    I am from Pakistan, I just got US spouse CR-1 visa and will move to US in next month. I want to ask following questions with background explanation of my case:

    My wife is US Citizen and has four years US born daughter from her ex Pakistani husband who had died in Pakistan in Car accident during immigration process & my wife withdrew his immigration case. From 2014 to 2015, my wife had received food stamps and WIC (Nutrition Program) for her daughter. In January 2016 we got married, she stayed with me in Pakistan uptil now and her daughter remained in US with her grand mother. She visited her parents and daughter in 2017 for two months only and after that she came back again to Pakistan. Her daughter continue to receive WIC from 2016 uptil now.
    We have joint sponsor in our case,  Now question is that when I'll be in US "Does my wife still eligible to receive food stamps/WIC for her or for her daughter?  If she receive food stamps/WIC does joint sponsor has to repay the Cost? 
    Other question is that when I will be in US which Federal, state, or local means-tested public benefits, I am not eligible to receive? Can I get health insurance?
    Kindly answer above questions.

    I had given interview for CR-1 visa in first week of April in US Embassy Islamabad, consular man took my interview for 5 minutes only and issued me a slip with administrative processing highlighted on it, and he kept my passport.  Now I want to ask following questions:

    1)-I am an Electrical Engineer and get a Job in UAE, is it fine to request Embassy to return my passport as I got job in UAE.

    2)-Other question is that if I move to UAE can administrative processing take longer time? 

    3)- Third question is that if I move to UAE, is it easy to get police clearance certificate from UAE?

    My wife is currently in US to meet her parents, and she is willing to move with me to UAE.

    Please answer above questions.

  3. I have got interview letter from NVC, my question is that if consular office question me "where did you first time meet your wife"? Is it right to tell him that we have met on matrimonial website two years back. Me and my wife have no records of that website as that was not free website. Also on that website after every two months they delete all messages from both sides but we have previous email records with us. Please someone guide me. 

  4. Hello, my case is currently at NVC stage. My wife has applied for my CR-1 visa. I want to ask following question:

    My wife's aunt is sponsoring me (joint sponsor) in my case. She is married & filed tax jointly with her husband and they have no children. She told us that her income is much above than poverty guide lines then there is no need for her husband to sponsor me by filing the form I-864A. Aunt has provided us signed I-864 with ACTUAL tax return and her W2 of year 2016. Does NVC can ask us to submit form I-864A filled by her husband or not? Please answer me.

    With regards to filing from overseas with zero US income, she will need to file a 1040, and also a form 2555 EZ which is the exemption form for foreign income.  As long as she didnt earn more than just over $100K they don't tax her but it needs to be declared. The form can be a little confusing. Get her to download both the 1040 for 2016 and the form 2555EZ (or form 2555 ... the instructions tell you which one) and get in touch with me on messenger if you like.  I just went through all this for my hubby :-)

  6. Please answer me following question. 

    We got married in Pakistan in January, 2016. My wife lived with me for whole year(2016) in Pakistan and didn't do any Job in Pakistan. She went back to USA in January, 2017. Does she need to file tax return in USA for year 2016 even with zero income as she lived outside USA for whole year? Or can she file the tax return with by filing the form 1040 with Zero income, to have a proof that she filed tax return with zero income.  We have already submitted our case to NVC and waiting for approval.

    - My wife is USA passport holder & her income of previous years is

    2015 5000 US $ after tax return

    2014 400 US $ after tax return

    2013 0 US $ after tax return

    She was not in USA in 2013 that's why her income is zero. Now question is that she had taken food stamps in year 2014 and 2015 with her Job as she has two years daughter from her ex Pakistani husband who died in Pakistan in 2013 and he didn't come to USA. We have joint sponsor wife's uncle in our case. Is it fine or is it acceptable by NVC as my wife did job, only made 5000 US $ in 2015 & had taken food stamps but we have joint sponsor who has income much above than poverty guidelines. Does NVC will approve our documents with Joint sponsor? Also is to good to tell NVC on separate sheet that she had taken food stamps in 2014 & 2015.


    -My wife is currently in Pakistan since our marriage as we got married in January 2016. What she has to write in her current income zero "0". Also is to good to tell NVC on separate sheet that she is in Pakistan that's why her income is Zero.


    -Can we send all documents to NVC via DHL or FEDEX from Pakistan including joint sponsor's affidavit of support? My wife is my agent in DS-261 but she is in Pakistan. Or we have to send documents to my wife's home in USA then her sister send these documents to NVC? Can my sister in law submit/post these documents with her name to NVC with her name or she should post these documents to NVC with my wife's name?


    -My wife filed her 2015 & 2014 tax returns as single not as a widow because her ex husband was died in Pakistan in 2013 after 1 year of marriage and he didn't come to USA so she filed single as he has no status in USA, is it fine or is it acceptable?


    -My wife didn't include her daughter in 2015 & 2014 tax returns because her daughter is dependent on her grand father's tax returns in USA since 2014. Does my wife has to include her daughter in sponsor's house hold size in form I-864 or not as her daughter is in her grandfather's tax returns since 2014.

  9. if you had income state your income. just include a note saying that your incone was below the threshold that required you to file taxes.

    Can you please tell me what is the minimum threshold level that required to file taxes in USA?

    Yes, if you read the I-864 Instructions: https://www.uscis.gov/sites/default/files/files/form/i-864instr.pdf

    Page 8:

    "Do not leave the boxes for Item Number 19.a. blank. Print or type the most recent tax year and your total income for that most recent tax year. If the amount was zero, enter “zero” or if you were not required to file a Federal income tax return enter “N/A” for not applicable."

    " If you were not required to file a Federal income tax return under U.S. tax law because your income was too low, attach a typed or printed explanation. "

    Ok, we will not write zero but can you please tell me what is the minimum threshold level that required to file taxes in USA?

    I want to ask following question please guide me in this matter:


    My wife is USA passport holder and my case has approved by USCIS and forwarded to NVC, question is that she was university student and did some part time jobs during her holidays in 2014 and 2015 in USA but she didn't file tax returns as she didn't make too much money. If my wife write in form I-864 that she was college student and didn't do any job or didn't make enough in last two years is that acceptable or should she have to file tax returns for last two years i.e 2014 and 2015 but she is already late and since January 2016 she in Pakistan with me after her marriage.


    Please reply to above questions.

    My case has recently approved by USICS and forwarded to NVC for IR-1/CR-1 visa but problem is that my wife didn’t do job for last three years as she was university student. I want to ask following questions:

    1) As a main sponsor my wife has to fill the form I-864 even with zero income?

    2) Can we use two joint sponsors for IR-1/CR-1 visa as option is available in part 1 item 1.e of form I-864 “first joint sponsor “ and “second joint sponsor”? If it is true then my both brothers in laws can be my joint sponsors? Both are single and their annual salaries are low because they do part time job with studies? In that case both of my brothers in laws have to fill individually form I-864?

    3) Can we use two joint sponsors for IR-1/CR-1 visa like “first joint sponsor my brother in law” and “second joint sponsor my brother in law’s friend”? Is it acceptable? If it is true then both have to fill individually form I-864?

    4) If my brother in law is my only/single joint sponsor then how to calculate sponsor’s house hold size? My brother in law is single. House hold size will be 3 or 2 in this case? Brother in Law +My Wife+ Me=3 or Brother in Law+ Me=2

    5) If joint sponsor is not a house hold member then how to calculate sponsor’s house hold size? If Joint sponsor is single. House hold size will be 3 or 2 in this case? Joint Sponsor +My Wife+ Me=3 or Joint sponsor+ Me=2

    6) If we have a baby before issuance of my visa and we will do delivery in USA then that USA National baby will be included in number of dependants or not?

    Please answer to all above questions one by one.

  13. You are the sponsored immigrant, not your wife. This is always a judgment call by the Consular Officer, who is trained and expected to consider the totality of the circumstances INCLUDING the joint sponsor's relationship to you and/or the petitioner, and how likely they are to actually provide any needed support, and how likely it is that you will quickly be supporting your family yourself.

    Yes, it's fine.

    The quote in your first post As written on NVC website that "if the sponsored immigrant uses federal means tested public benefits, the sponsor must repay the cost of the benefits" simply suggests that after you immigrate to US as a permanent resident, if you request use any federal benefits (like food stamps or so), then the federal government can make your joint sponsor to pay them back.

    Thanks means we have no problem with my case.

    I need help urgently, my case has approved by USCIS and forwarded to NVC, my wife has one daughter from her ex husband/previous marriage(her ex husband had died) and after that she is taking "Government Support/Government funds" to support her daughter. As written on NVC website that "if the sponsored immigrant uses federal means tested public benefits, the sponsor must repay the cost of the benefits".

    My wife is college student and she is not doing Job. What should we do now as she is my main sponsor? We also have joint sponsor for my case and his income is above than poverty guidelines. Does USCIS will accept my case with Joint Sponsor as my wife is not doing Job, has zero income and she is taking Government Funds.

    Please help me in this matter.
