  1. ****Update****
    My husband received email from the new Chief of the Immigrant Visa Section at the embassy telling us that they will move forward on my case. That is great news and a relief for our family and friends.

    MTR took about 3 weeks in total from the date filed to the date of answer and was terminated due to lack of proper service. I hope this can help answer any questions regarding timeframe for MTR.

I filed a MTR with immigration court regarding a "removal in absentia" order I had, ICE/DHS filed a request to "terminate" case to court and judge ordered case to be "terminated", now i forwarded this to the US embassy since i am still waiting for them to issue a visa but now they are telling me I have to file I-212 and here I will paste their explanation of it:"Dear Madam: The court ordered your removal from the United States (since you had not informed them that you had already left). According to Immigration Lawyer on the Department of State, the ordered removal sticks and you has been given a 212(a)(9)(A)(ii), this means this ineligibility still applies even though you had already departed the USA before the order of removal was issued. for which you will need a waiver (I-212 waiver)."

    Now does that makes sense? Does someone knows why because not matter how much I read their explanation it just seems bogus, I mean a "judge" immigration judge ordered for removal proceedings to be terminated why will it stick even though the same court that ordered me removed dismissed the case? is this legal? Is it the form I-212 sole purposed is to terminate such proceeding/case? in that case the proceedings have been terminated so why do i need to file I-212?

  3. Hello there, I hope I can get help from anyone that has experience or knows how to file a motion to reopen an order of removal in absentia. I been advised by a lawyer that is something I could do in my case, but cannot afford to pay the lawyer's fees so I will like to do it myself and asking for help please.

    I left USA before hearing was even scheduled and so I went to US Embassy to ask for help regarding the hearing and I was told they would take care of it and well they never did and so my I-130 was refused at us embassy because I have been ordered removal since i missed my hearing, but how could i gone if i was out of the country and could not get back in.

    I appreciate any help you can provide,

  4. Hello, Guys My I-601 form was denied based on that form is not the correct form for my situation and that I need to file form I-212 instead. Now i have questions regarding I-212, form I-130 was approved last year had interview last June, 2015 and I am wondering if I file I-212 does that mean I need to start the whole process again? if it gets approved?

  5. Oh, wow... I'm sorry...

    So, prepare that and don't get annoyed if they don't accept for the first. If they don't, ask to talk to a supervisor there. There is a link that state this situation and I wish I could know that when I was filling for the first time.

  6. since I am outside the US and it says we only need to file I-212 the instructions say we need to file at the office who has jurisdiction over the place where I was removed, so I still need to figure that part out because my hearing and judge order was at Memphis, TN. So we need to figure that out, i just been having a hard time contacting USCIS and husband too busy at work to take time off to drive there from Cincinnati, Oh.

  7. I filled in another office... So let me ask one thing: did you had a hard time for them to accept it?

    I filled the first time August 2015... 7 months between filling back again and flying around US... (Check my timeline).

    Hi, No we haven't filed it yet... but wondering how long will it take since we already waited 7 months for I-601 only to be denied and told that we sent incorrect form that we actually need is to file form I-212.

  8. I am so sorry to hear this! It so stressful already and then to have this mess on top of it. I hope you can get it all sorted out. Maybe a congressman could help.

    Thank you, right now we are open to any suggestions, he did mention about talking to senator but i will tell him about contacting congressman... I mean we need to keep fighting, we have children that miss their daddy so very much and he misses them and I know its the reason why he is so bent out of shape.

    So if anyone has suggestions that may have worked for them in the past please let us know, we appreciate it.

  9. LionessDeon, No i don't have a lawyer we did consult a couple and both said they should approve our I-601, but i am thinking we need one. Our problem is affording it, i am not working I care for our 2 children and its been hard to find reliable care for them and i had to quit my jobs, but that's another story.

    My husband is currently in the clinic because his blood pressure went up and has been since he got the news, HR at his work sending him home because he was just not doing well. This is really the most horrible thing i have ever endured, i am desperate and very scared for my husband health and emotional stability.

I got really bad news, My husband had been quiet all weekend long and finally today he called me to tell me he got a letter on saturday from USCIS denying our form I-601 saying i need to file I-212 because I was removed. But when my husband talked to USCIS they say I-212 doesn't apply to me because I was never physically removed or processed to be removed and that US embassy is the one that should fix the problem.

    Now we been getting this exact answer from any uscis officers they say US embassy are the ones that need fix my problem, and when we try to talk to us embassy they wont hear it all they have told us is to file I-601 and that it was going to get approve, now we are back to square one.

    Husband will have to come down to go himself to the US embassy and see if they listen to him since he is a US citizen.

    this is a never ending nightmare, right out from hell!!! i cannot help to be so upset by all of these. I just feel very bad for my husband who didn't tell me until today because he was just in a dark place after getting the hell letter.

  11. Yes its very sad how slow USCIS process is for I-601 and many other applications as well, many of us here struggle because of it and its heartbreaking.

    I keep hoping and praying for approvals coming our way soon.

    All i want to clear is uscis is not working only for i601 waiver there are more other categories so they updated for other this time not for i601 waiver.its sad that they are so slow in each process . They dont know how many hearts are trying to peep into system so they can start their life with their loved ones. Its just i am frustrated too being apart?

  12. Well at last! LOL... this has been a nightmare and ridiculous how much we have been waiting for applications to get worked on. Hope they actually do address and find a solution to the problem soon.

    USCIS informed stakeholders that it is working to address the staffing shortages and workload issues that are causing processing time delays. USCIS stated that it recently transferred cases between all of its service centers in an effort to reduce backlogs, ensure that processing times are consistent across service centers, and provide stakeholders with faster responses. On March 11, 2016, AILA sent a letter to USCIS Director León Rodríguez raising concerns regarding the significant USCIS backlogs in processing applications and petitions for immigration benefits, and a lack of transparency in communicating current processing times to the public. I am not sure what you mean? but if you are talking about the Processing times chart on the USCIS website, the chart says at the bottom "Last Updated: April 28, 2016" on the NSC option something Liondness made me aware of. On the top part says the processing dates for NSC as of February 29, 2016.

    I am not quite sure how we are misguiding others?

    Uscis didnt updated since feb 2015 so u r misguiding others ??

ATXmaster, it seems your form is being processed a little different to ours, i am saying for the fact that was sent and process to a different center and was not sent alone right? maybe they have a different time frame, hard to tell because there is really not much information on how they process forms.

    but hope you guys get an answer soon, my form wast forwarded to NSC and its only the I-601 form i sent. I am hoping my form gets approved soon since the forms with higher numbers than mire are getting either approved or REFs.

    My receipt date is Sept 15th, 2015. My case is with the National Benefits Center, so my receipt starts with MSC.
