    That's really weird. You would only have 9B ban if you had accrued 180 days of "unlawful presence" (during a single trip) and then departed the US.

    For your current trip, you have not departed the US, so that doesn't apply.

    For your previous trip, you said that you only overstayed 9 days, so that also doesn't apply.

    So I think it's a mistake.

  2. My dad applied for my f1 and he said i didnt overstay(but i had overstayed 9 days) i got the visa, came here, but they revoked it later. He didn't say anything about misrepresentation. I dont think they will have the reason/all the details of my visa process. They do know that my visa got revoked. This case is inadmissable under 212(a)(9)(B)(i)(1), Which is about the 3 year or 10 year ban. From many people, i heard that my case shouldn't have a problem. I am frustrated right now.

  3. Today i had an aos interview with my usc husband. We got the 130 approved but We got a 601 waiver for accruing more than 180days unlawful presence. Does anyone know about this process?how hard Is it to prove the extreme hardship and how hard is it to get approved? The officer At The interview said if our 601 comes back to him, he will approve it. How long will this process take? Thank you in advance.

    Recently I have been seeing a lot of people saying that I should get a new medical just in case the office asks for it at the interview. I have waited for this journey and I just don't want to deal with this any longer. Plus I got a job recently and my EAD expires in july so I need my greencard by then. so I just went ahead and got the new medical this week. I know I was a little upset to spend the money that otherwise I didn't need to spend, but I just wawnted to be done with this process as soon as possible. It really depends on the IO to ask us for a new medical or not, but in case they do, i just want to hand it over to them right on the spot.

    I got all my vaccinations, would they want the TB test done? Surely seeing I've been vaccinated would be enough! RPR, I've not heard that one, was that what the blood test was for when I had the medical in the UK?

  5. Yes you'll need a new medical, I had mine and the officer asked for it. He said those who turn up without a new medical have an incomplete case and will not be granted approval meaning the case could be delayed even longer. So definitely get a new medical as it will be over 12 months old.

    Ugh. Which visa were you adjusting from? Do you know if that rule applied differently for former k1 visa holders?

    I agree with Teeak,better not to waste the money. If They decide they want it they will ask for it. It wont hurt your interview success or anything like that. BTW congrats

    If you haven't gotten an RFE for it, then don't bother.

    They may or may not ask you to complete one at the interview. If they do, then all you'll have to do is mail it in. If they don't, then you've saved yourself a couple hundred dollars.

  7. haha I know I had my passport picture taken and ready but oh well, I am just glad it's finally showing some progress as well!

    I will be sure to share my interview experience with you! I am getting a bit nervous as the date gets closer :o

    Lucky timing! If I would have just waited TWO days I wouldn't have sent it. Ah well, I already had the package ready and I'm so thrilled that AOS is moving along. It's been a long time coming so it's good to get moving again on the process.

    Haha I read your reply right before I went to bed last night and thought you were funny ;). I really like your positive attitude, haha. I know. A lot of people who applied way later than us got theirs already. When I got up this morning, I got a text from USCIS saying that my interview is scheduled on 5/3! that's over a year since i've applied. Best of luck to you as well.

    What do you mean by priority date?

    Yeah, I know 2 people who came to America at the same time as me and they have their green cards in hand. I'm happy to be here and all, but it would be nice to get this part of the process out of the way. My local office is processing March 2015 cases, haha! I'm pretty sure mine is a June case so 3 months to go, but I'll be moving state in that time so that'll screw things up. Woohoo!

    My priority date is 5/1/15 and my local office is processing august cases. Super late:( its been almost a year since i filed, i had a rfe though.

    Personally, I would wait (it's what I am doing!). I'm not even sure how I would go about submitting new paperwork without having an RFE to say exactly what is needed and where to send it. I'm sure it's possible, but I sure would be annoyed if I didn't need to submit new materials like some people have experienced.

    Check the processing times of your local USCIS center to get an estimate on when you'll get the interview, it depends on where you live. I've been waiting for 10 months now.

  10. I didn't enter US with K1 visa, so I know I'll have my interview for sure. Should I still wait until the interview to see if they will give a RFE for medical or not?

    I went to Infopass and they told me that my case is resolved(I don't know if it's resolved from the RFE I got or the background check I had, probably the background check, though) and the status changed to 'ready to be scheduled for an interview' on 2/29. How long should I expect to wait for the interview?

    Now the status is case approved today :content: I really wonder how they manage those updates. Yesterday the card was on production, today my case is approved (it should be the opposite, but it's not the first time that I see the updates pushed in the wrong order).

    @-Shana-: the form I-693 had 5 pages (now it has 9 pages because they updated it) and the civil surgeon did just the first and the last page. So they were missing 3 pages, plus a thing on the first page wasn't filled.

    The form I-693 is not mandatory, but it's highly recommended to file and a civil surgeon has to do it.

    It's needed just to make some research to find a civil surgeon not so much expensive. Here in my city after several calls the prices were from $60 to $300! But I read about people paying just 15-20 dollars (it depends city by city).

    They didn't say anything about the medical being expired? I haven't even gotten an interview date yet, but I know my medical expired this month. i'm wondering if I should just get a new medical done(spending all the money) when I get the interview date so when they do ask for it in the interview, I won't have to worry about getting a RFE or anything.

  12. You can make a service request and may hear something after 30 days, we haven't but we're thinking about it, just don't want to push for an interview and we rather wait longer than having an interview.

    After many phone calls with tier 2 officers, 2 service requests, 2-3 infopasses, 1 ombudsman inquiry, and 1 senator inquiry, What they all told me is to wait. Some of them said that my background check is pending, but who knows.
