  1. If you're trying to deport him, your best bet is to annul the marriage (on the basis that it was entered into under fraudulent pretenses and not a real marriage). You should also immediately report his physical abuse to the police, if he ever tries to hurt you.

    However, the charges and proof will have to be serious and bona fide. Talk to a lawyer and tell them the facts, and the lawyer will advise you whether you have a case for annulment, or not.

    However, even if it's only emotional abuse you're dealing with, it's enough for you to walk away. If not annulment, then divorce. Do it fast, and move on. He'll be able to stay, but he won't get a chance to torture you again.

  2. I scheduled the interview, and now I'm wondering - if everything goes well and my parent's visa is approved during the interview, (and assuming no delays due to AP or what not), how long does it usually take to actually get the visa in hand?

    I'd love to be able to fly back together to the US, but I can't stay too long waiting for the visa issuance, due to work commitments.

    Is it possible to get a visa in hand by Friday, after a Monday interview?

    I called the US embassy this morning in France, but the visa service doesn't take phone calls....

    So I send a mail and they respond to me in 1 hour! I guess we have a case complete !!! We have to send back a letter after collecting some documents (already done !) and then they schedule an appointment !

    Our request to expedite was also approved and I contacted the embassy, but they haven't heard about us yet. Our CEAC status still shows "at NVC". I wonder how long it will take to transfer the file to the embassy?

  4. NVC because it was just after they assigned us our interview date and our petitions weren't shipped out yet.

    Thanks! I'll try that, too. Maybe I'll get lucky. :-))) What arguments did you use to ask NVC for an earlier interview date?

    I was in your batch of late May-June approvals, and I hoped for an April interview. But we got delayed because we had to get a police certificate from a third country, and now my plans for a spring interview are in jeopardy...

    It looks like with the scan date of March 28, we're looking at a June interview - just as the cost of plane tickets will skyrocket. If I could push the interview to May, that would be awesome.

    Oh, well. First we have to get a Case Complete from NVC... It says on CEAC website they should review in 14-30 days. I'm hoping for 14! (even though I know that 30 days is the average, LOL).

  5. I have checked my status on CEAC several times and it still says administrative processing but the status updated date has changed several times. It has not changed since they received the documents though. Do you think the overstay will affect anything?

    The overstay of 5 weeks will not affect anything, if you were straight forward about it.

    AP is usually caused either by a higher risk native country of birth, or by a high risk occupation (e.g., computer security).

  6. I am having a hard time finding the bank transaction requirements that you referenced, could you, please, share a link where you've read about them?

    The gist of it is that as long as Russian citizens spend at least one day per year visiting Russia, they are considered "residents" for the purpose of currency control laws, and have to follow very strict currency transactions and reporting requirements.

  7. I am thinking about filing for our son Alexander's dual citizenship and was wondering if you all think it is worth it? I am particularly concerned about military service. Corey and I are both employed in oil and gas industry and have a potential (and a lot of desire) of going back to Russia to work on Sakhalin or Kara Sea (when sanctions are finally lifted) projects.

    One more question: do I need to register Alex at the consulate office? And does he need dual citizenship / visa for travelling to Russia next year?

    It's possible that your child will not be able to travel to Russia without first obtaining a Russian passport, or without first proving to the consulate that he did not automatically acquire Russian citizenship by birth.

    However, it's not so easy to get rid of Russian citizenship once you have it. I strongly recommend educating yourself before you decide to saddle your son with something that might create problems for him in the future.

    I suggest you read a bit about the current situation in Russia, paying particular attention to the latest legislation concerning Russian citizens who permanently live abroad. E.g., read up on the requirements (and harsh penalties for non-compliance) to "register" dual citizenship, to report the details of all "foreign" (i.e. US) bank accounts, the mandatory use of Russian instead of "foreign" banks for many transactions, etc.

    Finally, neither Russia nor the US recognize "dual citizenship". Instead, they only acknowledge the fact that someone can have two citizenships, but each country only recognizes its own citizenship. In practice, this means that when travelling to Russia on his Russian passport, your child will no longer have any protection of the US embassy. If something happens, (if he gets arrested, or drafted to the army, or stopped at the border from leaving the country, or whatever), Russia will treat him as their citizen and consider it their internal affair. American embassy will not be able to intervene on his behalf.

    Why can't NVC do their jobs without constant prodding? I'm fighting a very nasty flu and lost my voice, and the thought of having to call (AGAIN!) sounds exhausting at the moment...

    Oh, well. I better gather energy and start calling. I guess it will take them forever to review the stupid form otherwise. Grumble-grumble.
