    Also interested to hear other experiences when it comes to getting a stamp, particularly in NY. I tried to schedule an appointment but was told that they are scheduled within 30 day of the expiration of the extension letter.

    Thank you.  The issue is not related to I9 Form/employment verification or work authorization, but to the permanent resident status.  Work requires access to information limited to US citizens or permanent residents. So the system flagged that the 18-month extension is expiring soon, and I was contacted to provide proof of continued LPR status to maintain access.

    My 18-month extension letter is expiring in November and my case status has been ready to be scheduled for an interview since April 2020. It seems that the only way to prove LPR status after the expiration of the 18-month extension is to get an I-551 stamp. I am a little concerned because I need to prove LPR status to my employer after the expiration of the 18-month letter to keep my job. Can anyone share their experience with scheduling an InfoPass appointment? I have been reading a few posts and it seems that these appointments are not obtained easily and are for emergencies only.

    If you require a stamp for ongoing proof of status and employment verification/I-9 when the initial letter expires, that is currently an accepted reason for an infopass appointment for an I-551 stamp in passport (or on an I-94) during covid.

     

    However, be assured that your spouse remains a LPR even without getting a stamp...just no way of proving it to anyone except USCIS without it.  

     

    Thanks so much! I think we will have to get an Infopass appointment for an I-551 stamp to prove LPR status.  I have been reading that a few people had issues trying scheduling these...hopefully we are able to get one without major issues.

    Could anyone point me to the language in the code stating that after filing the I-751, an LPR retains legal status until the case is adjudicated? I was under the impression that this was the case but my spouse and I cannot find this information on the USCIS website. My spouse's employer requires permanent resident status to be employed and their 18-month extension will end at the end of November.

    We will have to send our ROC package in a few weeks, so we just wanted to get other people's feedback on the evidence we are planning to send, and whether it would be enough for our ROC to get approved. We are planning to send the following: 

     

    ·       Copy of the marriage certificate between LPR and USC

    ·       Copy of a Residential Lease Agreement listing us as joint tenants at xxxxxxx; the ”Old City Address”, beginning October 1, 2016.  This lease was a month-to-month lease and was renewed on October 1, 2017.

    ·       Copy of the Lease Renewal stating both our names the “Old City Address” with October 1, 2017 as the renewal date.

    ·       Copy of the Notice of Intent to Vacate the “Old City Address” sent to the landlord on March 1, 2018 and signed by LPR and USC indicating a move out date of March 31, 2018.

    ·       Copy of LPR Old City driver license showing residence at the “Old City Address”

    ·       Copy of LPR valid passport issued on November 2, 2017, showing residence at the “Old City Address”

    ·       A copy of LPR and USC February 2018 paystub, prior to relocating showing residence at the “Old City Address”

    ·       Copy of Utility bills at the “Old Address” showing both of our names

    ·       Copy of the New City Rental Lease Agreement listing us as joint tenants at xxxxxxxxxxxx; the “New City Address”, beginning on April 1, 2018 and ending on October 31, 2019. 

    ·       Copies of utility bills showing both our names responsible for paying the electric bill in our New City Address

    ·       Copies of the internet and gas bills showing  USC as responsible for paying internet and gas in our joint New City Address

    ·       Copy of the New City State Certificate of Title showing USC as the owner of our car with our joint New City Address

    ·       Copy of a verification letter from  Bank showing both of our names under the same account number that was opened on March 7, 2018. We had a joint account prior to that date with  Bank, however, we were not able to obtain information on that account since it was closed because of an identity theft incident, which has been reported to the Internal Revenue Service (IRS) and Federal Trade Commission (FTC).

    ·       Copy of LPR and USC FTC reports with a personal statement indicating the identity theft incident and showing our joint Old City Address

    ·       Copy of USC and LPR 14039 Identity Theft Affidavits that was submitted to the IRS.

    ·       Copies of monthly bank statements of our joint checking account with X Bank since inception of the account on March 7, 2018 after the identity theft incident, showing various financial co-mingling such as rent payments, groceries, utilities, and car insurance payments, etc.

    ·       Copies of monthly bank statements of our savings account with Y Bank since inception of the account on June 24, 2017, which shows USC and LPR as the joint owner of the account.

    ·       Copies of the X Bank credit cards of LPR and USC ending with the same 4 digits (xxxx), and a copy of a verification letter provided by X Bank on February 16, 2019 indicating joint ownership of the credit card account since inception on January 15, 2017.

    ·       Copies of the Y Bank credit cards of LPR and USC ending with the same 4 digits (xxx), and a copy of a verification letter provided by Y Bank on February 22, 2019 indicating LPR as the account owner and USC as the authorized user.

    ·       Copies of the auto insurance cards directed to USC and LPR and mailed to our joint New City Address.

    ·       Copy of the Life Insurance policy showing LPR as the insured and USC as the beneficiary; we don’t have joint health care insurance since USC is 25 years old and can remain on her parents’ health insurance which is free of charge for us.

    ·       Copy of April 9, 2018 Beneficiary Confirmation Notice for the remaining of 2018 benefits showing USC as the beneficiary of LPR’s Accidental Death & Disability (AD&D) and life insurance policies, which are provided through the workplace of LPR since he started working there. 

    ·       Copy of December 5, 2018 Beneficiary Confirmation Notice for 2019 workplace benefits showing USC as the beneficiary of LPR's Company 401 (k) Plan, AD&D, and life insurance policies, which are provided through the workplace of LPR.

    ·       Copy of the Company 401 (k) Plan Account along with copies of 2018-Q3 and Q4 of Halim Abourachid indicating our joint New City Address and showing USC as the beneficiary.

    ·       Copy of LPR  ROTH IRA account, which was open on January 3, 2019, showing our joint New City Address and indicating USC as the beneficiary.

    ·       Copy of USC Fidelity ROTH IRA account, which was open on January 3, 2019, showing our joint New City Address and indicating LPR as the beneficiary.

    ·       Copy of 2016, 2017, and 2018 Tax Returns. 

    ·       Copy of flight tickets, gifts, cards, and booking of planned vacation. 

    ·       Copy of Verizon Plan Information showing LPR's device in the family Plan of father in law. 

    ·       Copy of renters insurance policy (active from Jan 2019) and showing both our names and our new city address

     

    Is there anything else we should add? Would the above be enough for USCIS?

  8. Hi everyone, 

     

    My passport will expire in a few months, and I would like to renew it before I go to Morocco.  I read the available information on the Moroccan Embassy in NY website, and it seems like they request sending the old passport with the application packet through mail.  

     

    Did anyone do this before? Also, do they return the old passport? 

     

    I would really appreciate it if someone can shed some light on this.  (Traveling to the embassy might not be an option since I might not be able to take off work)

    yes I attended 4 job interviews already! Haha Actually I just explained to them that I'm currently adjusting my status and will recieved my EAD this month! I got 2 of them that are willing to wait until I got my approval. Just today I have another interview and I explained my situation. So I told them a rough estimates on when I will recieve my EAD but that may change because of some delays. If the employer is willing to wait for you then they will tell you. There are several jobs opening in my area and I couldn't pass it up without applying. At least I tried and if they can't wait for me that's fine and if they can that's even better! I'm hoping to get my AED on the 17th. I already made a service request online and call USCIS hoping to speed things up but realistically I don't think that'll make a big difference. 

    Congratulations! great to hear that. I haven't been successful in my job search. Would you mind sharing what field/position you applied for?

Personnally I don't think it speeds the process, I still don't have any news and it starts to be long! I contacted the congresswoman in my city but no news either for now. 

    We have similar timelines, I filed on November 3rd, they received the package on the 7th and still no news as well.

    I received the same response via email after submitting the service request and it doesn't seem moving. I hope we will hear something next week!

    I had few phone interviews but no in-person interview. First thing they ask is the visa status. My experience wasn't very positive as they required authorization before going forward. Some of them even require Green Card (Ability to work without duration restrictions). Explaining that the EAD is valid one year while they process GC wasn't enough as nothing is guaranteed when it comes to immigration process. 

    However, I have read here that many people are having job offers before even getting EAD, so it depends.

    Yes I did both the same day. They didn't have any times for the driving there for over a month and half(!) the guy saw my shock and said he could ask his supervisor if I could do it today....duuh yes!! So I did both :) 
    Otherwise I would have had to go around to different dmv's or try to find one with walk-in.

     

    edit: I think he realized how hard it is to be without license when you just moved here from another country..  he was very nice :)

    Lucky indeed that what I was told too. After the computer test, I m supposed to look for a spot online and it might take few months before I can schedule it. 

     

    Indeed, being able to drive is important here
