  1. Hey guys. I filed in October and I was able to receive a case number via phone call but don’t we need an extension letter to be able to travel? We never got the receipt in the mail

    at all.

     

    We are to go on a cruise outside of the country and it’s next week. How do I obtain a letter or extension notice?

     

    Her green card already expired.

  2. Hey guys! So my mother in law wants to visit the U.S to see her daughter(she’s here as a permanent resident.)

     

    She spoke to a travel agent who’s told her that her income will be insufficient and they’ll most likely deny her visa. Now I know that we can be the ones that’ll pay for her expenses. I know this won’t guarantee her visa being approved due to other factors involved(ties to country, etc). 

     

    My questions are:

     

    1. Do I need to send tax returns or will W2s suffice? 

     

    2. Do we need so sign an affidavit of support for a tourist visa?

     

    3. I’m home in the U.S, so can they accept any scanned (and signed) letters and documents or do they have to be original and signed?

     

    4. Do I need to send supporting documents such as copies of birth certificate, U.S passport, driver’s license, etc? Does my wife as well(greencard, ID)?

  3. Hey guys! How’s it going? Little about this case: So my wife is Brazilian and she’s immigrated to the U.S about a year and a half ago. Her conditional greencard expires at the end of the year(not sure if this will affect her mother getting a tourist visa).

     

    My mother-in-law wants to come

    visit her daughter who she hasn’t seen for over a year now. If all goes well she will be traveling with her other daughter who has a tourist visa and a grandaughter who’s a u.s citizen by consular birth abroad.

     

    My question is can her mother obtain a tourist visa with a daughter living in the U.S? How can we improve her chances? Tips? She has no intention of immigrating. Here are some things:

     

    •She’s owna a restaurant.

     

    •She has a car in her name.

     

    •Owns a piece of Land/property.

     

    •Both daughters are married to American citizens. One daughter is a permanent resident living in the U.S and other daughter makes short yearly visits to the U.S. Her granddaughter is an American citizen.

     

    •None of her family violated any visa laws.

     

    So can these things help or hinder? Will she need to show any stronger ties to her country to obtain a tourist visa? Thanks!!

  4. No your case was expedited like Dwheels said. It caught me and my wife by surprise too. NVC informed us it was because of the Olympics. So just take all of the original documents and the ones you sent to the The National Visa Center.

    So your interview is the 20th. I know a woman who's having her immigrant visa interview the same day. Mine is the 17th. Next week!

  5. Like said above-- lots of red flags. Who is paying for the trip? My wife tried for two tourist visas, refused both times. All the questions asked at the interview were about me (USC). Didn't matter she owned property, car, had her own business, had money in the bank. So now I got her a residency visa. Most likely will return and hand it over for a tourist visa.

    Thats what I imagined.. A friend of theirs(who sent the letter) is paying for the trip. So it here's a greater chance for denial then. Hmm. She's going to try this weekend with her husband. They're going to Rio.

    Arken-Yes, he's traveling with her.

  6. So here's the story. I have a relative who is planning in obtaining a tourist visa for his alien spouse. He moved to her country a few years ago and lives here ever since. He's married to her for 2+ years. He's planning on getting a visa for her. In fact he obtained one for his seven- month child (born abroad).

    Here are some information. Can it help or hurt her chances?

    American Citizen:

    -Lives abroad;

    -Has a car in his name abroad.

    -Has a child abroad.

    -Is a religious leader.

    -Married previously and helped a former alien spouse immigrate to the U.S

    -Has an American child also living abroad with him and spouse.

    Alien spouse:

    -Has letter of invitation for a religious event in U.S and trip expenses paid for.

    -Has no income

    -Lives rented home.

    -Has a child from previous marriage, and one current to American citizen.

    -Has previously travelled to another country.

    Does the American citizen having ties to her country help anything or is it up for the alien to prove she's coming back to the country after a trip to the U.S? They aren't planning on immigrating anytime soon . . . so a IRI visa is out of question. Has anyone had success obtaining a tourist visa after being married to an American? What helped?

  7. Hey guys. I sent my documents to the U.S to a relative so they can forward it to the NVC, I made some mistakes on the tax page.

    1. I was not required to file a Federal income tax return as my income was below the IRS required level and I

    have attached evidence to support this. I checked out yes. The problem is I sent in a tax return from 2013 because that's when I was working in the US, and my income wasn't below threshold. I was not required to file for 2014 and 2015, would be submitting a tax return be a problem? Should I avoid submitting it since it was income from a former job?
    2. Have you filed a Federal income tax return for each of the three most recent tax years? Do I check yes or no? I only have 2013 tax return transcript.

    (Optional) I have attached photocopies or transcripts of my Federal income tax returns for my second and third most recent tax years.
    Again, do I check this out instead of the second one? I only have it for my third year . . . since I did not file for 2014 and 2015 as I was exempt . . . do I even need to add one from 2013?
  8. So I'm in the same situation here. I'm going to file taxes for both 2015 and 2014, as I was living in the U.S for 2013 . . . but now I live abroad and I have to declare my foreign income. I am at the stage where I need to send my documents to the NVC. I have a joint sponsor.

    My question is how long does this tax stuff take? For me to file them how long can I get a transcript to send to NVC so I won't have any more delays? I have to file form 2555 and 1040, how long until I can send the transcripts to the NVC??

  9. Hey guys! I'm about to send off my documents for the NVC. Now I've heard plenty of different things when it comes to income. So far I put $0 as far as income goes because it's a foreign income and below the tax threshold. Now.... I've also heard we should put unemployed. Someone once said:

    "Indicate unemployed with zero income. You can add a note that your income will not continue. Under current income, (See part 6.5 of the instructions.) you are instructed to enter the total income YOU ARE USING TO QUALIFY.... Since you are using none of your income to qualify, it is correctly entered as zero already. Since your employment will not continue from the same source, it is unintuitive but correct to indicate "unemployed"."

    Is this correct? And if I put unemployed, wouldn't this conflict with a letter I wrote to USCIS mentioning I work abroad? Can they deny my wife at the interview for this for misinterpretation? (I'm going to be present at the interview.)

    Secondly. I have a tax transcript from 2013. I have two joint sponsors. Do they focus on my affidavit or since my joint sponsors have all their necessary documentation, they don't focus as much on my form I-874 as my joint sponsors have their 3 year tax returns?

    The DS-260...all of the information they are asking for is about the beneficiary right? Also they are asking to list the places she has lived since she was 16.....this seems very excessive and she has lived in about 10 different places hah

    Well she can give the address to the places she remembers. I know. Personally I thought it was too much. She doesn't remember he address let alone the month and year.

    And yes. This is a visa for her. There will be a few questions about the petitioner. Simple questions like nationality, age, name, etc.

  11. So I've been extremely busy with all the documents, and I made a few copies of the ones I sent to USCIS. Turns out I noticed an error on the G-325a. I put that my spouse moved to an older address at the wrong month and year than the one on the DS260 that she filled out. Secondly, I asked both her parents their date of birth and I was off by two years when she applied for a nonimmigrant visa last year which she was denied. Of course I put the correct year of birth for her parents in the DS260(which she was present at the time). But will this cause a problem in the interview?

    I am aware they have records of her DS-160 nonimmigrant visa form. But her father and mother's birth year contradict each other on those, and her address and year she moved contradict each other and aren't consistent in form G-325a and DS-260. Is this a huge issue that can cause a denial in the interview? As far as I am concerned and I doubled checked everything else is %100 alright. Can she be denied for this simple mistake?
