  1. By 'CYA' I meant nothing more than the lawyer trying to 'cover [his] a$s' by asking you to send as much as possible (so you can't complain if you get an RFE).

    Well, I didn't base my decision soley on what my lawyer said, I based my decision on my fellow Viet Nam filers as well. As for my lawyer, he is also my best friend. So no, he wasn't covering his A$$, he was looking out for his friend.

    As for the posters original question, my advice to him was to send everything he has, to both USCIS and the consulate. Why you ask? So he can avoid RFE's from both USCIS, consulate and not have to think about "What should I send?". If he sends everything to both...then he won't be sitting around worrying to himself later on...."Should I have sent more?" Nothing like not providing enough of something and then consequently going through the AR process. That means, not only can the consulate put things on AR, but the USCIS does the same thing as well. Is that a risk that people are willing to take? Why gamble or play with fire?

  2. hello ,when i was in vietnam i thought i could go to the counslers office and get the 1-29f but as we were riding people would point and we was directed to a travel place a few blocks away from us couslers office where they help with forms and visa information it cost 200 us dollars and they also help with interview questions and make sure everything is in order.did anyone else go to this service ???if so what do you think about it .it gives my girl alot comfort to call them and tell them whats happening

    From reading posts from my other Viet Nam brothers and sister out there, this was sort of a hit or miss thing when going to them. Your best bet is to get on our regional forums here and do searches as to how/what goes on during the HCMC process. There is loads of information there.

  3. This is interesting. I ran my application by an immigration lawyer. He said the consensus among immigration lawyers is to bury them - send EVERYTHING.

    I sent copies of boarding pass copies, passport/visa copies, receipts of currency conversion, etc. for 5 visits. I also included copies of over 400 emails and IM sessions, and copies of phone cards showing several hundred hours of calls over the last year. It took a Priority Mail BOX to send it all.

    After reading here, I was doubting the wisdom of this. But we got our NOA2 right on track with others with similar dates. My fiance will have duplicate copies of all of this when she walks into the interview.

    I feel for the two people who got turned away because of lack of evidence of a relationship. I wonder if the consulate officials had their minds made up before the interview started, and thus were not as interested in additional evidence presented at the "last minute".

    I am NOT saying that the board consensus is wrong. But the answer may not be as clear or one-sided as some think.

    My lawyer told me the same stuff. In fact, we sent 500 plus YM chat log pages, another 500 of skype pages. 200 photos and lots of receipts. I even wrote a program to capture the screen into a video file so I can produce a dvd video of us communicating.

  4. According to that source, there were 32,900 K1 entrants in 2005. Suppose that this is a reasonable guess of how many applications they have.

    Looking at the Immigration Timelines, we have 1150 applications so far in 2006, which will probably mean about 1500 for the year. Thus we are about 5% of the applications.

    When presidential polls are done of 100,000,000 voters (a guess), they poll about 1000-1500 people, and get results that are accurate within 3%. If our membership is typical of K1 applicants, then analysis of our applications is probably a pretty good picture of what's going on with all applicants.

    Overall, Internet users may be more affluent and/or computer savy than others. But if you don't meet the poverty guidelines (directly or with help), then you probably won't start the process. Thus it would surprise me if VJ members are substantially different than the rest of the applicant pool.

    Also some steps in the process are totally independent of income. For instance, a name check at NVC or shipment to a consulate are the same, no matter your income.

  5. my fiance had a record of 3x divorced all married in american women we applied K1 visa this month so the waiting time begins now i was wondering if his background can cause of our application denied...any advice will greatly appreciate thanks.

    p.s. we been engaged for more a year now and we met personally 4times already

    In addition to the Divorce Decrees, make sure he produces a Affidavit explaing the current whereabouts of the prior wives.

    I agree. I am religous and do things in a religous way. But I usually attempt to give real/logical advice without a religous or a politically correct viewpoint.

  7. it's not USPS who STOLE your $#|#, it's VNPT (Vietnam Post and Telecoms). I sent 65lbs container of Christmas present in the beginning of 10/2005. Guess when did my in-law receive the notice to pick it up? March 2006. Went there, the container mysteriously weighted 30 lbs lesser when It left the US. Go figure!

    VNPT also jacked up the VAT, all used children clothes were taxed at 20% rate, B/S But whatever, I know for fact USPS has nothing to do with your package, it's the VNPT in Vietnam. Lesson: Send CASH next time, no more gift from America hahaha :) Unless you personally go to VN then bring gifts, lots of gift!

  8. I've used FedEx and have been very happy with them. They were the cheapest and fastest. I sent some documents on Saturday morning, and they were in my wife's hands on Monday morning (local time). I was amazed. Stay away from UPS/USPS if possible.

    Sent some stuff to my vo 3 months ago via USPS...MFs stole the sh!t....now they can kiss my A$$.

    They also told me if I pay X amount of dollars, it will get there in a few days....bullsh!t!!! they can kiss my A$$ again.

    Go with FedEx or DHL...USPS can kiss my A$$!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!AGAIN!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

  9. It has been said that others have submitted information (statement of some kind) to their fiancee to give the current location of ex wife for when the fiancee goes to the interview.

    Can someone educate me on this? Is this document required for her interview (specifically HCMC consulate)?..etc.

  10. Congrats!! Hop up here on the bus as we head off for the trials and tribulations of the HCMC consulate. It looked normal enough from the outside as I walked by last week. But we all know how looks can be deceiving.

    Your in VN now? How about taking a picture of it for me? We should start a picture database of all consulates.

  11. I noticed on the NOA2 that it expires on 13 Jan 2007. Does this mean the Embassy has until that date to approve the petition on their end and if they do not we have to submit for an extension or refile? What does the expiration date mean? Does it mean I we may betogether before that date? I searched and might have missed it, but I did not find this in the forum. Payato

    I would like to know as well.

  12. After the NOA2 approval, how do you track the status from then on? I noticed people having a status for NVC and such. Will I get a notice from uscis about them sending the paperwork to NVC? After NVC how do I track status? What say you?
