  1. My husband came here on a K1 visa and after a very long wait in the past month he has recieved his EAD/AP and now the interview date coming up on July 7th. Although they sent a letter of what we should bring a lot of it lists things then say (if not already sent/provided) .. through out this entire processed they have received more than enough information on our marriage/lives/finance etc..

    Now my question is what should we expect at the interview and what should I bring those documents even though I have sent them in previously?

    Also would they take in account that I'm currently pregnant?

  2. I have a m quick question I was hoping someone could help with. My husband came to the US on a K1 visa we got married and filed in January, his K1 visa expires on February 14th (ironic I know) but I was wondering does that mean he would be considered out of status since the AOS is in process but has yet to be approved or anything.

    A side question is that he passed his permit written drivers (since he didn't have one in his country) and they BMV suggested they only issue his permit when he has the green card approved? I'm confused could that possibly be also his EAD? Since it comes quicker?

  3. You should double check to be sure you don't have any returns to file. IRS Publication 929 requires ALL legally employable dependants who have an earned income over $6300 for the year to file a tax return (there are other qualifications that raise the income required to avoid filing it's in the link), even if they are claimed as a dependant. So with a $10/hr job, you would need to work less than 12 hours a week to go below the filing requirements.

    If you should have filed, but did not file, it may come back to bite you later on.

    Thanks for the information, I just now completed 6 months and have only made half of that and didn't have a job previous to that so thats why I hadn't done taxes before so legally I am fine, just not sure what to put as a substitute for the affidavit of support. Because this year will be the first year I do taxes now that I am married and have a job.

  4. Are you saying that you didn't have an affidavit of support for your K1?

    It doesn't matter if it's the same joint sponsor whether or not anyone checked the papers. As long as they qualify- they can be your joint sponsor.

    That's correct I did not have to submit an affidavit of support for K1, I had it ready for when they would ask me for it but they never did so I just kept the information but it's much different now. The i-864 is much more in depth and do not know what all documentations needed on my behalf and the co-sponsor

  5. Should I be sending current paystubs? I've had that job for 6 months now. And what all documents should I be sending for my part since I don't have tax returns? And I can use the same co sponsor I was going to use for the K1 app because they never asked for it but now for AOS it's a whole booklet. What all does my co-sponsor need and what do I need?

    Also I don't think I make above poverty line I only make $10/hr part time.

    if you didnt file taxes i suggest you get a co sponsor even if you make above poverty guidelines (we got a RFE for that reason)

    anyone can be a co sponsor, as long as they make above poverty guidelines and had filed taxes.

    affidavit of support is a very big deal, your co sponsor will have to file form I-864 and provide tax documentations and supporting documents.

    What are the supporting documents?

  6. Hi Im having a similar problem

    I'm a full time student with a part time job $10/hr but i've never have done my own taxes because my mom always puts me as her dependent. So I don't have any tax returns to put down and I could do it this year for this past year but by the time I wait on my W2's it'll be too late. i want my husband's legal status to stay up to date. My mom doesn't necessarily meet above the poverty line due to getting on permanent disability. So I don't know who would qualify for a joint sponsor? And how do I fill out my own affidavit of support papers without having tax returns?

  7. So my husband came in November on a K1 visa, we got his ssn, got married early Dec got all the paper work needed for his AOS including the money order. Now my problem is the affidavit of support papers it has alot tax return questions that I don't have. I've never done taxes due to always being a dependent on my moms taxes because I'm a student. i have a part time job now and I am expecting a W2 now but We can't wait til I get that in the mail due his deadline. i want his legal status to always stay up to date. But this is the one part I don't know, I'm assuming I need a co sponsor? How do I go about that? Who is eligible for that? How big of a deal is the affidavit? One of the reasons we wanted to be together was so he could help me finacially, but now Idk how to sponsor him? Someone help, we're running out of time.

My story is pretty identical as rms171's except the visa was approved 10/30 just a day before we were in AP for a few days and now it says ISSUED and super excited just waiting until they say ready for pick up. Which according to them it shouldn't take longer than 10 days. Lets just hope we don't have to call/email for that as well.

  10. Have you checked you status on the CEAC website? Checking there will give you a better idea of what is going on.

    Ustraveldocs is useless..they are a glorified call center who offer no real help at all.

    I did and it says the case is in AP, and if the visa gets approved it will be 2-3 business days and that was updated Nov 5th. So it's not very helpful.

  11. Thank you! I will check it out and yeah we were approved 10/30 with no issues at all, and they kept his passport.. now we'e just waiting to hear back.

    Does anyone know if this interfere's with the petition expiration because my petition expires in Dec, but his visa is approved what if he doesn't get his passport back before it expires?

  12. We were told that we'd be contacted in a couple of days and we are in the second week of waiting. Ceac.state.gov went from saying no status to admistritive processing but it says if your visa is approved it'll be mailed in 2 business days. In Santo Domingo my understanding is that we go to pick up the passport at a location we choose. Also last night the ustraveldoc box where it did say Passport still at Consulate/UsEmbassy now says Delivery document information. But everywhere else says nothing and doesn't say if the Visa has been issued. I just wanted to know if this is normal? What's other's experience with this? What does this even mean? Will the wait be any longer ??

The medical exam is supposed to be like 2 weeks or 10 days before the actual interview depending on the embassy your going to interview at. But yes if the petition expires in Jan you must get through the visa process before it expires or ask for an extension of petition. Your fiance has to interview before the petition expires. Be mindful that consulate fill up quick and so try and schedule as early as possible

  14. I have read reviews of the Dominican Embassy, my fiance went to the VAC app, then got all his shots and medical exams.. Now I'm fllying this thursday to go to the interview with him on Friday.. What should we take to the interview? Are there any fees at the appointment? I want to make sure i'm all prepared for any situation

  15. Just try to schedule, if you pay at banco popular just go to ustraveldocs.com and try to schedule , dont waste the time and try to schedule, if they have days for interview you will know when you schedule

    Yeah it says the available date is October 30th at 7am, and it's already registered that he paid and everything. They won't reject if the DS-160 isn't ready yet will they?
