Which province or territory are you or your SO from?
I'm (Karen) born and raised in Ontario. Currently in Brantford, Ontario.
I was born in Guatemala city, Central America, came to Canada as a child and was raised in Québec, Montreal.
I am going to live in Alabama with my husband as soon as we get the visa. We are planning to leave around the first week of January if God's will.

Hello everyone,
Since I am all confused re:translations (as you can see in my other posts); I wondered maybe I should contact MTL directly and ask them. Now, I wonder.... which method is better for this? I thought e-mail would be my best option since then I would have a written record of whichever response.... but I also have no clue how long it takes them to respond.
How about phone? I've heard stories about "Ms. Nasty" and that scares me... kind of

hi all....our interview is the 27th....i know there is someone else on that date as well.....just cant remember who for the life of me...
...any last minute suggestions in staying calm....oh...i went photocopy crazy...and made a copy of everything i am bringing to interview...was that neccessary

Hi there,
I am going to my interview on the 22nd at 9:30am. I will be there around 7:30am just to make sure.
I live in Montreal and my fiancé is living in Alabama. He will be flying on the 22nd but won't be able to be with me for the interview. He will be landing around 12:00 am on the 23rd.
my suggestion is to stay calm...( I am telling you this even if I am having trouble to stay calm my self. LOL...!)
We are finally at the end of this process and are very excited about this. we will be moving around the first week of January. I just did like you and have everything photocopied....
I will be posting my interview experiece and let you know how it went.

Is there a way that a Canadian married to an American can live in the U.S. but cross the border daily to work in Canada after the finance VISA is issued and the marriage occurs?

I think we are done waiting for them anyway. This mess is creating unbelievable hardship for us.
She is just going to come for the 90 days she is allowed and not work.
I just need to find out how long she has to stay in Canada after the 90 days is up before she can come for another 90 day stay.
You got the standard canned answer from their customer service desk. Remember they arent even located with CSC that is the national number that goes to an office somewhere. All the do is read off a script.No they gave the Senator's office the canned response. That is just slightly more bold (or maybe not).
Who are government service workers accountable to anyway?

I just talked to him and he agrees the input from California Service Center Does not makes sense.

I recently spoke with the California Service Center and they stated that your application should be decided around 60-90 days. I then spoke with her about how some petitioners were getting their petitions approved even though their petitions were sent later than yours. She stated that should not be the case as they are processing petitions in the order in which she came in. She did say that if I received the receipt numbers of those petitioners who sent in applications after your date she would check on it for me to see if this was in fact the case. In order to do that I would need privacy act release forms completed from those individuals to verify that those individuals got approval notices even though their petitions were sent in later than others. Let me know what you think. Thanks.

I am really confused now. My application is now 138 days old. They are working on everything after March 6th now.

They received my application March 11th.
That means that my petition should be in the next 5 days of work, but they have been at March 6th for about 2 weeks now.
60 to 90 days more for them to do 5 days or work is horrible news and does not sound correct.

I filed a detailed congressional complaint today with proof of what they are doing.
I realize that this does nothing...... but for them to be working on and approving June
petitions 1 minute before early March ones...... is simply unacceptable.
There are several possibilities.
Someone said that they had to sent work to Vermont from California..... the ones being completed
may have actually been done in Vermont.
The second thing is that all most of our petitions may have already been at some level of approval and they are handling the RFEs in mass.
I wish they were a business and I could charge them back for all the pain and expense that they have caused us because of their gross incompetence.
And yes.. it is incompetence.. that they were not ready for a law that had been signed over a year and a half before taking effect. I can only wish that some high level government service workers and now at home spending their days serfing the internet for jobs.. because that is what they deserve.
It is also simply unacceptable that people in New York can get approved in weeks and we have to wait 6 months.

Are they supposed to process these based on the NOA1 receipt date? If so they are not doing it.

I have early March NOA1 as well and nothing in the mail :-(
I am just so very tired. We have been together for over two years
and now we only want the seperations to end.

I just received a call from another person on the discussion boards from Illinois. From what he tells me Vermont is already starting to issue the RFE’s so I put a call in to the California Service Center to see if they can give me any information on when they will start issuing RFE’s. I got their voicemail but the question I posed was that if Vermont is issuing them is California close in following suit? If not, do they have a specific time frame? If I don’t hear back from them by early afternoon I will continuously call throughout the day to see if I can get a response. I will keep you posted. Tim

You need to contact your senator.
We got the response from the same guy as I am from Illinois as well.
It looks like he knows how to cut and paste... a critical time saving skill in the modern
office work environment.
At least Senator Durbin's office picked up the phone. I have had no response from
Senator Obama's office.

Not new news .. but this is yesterdays response from my Senator. It is a bit confusing when you look at all the board activity.
The only information in it that is really valuable for me is that the origional receipt date will be used for
petitions transfered to California. We are not going to be treated differently just becuase we are transfered.

This is the response I received from California. Apparently, they have not heard from USCIS Headquarters on how to process these cases under the new IMBRA.
Any and all applications or petitions that are transferred to the CSC are assimilated into our processing schedule by the original receipt date. This case is no different.
However, all I-129F petitions received on or after 03/01/2006 fall under the umbrella of the new International Marriage Brokers Regulation Act of 2005 (IMBRA). All of these petitions will not be adjudicated, and will remain pending until Headquarters USCIS issues quidance regarding processing under this new law. This petition was received 03/13/06, and falls under this new law.

I hate this "abuse against women" stuff"
It is sexist biased #######...
Why.... becuase abuse can happen against anyone to anyone regardless of gender..
men can abuse woman
women can abuse men
men can abuse men
woman can abuse women
people can mistreat animals
All of the above happens and all of it is wrong...
It is my opinion that women abuse men just as much as the other way
around if not more.
The issue is that men are too proud to report it and sometimes don't
even recognize abusive behavior for what it is. No man wants to admit that he
is abused by his wife and that he is psycologically a basket case becuase he is always being
told what a useless waste of a human being he is.
I have no arrests, convictions or even police encounters for abuse but my ex-wife has tried everything
possible to get me to do something I would regret.
So.. lets be fair on these boards... and call it SPOUSAL abuse.
or VIOLENCE against PEOPLE.
Women don't have a monopoly when it comes to being mistreated or abused. They just shout the loudest about it.
Lets open our eyes to the other side... Spousal abuse by women towards their spouses, causes alcholism,
depression, suicides and broken lives all the time.
IMBRA is not only for women, it is also meant to protect men. It is for everybody outside the USA wanting to immigrate to the country on the basis of fiance visa regardless of sex. It is only unfortunate that women makes up high percentage of the ones getting abused. Get it ?
Women make up the most complaints but the difference may end there. Female to Male abuse is silent, ugly, prevalent, and destructive. It goes unreported and unaddressed most all of the time.
In short we really have no idea how many men are abused because men don’t report it or talk about it until it is way too late and situations are out of control.
Again, abuse is equal opportunity and not sex specific.

Are they going to put all the people transfered to California Service Center to the end of the line....? Does anyone know?

SUBJECT: FIANCÉ(E) I-129F PETITONS RECALLED BY DHS
1. Summary: The International Marriage Broker Regulation
(IMBRA) was signed by the President January 5th of this
year. A 60-day deadline, March 5, 2006, was established
for DHS to begin asking K-1 fiancé(e) petitioners for
their criminal background information. DHS did not meet
the deadline for collecting additional information. Some
petitions filed after the deadline were approved in error
under the old procedures and sent through the National
Visa Center (NVC) to posts for processing. Approximately
1100 cases went to 95 IV-issuing posts. Posts are
preparing to return these cases as quickly as possible to
NVC. End Summary.
2. While most K-1 cases under the new IMBRA requirements
were held at the service centers pending development of a
new form I-129F, some cases were processed after March 5
using the old forms and procedures and sent to posts for
processing. The DHS Service Center Operations (SCOPS)
Unit of USCIS, Status/Family Branch requested that posts
return to NVC all K1 I-129F petitions with priority dates
(date received at the DHS office) on or after March 6,
2006.
3. NVC was able to run a data base list of all petitions
meeting these criteria. We have notified those
posts that have received these cases and given them the
case numbers and further instructions. All cases on this
list, even those with firm appointments or in 221(g)
status, are to be delayed while the petition is returned
for further information. No cases in issued status will
be recalled. If posts have any question about the correct
priority date of the K1 case, they should use the priority
date (receipt date) written or stamped on the original
petition. DHS has not requested return of K3 or K4 I-129F
petitions.
4. The Department presently has no information about the
extent of delay for these cases. In the meantime DHS will
send additional questionnaires to the petitioners
inquiring about their possible criminal backgrounds. When
the petition is compliant with the IMBRA, it will be
returned to post from USCIS through NVC for processing.
5. The Department understands the additional workload of
this process and the public relations demands of
responding to disappointed petitioners and beneficiaries.
We recommend that questions be addressed directly to USCIS. The USCIS customer service number is: 800 375 5283.

I am going to my interview tomorrow and i am so nervous.... my fiancé will meet with me tomorrow night.
