  1. You don't have a timeline, please provide more info on what visa did you use to get hour hubby to the US.

    Mick came on a CR1 Visa We are now in the process of doing the next step that we have to have done before the two years are up.We filed a I-130 in Austraila 18 months ago. Got approved. He's been in the US with me.He has his permanent resident Card and SSN card.

    We have read the guides and still confused on what we need to file now.

    From your profile, it says DCF? and you said CR-1 visa at entry? ..... so he has a GC already?

    If so and your marriage was less than 2 years at entry then you have to remove conditions not AOS as that is for getting a GC.

    We got married in the USA in March 06 We did the DCF in Sydney Australia In August 06, lodged I-130 and all documents in Sydney (Au) Approved in August 06. We flew back to the USA in late August. He entered the USA on a CR1 visa and has a I-551 Green card. So it looks like we need to remove conditions (I-751 form) not AOS. This is where we were getting confused. Are we on the right track now ?

    I'm still confused as it was the woman in the Police Check division who said they don't do this anymore, and that they told the Consulate but they mustn't have passed this on to visa applicants. I thought I could just submit the form to them anyway by mail, but I'm worried if I do that, after being told not to, that they just won't process it.

    NCBABE, just out of interest, when did you submit your AFP form? I'm curious how long it's going to take if I have to do it that way.

    Sorry about the multiple posts, but I just thought of something else. I have to wait a month to get my fingerprints taken in Melbourne, but I'm going to be in Sydney later in the month, so perhaps I can just have them taken by the NSW police, and then send in my form with them to Melbourne. Can those of you from Sydney tell me if you had to make an appointment for this -- I also seem to recall some stations were better than others??

    I did mine at the local police station for our area in Sydney. They ask whether you live in that area before they will do it for you, but it might be a bit tough. You could try having a chat to Criminal Records Section in Parramatta by phone (02) 8835 7888.

    Well I'm thinking Mick put it in like 7 weeks ago or even more and we still hav'nt got it back. Mick even rang them and was told "dont contact us we'll contact you" lol. thankfully we didnt need the AFP one anyway.

    Well I guess you's want to know what happened at the consulate today. Well it goes like this, WE GOT APPROVED !!!! We pick up Mick's Visa tomorrow and fly back home early next week. We do have to give a big thankyou to all the people on this site who helped us, you's have no idea how much easier it made it for us. If we can help anyone please feel free to ask.

    Congratulations guys, that is awesome! I hope your passage through the Port Of Entry is painless as well. How was his interview by the way, the same type of questions as your petition day, any special kind of relationship evidence they requested?

    Thankyou all for the congrats, Yes the questions were pretty much just a rerun of the I-130 interview

    they just went over what we did the day before It took about 5 minutes for the interview. It seemed like as long as you can prove you can support your spouse and meet the income requirement's then your good to go.

    As aussiedude said, they often aren't up to scratch at the police stations.

    If you can PM me your email I can email you the instructions from the consulates regarding Victoria if you havent gotten that from the consulate yet.

    Mick just had his done in N.S.W. and it was'nt a state check that was done it's actually a national police check. The federal police check we are still waiting for lol, and we had our interview and got approved without a federal one. " National Police Check" with fingerprints is the one you need.

  7. All they really asked was how we met, when we met, How long we knew each other. When and where did we get married. Did Mick like the states. Oh and... did we have any photo's of us, I sez... well no it was'nt on the list of thing's to bring, he sez no problem. and that was basically it. Then he sez approved, stamped the form and said seeya Monday for the final interview.

    Well we got a reply to our email, They gave us a case number and told us to lodge the DS-2001 immediately with a note saying when I'll be in Aussie, what Thursday date i'm lodging the form and they'll try schedule his interview on the next day Friday.

    So its all going good, we do have a question about Federal police checks though. Mick had the national police check done with fingerprints and we got it back. We still hav'nt got the Feds one back and we was wondering do we really need it ? If we dont need it we can lodge the DS-2001 Any help here would be most welcome.

I wanted to find out for us.If our papers we have already got sent to us and filled out.We sent the ones back we were asked to.If they are going to let us got through the process the old way. Seeings we are caught in the middle of this change over.We started our process back in April.I will let you all know what they say.When I get the email back. They say it can take up to five days to get back with me. Wish me all the luck that they let us do it the old way.(We get everything done in one day)

I am going to fly to Aussie from the U.S. and and lodge my I-130 and supporting doc's in person. We sent in Mick's 230 parts 1 and 2 to get ourselves a case number.     Hi again, And thankyou for your reply's and help. We have read the Pinned and DCF guide. I will be going to Australia to attend an interview. I would like to know what is my first step, do I email the U.S. Consulate in Sydney asking to lodge an I-130 form or how do I start the ball rolling.
