  1. Hello everyone! It's a pleasure to be part of this community! All help is appreciated.

    I am engaged and soon to be married in a month**. Fiancee and I live together in California and have a shared bank account.

    I am a U.S. citizen and would like to file I-130 & I-485 to petition/sponsor him in so that he can visit his family in the Philippines, for leisure travel and possibly eligibility to adopt.

    He is a DACA applicant-- with 2 misdemeanor of petty theft and burglary (as an adult); convicted, no contest and eventually dismissed after expungement.

    His DACA is approved despite having a record and received his work authorization and has been working for 2 years, pays his taxes and goes to school pursuing his Bachelor's.

    He came in the country legally with a visa-- but overstayed.

    I was wondering the likelihood of my petition/sponsor being denied due to his record.

    We will be meeting with an attorney in a couple of weeks. We just want to know if there are others who are in the same situation and who can possibly share some guidance or advise.
