  1. I had a request for further information. I have been insanely busy at work, working weekends, travelling etc, and got my dates muddled, resulting in me sending out the further information late.

On the day *I* mailed the evidence, the USCIS mailed a letter to me saying that my petition is considered abandoned and is hereby denied.

It says I now have no residency rights nor right to employment.

However it says the denial is without prejudice to the filing of a new Petition to Remove Conditions on Residence I-751. This confuses me because I apparently am no longer resident.

There are three bases upon which I can appeal and none apply to me.

I am sick with worry and kicking myself after this stupid mistake. Does anyone have any advice?

In same situation right now. can you update yours please? thx

  2. So I have a question about my case.....

I went to my interview for my AOS with my husband, and at the end of the interview she asked us for documents I didn't have with me so she gave me a RFE to return 30 days later (jan30-saturday).

I did return it on the same day but for mailing reasons, which was my fault, it came back to my address one day before the deadline, so the local office never received it. So on Jan 29, I ran to the post office and sent it back using the certified mail. The package was delivered on Tuesday at my local uscis office on feb 2. However I personally went there on Monday (feb 1) with another package with the same evidences and with a letter telling them what happened.

So, the mail was delivered on feb 2 and uscis updated my case status online saying they "received my correspondence and uscis is reviewing it". My question is: does that mean they accepted it even if was 3 days past the deadline and added it to my case or it just means that they got the package but I can't think yet that they updated the evidences to my case???

Also: my deadline was on Saturday (in case it just changes the deadline to next business day) and I personally delivered my evidences on Monday at the office, before they got the package in the mail on Tuesday, just to make sure this time they would get it. Also read on their website that they give 3 additional days when responding a RFE.

Can someone help??? I'm sooooooo worried!!!!!

    Thanks

I'm in the same situation right now. Can you give me an update please? Thanks!

  3. We were both occupied because we moved from New York, i almost got fired from job, so had to quit to get another job, got another job then got promoted at other job, moved for new job. Had a miscarriage in the middle somewhere, and she is pregnant again, so in all of this it was very easy to forget since we didn't think of it as important, my wife is a housewife so she doesn't need to go anywhere, i take her wherever she needs to go like getting the groceries and stuff. Nor does she want to work and i don't want her to work either. So AOS was useless, but now we want to travel so it has become important. Anyways... Thank you all for helping and answering my questions. Also thanks to those that have yelled at me and wished me luck, it shows you guys care for another VJer.

Do you have any updates? I'm in the same situation right now :(.

    Thanks

  4. Yes. I am in the Army and my wife got her I-693 done at Madigan Army Medical Center at JBLM, WA. Military hospitals do have doctors that are Civil Surgeons, you just have to do a little bit of searching. The best part is that is totally free including any vaccinations needed as long as she in already in DEERS.

Where are you stationed at? maybe I can look some up.

We are in Patrick Air Force base right now. Can you help us out? I need to get the vaccination done :(. Or can you tell me how to look it up? Thank you so much!

  5. Sorry, as in exam, I mean vaccines. Have the civil surgeon do the vaccines for you and complete that portion of the I-693.

There are a lot of people here who have their vaccine records transcribed onto the I-693 by a civil surgeon.

I just looked at the I 693 and lots of it were completed during my exam in Vietnam. However, I do not have any records to show it to the surgeon. Can I just come and get the vaccination and be done? Can they just file the vaccine part?

    Thanks

  6. Ahh, yeah, you'll most likely receive an RFE for not submitting the I-693.

Since you don't have the vaccination sheet, you'll probably need to get the whole exam done and have a civil surgeon fill out the I-693. You may be able to send it once you get the NOA1 but, there's a chance they may not be able to match it up.So, it might be best to just wait for the RFE. Responding to an RFE usually only delays the case by about 1-3 weeks.

I already got the medical exam done, just not the vaccine. I guess I'll be waiting then. Thanks

@all: anyone filing AOS from K1 having some experience here? Thanks.

  7. Just wondering, does my medical package that I turned in at POE (k1 visa) includes my vaccination worksheet? I didn't include my vaccination worksheet for the AOS package :(. I thought I didn't have to since I don't have the original copy either.

    Thanks

Edit: I also don't have enough required shots because some of them were marked as D. What can I do now?

  8. My sputum test was negative and after 10 weeks, IOM called and gave me back all documents, submitted to US embassy on 3rd December and got my visa on 10th December. I arrived in US on 23rd December. Tell me about you, send me an email, hope i can help. My email: nguyenthanhthaovn@gmail.com. Good luck to you!

Did they mail the document back to you or you came pick it up? I was hoping I can get it after 8 weeks :(.

    Emailed!

    Thanks

  9. Hi, sorry for my late reply. I am on my 8th week and really nervous. Hope the result turn out with negative. Thank you for you sharing

Have you heard back from it? and what was the process after that? I'm in the same situation right now in Vietnam as well. Thanks

  10. I am not making assumption. I have lived and experienced it myself. You are very naive to think that coffee money does not go a long way in a country that is run by one of the most corrupted governments in the world. You've got a lot to learn, kiddo.

    Good luck with you interview.

LOL I didn't say it won't go a long way. I was just saying it's not ALWAYS the case. It's not always that you have to use coffee money to get ahead of things. Don't be too negative, old fart.

  11. If I recall correctly, I had no medical package at all for the interview. The doctor's office sent the whole package to me when the TB test was done, and I forwarded it on to the embassy at that time.

Oooh I hope it would be the case then I'll at least don't have to worry abt it. I'm waiting for the embassy to email me back. Did they keep your passport until you have the medical package?

  12. Well, it's good for you that you did not have to wait. But it is very immature of you to make personal attacks on these public forum without knowing all the facts. Shame, shame.

Btw, she is not the only who thinks everything will be OK with coffee money.

Not sure if that's personal attack. Just trying to tell you that it's not always the case and it seems that you keep making that assumption everywhere.

  13. I don't know where you are, and it may depend a lot on that, but I went to my interview without the medical being complete because of having to do the spit test. They looked at all my other paperwork and then just waited until the TB results came back, and then I got my visa.

You might check with the embassy where you will interview, to make sure.

    Good luck

Did they send you the medical package without the TB or you went in without the medical completely?

    Thanks

  14. I would advise against going to Cho Ray. Long story short, my then-fiancee made an appointment for her medical exam a week and a half before flying to Saigon (she lived in Central VN). On her appointment date, she went to Cho Ray, got a ticket and waited for almost 2 hours, then when her ticket got called, she got the usual run-arounds until they told her that her appointment was not for the K-1 medical exam, and that they no longer performed medical exams for K-1 visas. WTH??? Maybe they wanted some coffee money and she was not planning on giving any. She frantically called me and I made a call to IOM. They were able to squeeze her in the same morning and she was in and out in about 2 hours.

I was told there are huge signs at Cho Ray warning you of pickpockets. In the waiting areas!

I would advise getting the vaccinations first before going to Cho Ray or IOM, and you don't have to make 3 separate trips.

Been following all your posts for a while. Just wanna tell you from my exp today is that it's your wife's fault for making the wrong appointment. I literally walked in and didn't have to wait a sec. I've been living in Vietnam for over 18 years and never have to pay any coffee money or whatsoever. I think your wife just thinks everything will be ok w/ coffee money. Tsk
