  1. OMG! you are right it is driving us crazy... but OMG!!! I really hope we are next!!! I think the wait is driving us crazy and the fact that it causes so much pain.

    Your welcome.... my interview was april 27 ,2015. Since i am turning in 1 year this month and still waiting for the waiver. I called the consulate/embassy to let them know i am stil waitin so they told me they wont close my case till waiver repond is done. They did a notification and i got an email confirmation next day..

  2. Ok. I just loged in to tell this to all yal. Dont let this processing time date drive you crazy.. we have seen RFE fron october 5 already in facebook group. 601 waiver journey.. my recive day is october 28.. so in facebook we are getting approval from august and september and yesterday we got two from october 2 an approval and so cheerr up this waiting is crazy but we are strong.. god bless you all.

  3. Yes this about immigrations is a puzzle.. you can re-send waivers again. But this time make sure to do extreme hardship lead to the husband. Always the husband. But also prove that they are in a relationship actaully. Cuz even though the husband will suffer hardship if they are not convence that they are in a relationship they will reject it. Even though they may have 20 years married and 5 children togehter and stay be lawfull married they have to prove they are co-living togehgter(bills,bank account commun,and anything that can prove they are having a marital relationship) cuz they have reason to believe that the relationshin ended even they still are married.. so is a little complicated but no impossible. Of course you have add the family hardship also as help to support the main hardship.. when u recive the letter from uscis pleade keep us posted..

    I am new to the forum. I should have joined 4 years ago when this nightmare started but better now than never. I am writing for some advice on my I-130 petition for my mom, which was approved 2 years ago.

    Here's a timeline of events:

    Fall 2010: My mom's brother's I-130 petition for her was approved after 11 years

    Aug 2011: Mom self-deports to Ghana, because some USCIS person had wrongly told her that she would need to go back to process the visa.

    Aug 2011-Feb 2013: the separation has negative impact on family, financial issues, apartment eviction, depression, marital tensions/resentment etc.

    April 2013: Mom finally goes in for visa interview at Accra Embassy. She is refused visa and told she's banned for 10 years due to self deporting after over staying visa and voluntary removal order (which was 10 years before)

    June 2013: I submit an I-130 on behalf of mom

    June 2013: My citizen sister and I file for I-601 waiver for mom. We didn't file I-212 along with it because we read somewhere that I-601 was sufficient.

    Feb 2014: Mom receives RFE from I-601 people. Specifically they want a letter from my dad since he's the only one citizen relative that can petition for my mom. Dad refuses to help her.

    April 2014: we submit RFE response explaining all that dad wont help due to how separation has caused family problems. We enclose marriage certificate.

    May 2014: USCIS miraculously approves I-601

    May 2014: Accra Embassy tells her she still needs an I-212 waiver before she can get a visa

    July 2014: I-212 submitted, with I-130 case number

    July 2014-July 2015: my I-130 gets processed then approved; we keep checking with I-212, no news

    November 2015: Notification from Accra Embassy that I-130 interview scheduled. Simultaneously, USCIS mails us that the I-601 approval has been reversed, unless my dad submits proof of hardship.

    Nov 2015: mom goes for interview with embassy, she is told to prove her relationship with daughter petitioner. CO also wants proof that she is married to her citizen husband!!! We wonder, why is my father being asked about when he is not mentioned at all in petition.

    December 2015: Mom goes back and provides evidence. CO says still not enough. You cant go back unless you can prove your marriage to husband is real. Orders a FULL family DNA test. At this point, we just assume that Embassy is coordinating with USCIS by requesting DNA test as proof for the waiver

    December 2015: Luckily dad abides to DNA test but refuses to submit letter to USCIS I-601 waiver.

    January 2016: We mail I-601 NOID response, explain family situation, provide evidence of dad's hardship. but still with no letter to dad.

    February 2016: mom called in to take DNA test. 2 weeks later results done, full match. results sent to embassy.

    March 2016: Embassy contacts mom about visa interview

    April 2016: mom told by CO at interview that 1) everything is fine with evidence but 2) she needs to FILE I-601 and I-212 waivers and hands her folders with the applications. Mom tells her she already filled both and that it has been in their system. CO claims no such record in their system and requests proof from mom. Erring on the side of caution, she doesn't show the CO the original I-601 approval since there is a 601 NOID thats pending.

    In the meantime, we havent heard anything from I-212 EVER. we submitted it nearly 2 years ago, and its been under officer review since July 2015 (8 months no). likewise, USCIS has had our response to the NOID since January 5, 2016. No response since.

    So my questions are as follows: 1) Why would the CO bring in my citizen father and sister for my I-130 petition which makes no mention of them and has nothing to do with them, but then state that she doesn't know anything about the waiver? Why else would she ask for proof of marriage and offspring with her husband if its not related to the waiver? Moreover, shouldnt the 601 and 212 applications be in my mom's files since they are connected to her case number?

    Things are really really really dire in my family and we need an immediate waiver. But with this 601 and 212 in limbo and a non-compliant father, what are our options?

    Wow for what i read. Your father damaged everything for being actin so stubborn. We) they need to make sure your dad and mom are still in a relationship since that he is the only one cualifyin relative to she can fill for a waiver or both waiver 212 and 601. Children are not cualifyin even the daughter be her peticioner. That why the drama with adn test cuz who person with little feeling in his heart reject to help the woman mother of his children. They are using the background history that your mother has agaisnt her now. So just the husband can help her. The approval expire every one year so that why is need to fill up new one forms. Good luck my friend.. to fix this mess yal nees to tell ur dad to be more sentive and find a lawyer also..

Hi, I currently have a CR1 case under AP in the counsuler in santo Domingo....my husband who's the beneficioner was once arrested for a non drug charge, however he was not convicted and the charges were dropped. The day of the interview, he was asked if he was previously arrested and he said yes, gave an explanation and gave the court papers to the officer. The consulate officer looked at the papers and said that everything was fine, but that she has to put the case under review to vertify that everything was true. She returned the passport to my husband and said that my husband would receive a call from her in a week so that he can then bring his passport and then they can issue his visa. The interview date was on March 17th 2016 and it has been 3 weeks since then. Has anyone gone through a similar experience?

    Yes my uncle went thru that and it took him 6 months. That is to verify everything is ok with him dont worry about it. They gonna approve his visa. You can email them in the next week cuz consulate in santo domingo is overload and is good to keep nagging them to remind them you are in hold..

  6. I was reading all the commwnt but thats not is only happening in pakistan! Also in dominican republic! I got a fiance k1 denied in 2006 cuz my exfiance was a heavy smoker of sigaret, and even i didnt smoke i was used to tolerate smoke cuz my mom was a heavy smoker sinve she was 14 years old, also i was very pretty and not tatoos and he wasnt brad pitt or a baby face also he had two kids different women, and my big red flag it was that we met online, so they thought my relationship wasn't bonafide and denied me cuz i was 22 years old and also he was 31. So i lost that case and same things they sent it to NVC and then to UCIS so them expires. and now i have start over again and have an ameican husband and they asked to summit a waiver for the old case with my exfiance. So they think i commited fraud but actually was bonafide! We didnt get marry and re-apply cuz my exfiance pasaport got revoked in 2007 and he never fixed and then we split way.

  9. I was interviewed on 8 july 2015 but was denied for mispresentation in my earlier interview in 2008. So my wife filed i601 waiver submitted on 22 sept 2015. But still waiting

    Hola! I was interviewed on april 2015 and got refused for an old case on 2006, may i too know what kind of misrepresentation you have? I sent my waiver in oct-2015 and nothing yet!

  10. I have no clue what's going on. I just can't believe they rattled off the ban and medical and didn't say a word about the charge that the embassy had such an issue with!

    He called Andrews and told them he has a letter from USCIS requesting a new medical exam. They won't listen. They're not used to seeing anything but the letter from the consulate. Believe me customer relations in JA is nothing like USA. I've learned that the hard way. Hopefully, the email to the embassy from our lawyer will prompt a letter of some sort.

    Yeah! Exactly that what they want! I disnt know it was about smoking wid! Yeah that why they want test to make sure he is clean now! I saw a case alike from trinidad and tobago! I hope yal man dont let you down now cuz this depend on him! What result they get! The thing about trinidad he got denied cuz they asked him to re do test and he smoked one week before cuz was in a parti! So he ###### up everything! The woman was desperated and frustrated! So i know it wont be your case cuz your man seems be responsable and care for you much! So once yal get that test result they will approve you! Blessing for yal.

  11. Yep Ken. I think that is exactly what happened. I think he never needed a waiver to begin with, which is what our lawyer tried to tell them last June. That "smoking ganja" isn't a listed offense in USA, only possession, trafficking, or selling. But they insisted we needed one. I think USCIS is basically saying we didn't. Whatever I just hope this gets resolved and he gets his visa issued. Right now trying to get Andrews to schedule a new medical, which of course they are refusing without an interview letter. Nothing is ever easy with immigration or JA.

    I think the RFE letter may work as a reference to repeat exanms! always is a drama! ?

  12. Well I'm not sure. Our lawyer is totally confused. We knew he'd need a new medical, he got a one year ban for past use.

    Our waiver was for a "smoking ganja" charge in 2005. They didn't say one word about that. All they said is he was found inadmissible for the past use, that no waiver for that is available he just has to wait out the one year and get a new medical. Well ok thanks we knew all about that. What about the charge the embassy insisted we needed a waiver for??? Not one mention of that!

    Oh my god i dont want to think consulate made a mistake with yal case! But thanks god the end of this nightmatter is coming closer!
