lets just say (theoretically, of course…) : we had filed our I-130 already, and a month or so later my wife came and visited the USA and decided she wanted to stay. Would there be a possibility of filing the AOS while she is in America, and her remaining there while it is processed? And subsequently would we then cancel the I-130 Application?
I saw some things about a few rules regarding the AOS changing in the October, just need a little clarification. Thanks for your help

I am currently in Austria on a Visa D, which is a 6 month Visa granted from the Austrian Government. I am married to an Austrian Citizen. The purpose of the Visa was to stay for an extended period because originally, I was going to apply for residence in Austria. (We since changed our minds and want to apply for residence in the USA.)
I am wondering if it is possible to file directly with the consulate in my circumstance. I have not yet been here for 6 months on the visa, and the visa is still valid. But I heard that the 6 month restriction was lifted…?
I tried multiple times to call and email the USCIS in Vienna but haven't had any luck contacting them.
Any advice would we helpful. Thanks!

I'm having trouble finding information on who to write the check out to when filing the 1_130 application. i believe it is 420$? Just can't figure out who to write the check to… sorry if its a stupid question. my brain is tired

ok, boarding passes and photos! makes sense. I didn't see that information in the guide, it seemed to imply that it needed to be financial.
so do i need to send all of that with my application? or is that more for the interview? or both…

its better than nothing.. I have no shared financial resources with her as of yet, no property, no rental, not much at all. Im gonna get a rental agreement for when she moves there with both of our names, but Im not really sure what else I can do for the evidence...
either way, when i get an affidavit should it be notarized?

Im having family write an affidavit regarding my relationship with my wife as part of the 'proof of bonafide marriage'.
Question is, does it need to be notarized?

My last 3 years of tax returns show a much lower income than the projected income for this year, and my last 3 years of tax returns show income rather significantly below the poverty line. A few points:
-New Employer
-Currently living in family owned house, no rent
-Have about 17k in investments (roth IRA, 401k)
- Income average of about $14k/year for last 3 years
My Parents are considering sponsoring her, but obviously unsure about the obligation of 10 years or until a US citizen, which i completely understand.
I am thinking about attempting to file on my own with my assets and new employment, and seeing how it goes, but if i am initially rejected, how far back does the process go? can I just go get a sponsor and reinterview or do I need to start over?
Appreciate the help!
