Thank you so much for your quick responses. Very helpful and very much appreciated! Yeah the job will be in Abbotsford BC. So ya I guess we will start looking for place in Washington and commute cross border to work til I get my citizenship. Its cheaper to live in WA anyway real estate wise. But I just have to pay for my healthcare out of pocket since I wont have a job here which sucks...

I am a green card holder now for 7 months. I have been recently offered a job in BC Canada. The job is close to the US/Canada border.
Can I keep my green card status while I work in Canada? Do I have to live on the US side (Washington state) to keep residency status or can I live on Canadian side (closer to work) and still keep my status as long as I continue to file my taxes to IRS, keep US drivers license, etc? What is the best way to do this? It would be nice to start getting the monthly baby bonus again and maybe free health care.

something similar happened to us. We were waiting for an apartment while living in the house of a friend. According to and advice of a lawyer do you have 2 options:
1 - file the petition with this temporary address and wait till the moment you receive your first notification ( KNOA1 ) to notify the change of address
2 - Wait to the moment you have the new address.
She advice us because at the beginning you don't have a case number to track so it could be something difficult.
to change the address follow this link uscis change of address
Thanks a lot inloveVEN

Also, I have a follow up question.
Husband recently got a job in the u.s. and will be moving there by the end of May. He will be staying temporarily with a friend for 3 weeks as he looks for a place to stay permanently with his wife in the future.
They plan on submitting their application by the end of this week. What u.s. address should they put in the Affidavit of Support under the sponsor section? Should they put the address of his friend even though he is going to move out in 3 weeks? Can they change the address on I-864 while its still with USCIS or NVC or at the interview? how easy/hard is it to change address? is this going to delay the process?
Thanks for your help in advance!

Canadian income didn't matter unless the job was to continue in the USA. Basically counts as nothing so wasn't above poverty guidelines.
Current income is the issue for them, but as mentioned 2016 complete tax return will be needed for the NVC and interview.
Interesting. so do you suggest getting a joint sponsor then? his new job is definitely above poverty line but wont have a tax return til the end of 2017.

Hello. A friend of mine is currently filling out I-864 for their K3 visa application.
Just a little background, both husband (American) and wife (Canadian) currently reside and work in Canada and has been for a few years. Married last year. Husband recently got a job in the u.s. and will be moving there by the end of May. He will be staying temporarily with a friend for 3 weeks as he looks for a place to stay permanently with his wife in the future.

Regardless of whether he uses a co-sponsor or not he is REQUIRED to file his 2016 tax return, unless he is not required to by the IRS (i.e., if he is making too little money, in which case he needs to provide evidence that he is not required to file his taxes). The 2016 tax returns don't need to be accepted, but he will need to file ASAP. He will need to provide the following documents to submit with his affidavit of support:
- I-864 form.
- 2016 Tax Returns with W2 forms if available.
- 2014+2015 Tax Transcripts or Tax Returns + W2 (OPTIONAL).
- Letter from employer.
- Additional proof of income (pay stubs, etc.)
Regardless of whether he uses a co-sponsor, he MUST file his 2016 US Federal tax returns.
Thank you agripa for your response.

Hello,
My friend is currently filling out I-864 form but is stuck on the income portion.
A little background, he (american) and wife (canadian) are both living and working in Canada. Married last year.
He filed 2015 u.s. taxes on his Canadian income but did not file for 2016. income is above poverty line.
He just got a job in the u.s. this year (2017). income is also above poverty line.
Can he submit I-864 with 2015 tax return attached? or does he need to wait and file 2016 tax return and attach that to I-864? or can he attach proof of current employment in the u.s. showing the salary instead? they want to know the quickest way to do this. Is it quicker to get a joint sponsor instead?
If you guys know of a thread that already explained this kind of situation, can you please direct me to it? Thanks!

So I have another question.
I received packet 4. On page 3, it lists all the possible documents that I need to bring with me to the interview, which includes original police clearance, I-864 AOS and proof of domicile. However, I also got a very recent email from the Montreal Consulate giving me a shorter lists of things that I need to bring to the interview. The email is below:
In reference to your immigrant visa case, please bring the following on the day of the interview:
- Two recent passport size photographs on white background (you may not wear eye glasses)
- Medical exam from one of our panel physicians in Canada as instructed on your appointment letter
- Original of your birth certificate (version with your parents’ names)
- Original marriage certificate
- Photocopy of your petitioner’s U.S. 2016 (if filed) tax return and respective W2s
- Photocopy of your joint sponsor’s U.S. 2016 (if filed) tax return and respective W2s
- Final U.S. address and U.S. telephone number (we are missing the U.S. Telephone number)
**Please bring a photocopy for each original document and Original translation you are submitting at the interview.
We thank you for your cooperation.\
My question is, do I still need to bring original police clearance, I-864 and proof of domicile? I sent my original police clearance to NVC awhile back and got a newer police clearance just in case (the first one was in Sept. 2016 and the newer one is March 2017). Or should I just bring the documents they mentioned in the email?

I don't know about Canada, but it is required in Jamaica.
thank you for your response. What does this step do? is it just a confirmation? I am trying to register now but I hope it wont mess up my current interview schedule.

I really feel sorry for you, I do not want to point fingers to any one but the facts show something fishy is going in Nebraska and Philippines.
After August 26 2015, Philipines is the only country with approved cases, not 1 but 6 cases and on top of that to put the icing on the cake, they mistakenly routed your case to Philipines. I let you guys be the judges. Some one should be investigating on what is going on in there. I read on an earlier thread it was due to a typhoon.
Note: France has 1 case approved with NOA1 after August 2015.
I am not sure about the typhoon. I thought that benefit was 2 years ago and might have expired already? Im not sure. For people who were affected by the typhoon, they need to provide pictures/proof that they were affected. I didnt. So I dont know what the deal is with NVC. I am just disappointed how they handled my case. Just because I was born in Philippines doesnt mean I still live there. I have my current Canadian address entered multiple times in my application more than my place of birth. I also provided them my Canadian passport, employment letter, house purchase, etc. that prove I live in Canada. But oh well. Happy New Year!!

I got my case approved in nvc but they assigned it to the wrong embassy. I emailed them to correct it and im still waiting for their response.
-
Good luck everyone. I just sent NVC an email regarding my situation and that I need them to change my embassy from philippines to canada. Thats another month of waiting for me before I can proceed to the next step after receiving NVC case number. I dont mind waiting since my wife and I and our kids are living together already. The wife just wants to move to the U.S of A.
I am happy for everyone who are progressing and wish everyone good luck!
-
I need to email them to change the embassy they assigned me. What is the email that i need to use?
-
Hi. I called them too and they gave me my case number. Unfortunately they assigned me to the wrong embassy. Im in Canada but for some reason they assigned me to a philippine embassy because i was born there.

Any lucky soul who's advanced with NVC?
I just called (no waiting time at least ) and still no news...
Guess I'll try next Friday again.
No luck for me either. I called yesterday. Im thinking of giving them a couple of weeks before I call back.

Hi , What was your wife asked at the port of entry when she visited you on a B1/B2 visa . Is it possible to travel when your 1 130 is in process
I read that you need to have a very strong evidence that you have plans on returning home and not stay in the u.s. A return ticket will not be enough. You need to prove that you have assets, a job or a business from your home country.
-
Who knows! Maybe you're already lucky and don't know it yet ;-)
When they say 42 days, is that 42 business days or calendar days?
-
Called NVC again. Like the first time a week ago, I waited between 20-25 minutes.
Still no tracking number... again reminded of the 42 days estimate since they received my case on November 12th.
I'm hoping for better news next week. I'd love to read you're lucky as well!
I was actually planning on calling then today but after your comment i might wait a little longer then. NVC received my packaged Nov 9.

When is it the best time to call? No luck so far at all!
I called them the first time in the morning which was 10am EST. It took 5 calls before I was able to get in. The 2nd time I called was 1pm in the afternoon EST. I tried 3 times before I got in. Wait time was about 15 mins before I spoke with someone. I would suggest to call right when they open business in the morning.

Do you guys know what is my best option regarding health care? My family and I will not be covered here in the USA with my job being in Canada. Does that mean I have to pay out of pocket to get medical coverage? I believe dental and eyes are covered through the company.
