based on priority date of Sep 2014 and using the charts on that USCIS website, how am I wrong? Or am I wrong? I just want to know whether this is my mistake regarding the filing or this is a USCIS mistake.

Sep 2014 PD was not current in Oct 2015 bulletin to file i-485. USCIS accepted your case that was possible mistake done by them at first place. As when i already stated, when I applied i-130 with i-485 they send rejection notice with all the forms and documents as PD was not current, and ask me to re-apply when pd gets current.
-
I was posting that to this post... Here is they way it read.
A. STATUTORY NUMBERS
This bulletin summarizes the availability of immigrant numbers during October for: (1) “Application Final Action Dates” (consistent with prior Visa Bulletins) and (2) “Dates for Filing Applications,” indicating when immigrant visa applicants should be notified to assemble and submit required documentation to the National Visa Center.
Unless otherwise indicated in this bulletin, individuals seeking to file applications for adjustment of status with U.S. Citizenship and Immigration Services (USCIS) in the Department of Homeland Security must use the “Application Final Action Dates” charts below for determining when they can file such applications.
This bulletin may indicate the ability for such individuals to instead use the “Dates for Filing Visa Applications” charts, when USCIS determines that there are more immigrant visas available for the fiscal year than there are known applicants for such visas. Applicants for adjustment of status may refer to USCIS for additional information by visiting www.uscis.gov/visabulletininfo.
I hope you it will clear the confusion.

However looking back at your snaps of rejection letter, while USCIS has accepted your AOS application, it should not have arranged for your interview. They cannot issue you a GC unless your priority date become current which is the final action cut off dates. The filing dates is for filing AOS only not for giving out the GC.
Agreed here. IF PD is not current they should not cashed check here.
By mistake I applied i-485 with i-130, and they reject my case sent all documents back with rejection notice.

FYI
This is Oct Visa bulletin used by USCIS which clearly says the dates for filing family-sponsored Adjustment of Status.
October 2015Note: This bulletin supersedes the bulletin for October 2015 that was originally published on September 9, 2015.

VISA APPLICATIONS
The chart below reflects dates for filing visa applications within a timeframe justifying immediate action in the application process. Applicants for immigrant visas who have a priority date earlier than the cut-off date in the chart below may assemble and submit required documents to the Department of State’s National Visa Center, following receipt of notification from the National Visa Center containing detailed instructions. The cut-off date for an oversubscribed category is the priority date of the first applicant who cannot submit documentation to the National Visa Center for an immigrant visa. If a category is designated “current,” all applicants in the relevant category may file applications, regardless of priority date.

That particular does not says about USCIS AOS, only point to NVC.

I am no expert here but here is what I think. I also fall under F2A, yesterday, in my AoS interview officer want to double check the priority date before he approve case. We also stuck here. My PD is 05/14/2014 and filled AOS in Nov 2015.
1 Mar 2015 is for NVC filing, which has nothing to do with USCIS i-485. it says in "Date for filing Application" para. So it seams that your priority date was not current at the time of filling.
Did officer reject after interview or you received website update for it? Now, I am double checkin my dates.

Finished Interview at Tampa Office.
Get Ticket number and waited four number. After 25 min, officer called our ticket number and walk us to the room. Before we sit, He took us under oath. Than ask ID & Passport, verify name with form. "Officer was very nice and professional."
Entire interview was like conversation than Q&A. We interviewed together, nothing related to personal or current life. Interview last for less than 30 mins.
- First request us to give supportive evidences, if any thing new. We gave Tax 2015, Life, Health & Auto Insurance, He asked copy health claim made using current insurance.
- Than asked petitioner about Job and position. After that I presented, Joint account details and he requested to show the statement where petitioner’s pay deposited.
- Officer asked some questions about name of in-laws, verify my SSN & phone or any name change.
- I was entered on F-1, so he asked me about study, which was completed. Luckily, i brought copy of degree certificate, he was pleased to see that.
- We showed family pictures to officer, to keep in file. Also, we submitted current lease & credit card year end summary.
- Then officer ask “No” questions of i-485. in end he ask when, where & how questions about marriage.
I asked him about conditional card, he said no as our marriage has more than 2 years. He has not given us letter saying pending, review nor stamp my passport.
Still my status on website shows "Interview is schedule"
Waiting update…
-
while we are waiting, this link might be interesting. I am not sure about truthiness, but it explain many area of processing.

It has been officially over 5 months since we submitted our AOS packet. We received a RFE for an I-693 which we replied to. For the past week I have been trying to submit a case inquiry since we have been waiting so long. It keeps telling me that we are within normal processing times. Our local office is Tampa, but we had to send our RFE reply to Los Angeles. So we are thinking we were transferred, but we were never notified of the transfer. So I don't know which local office processing time to follow.
Has anyone from November 2015 been able to successfully submit a case inquiry?
Thanks!
When I did case inquiry, it ends up with the reply "case is within normal processing time". On 4/4, i got IV conformation for MidMay. it took 6 months to get update on my case (No RFE). My i485 receipt date is Nov-3, I believe you will see some movement in your file soon.
-
After long wait, we received update for an interview.
-
Are there many October filers waiting for their green card interview date?
i-485 is on "Fingerprint Fee Received"

In case you don't hear any thing than file Online Service Request for USCIS web, they will usually respond in and around month. after month, if u still waiting, take info pass.
In my case office told that I will receivers paper work in a week, but nothing for next 3 week. I did service request that case taking longer than usual, as officer did not give me any paper work at Interview. after month of service request they assign officer and approve the case.
it took 55 days to get paper work after Interview.
