  1. When you file for lifting conditions, I know you must show proof of having a house together. My mortgage company says we might have to redo the mortgage and closing cost. Need to draw up new papers from the lawyer to show his name on the mortgage. Not sure if this is right or not. They did say to wait until he has good credit first, like for a year. But if I pass on first, he will get my house anyway. so why put his name on the mortgage.

    Any input on this will be appreciated.

    NO NO NO! I am not on our mortgage statement. I just sent them our monthly mortgage statement which shows my husband name on it only!!! Then I wrote a note on the statement saying that he owned his house before I met him........which is true!

    I am finally going to try to send our paperwork tomorrow or Tuesday, and am wondering if I should try to explain why my husband's name is not on the deed to our house in order to try and avoid an RFE...

    I owned the house prior to our marriage, and have an excellent fixed-rate mortgage. I checked into adding his name, but it seemed complicated (there is no clear answer for how to do it), potentially expensive, and may require refinancing (no way). Furthermore, in Minnesota, all property is considered to be jointly owned upon marriage, so there is no legal reason to do it.

    I think we have an abundance of other evidence, but is it worth adding this?

    I just sent in a copy of my monthly mortgage statement with a note on it explaining my husband owned our house before I met him. I sent in my I-751 on Dec 23 and they received it on Jan 2/09. On Jan 9 I received the extension letters for my two boys (they are also on my application) extending the expiry date of their green card which will expire in March. I didn't get mine yet though!!

  3. I am in the US now and am working on removing my conditions. Question.............My ex lives in Canada and has a criminal record, therefore he cannot come down to the states to visit his children. He told me he has applied for "a waiver" to be able to enter the US. Is this same kind of waiver? and if so, how long does this take? He applied 2 years ago and he still has not received it...............so he says. Is this a realistic timeline?

  4. You should receive the biometrics appointment letter about a month after the NOA. Yes, California is taking approximatley 6 months to approve I-751s. You can check the CSC status list in this forum for exact dates for those who have also applied and received their cards. (Just be glad you didn't have to file to VSC and its average 11 month wait!).

    Don't worry if your green card expires before the 10 year card is approved. You will receive an NOA receipt letter that will extend the validity of your green card for one year. You carry the letter and the green card together.

    I guess they thought it would only take 90 days to process the things when the legislation was enacted and they have never gone back to fix it.

    Thanks Kathryn, I was getting a little worried about what I would do if my green card expired and I couldn't travel. So they will send me a letter extending it till my application has been approved?

    I sent off my I751 package last week. Does anybody know how long it takes to get your biometrics appointment at you local service center? AND..............how long is it taking getting the green card renewed through the California Service Center? I looked at processing times on the USCIS website and it saying 6 months!!!!! AND THEN ON THE APPLICATION INSTRUCTIONS IT WANTS YOU TO FILE WITHIN 90 DAYS BEFORE YOUR GREEN CARD EXPIRES!!! Can anyone enlighten me on this?

  6. We filed in Aug of 2006 and we did info pass. They are now processing in californina. You should have an answer this month or next. Hang in there its almost done

    Yes I am still waiting too. I sent mine in the first week of Sept 06 and have had a couple of updates on my I485 but no approval yet. I'm wondering just how long the green card takes??? For me its been 6 months.

  7. My AP was approved and mailed "they say" on Dec 13 2006. Why haven't I received it yet? It's frustrating because the NSC is so unhelpful its pathetic. They said they would send the service center an e-mail stating I haven't received it yes and they said it could take another 45 days. That is BS. Anybody ever have this happen to them?

  8. Thanks for the replies. Today I got the hard copy in the mail. I was expecting my approval and my son's approval, as stated in the email from USCIS, but instead I only received two copies of my approval. Is it normal to get two identical travel approvals, or did USCIS make a mistake?

    Good for you!! I got my approval for my AP on Nov 20 and received my hard copy 4 days later. My sons AP was approved Dec 13 and I stll haven't received his hard copy and he is stuck up in Canada. I phoned them and said they wouldn't do anything until January 13. I'm just a little stressed out at this point. :crying:

    From my personal experience they only give emergency advance parole for sickness or death. My kids haven't seen their father since August so I thought they could speed up the process based on that but I was told that wasn't good enough reason to issue me their AP any faster. I thought that really sucked.

  10. Mich3: There is no expediting of EAD or AP, despite what some CBP/Immigration officer told you. EADs and APs take about 70-90 days. If you sent your stuff at the beginning of September, you should be getting AP/EAD in the next few weeks, but no guarantee that you'll get it before Xmas.

    Thanks and I'm just hoping that it will be for sure before Christmas. It's just makes this process worse when you keep getting misinformed.

  11. Can anyone tell me what the heck is going on!!!! I just had to call the 800 number to let them know I moved. I asked about my AOS which was sent to CSC on September 14th and has since not be touched. The freak on the other end told me they haven't logged it into the computer yet because they were waiting on the biometrics to be cleared? Whatever that means and that by the first of January they should have them and begin to process my application. NOW PLEASE TELL ME WHAT KIND OF ####### IS THAT???? Since she also informed me tht my EAD should be approved by the first of December and if not I can make an appointment to receive a temporary one since it will have been 90 days. But if they got the biometrics why didn't CSC??? My EAD was touched twice this week once on the 17th and then again today. Anopne have any clue what's going on here. My guess is they lost it again just like my I-129F and my passport. This whole process is infuriating. I'm about ready to tell the US goverment where to stuff their greencard and go home. This waiting forever for them to get their incompotent a**'s going is driving me crazy.

    I FEEL YOUR PAIN!! This Adjustment of Status process is complete BS. I have 2 sons that I also had to file for and its been really frustrating. First of all I was given totally wrong information by the guys at the border. They said I would get me advance parole in 2 weeks. :angry: They told me I could file my AOS in person so I wasted a trip down to Seattle. Then when I was in Seattle getting my kids biometrics done I talked to an immigration officer to see if they could expedite my kids travel documents (their dad lives in Canada) and he told that yes he would take care of that and e-mail the service center where I sent their application to and said it would take a week to get. I sent all our I485, I131, I765, I130 back at the beginning of September. My EAD has never been touched nor has my Travel Document. They requested more information on my kids I485 so I sent that in. Then they transferred their case to California and mine was transferred way before that. I'm worried because I'd like to go back to Canada at Christmas but I'm really starting to doubt that its going to happen. I never thought it would take this long by looking at some of the other timelines. :(
