  1. I am applying for the I-130 alien relative (spousal)

    First I'm traveling to Nigeria in November and my fiance and I are getting married there in abuja. We first were going to persue the K-1 visa, but decided to go the K-3 route instead.

    Next, I'm just now in the process of downloading all the forms for the I-130 & I-129F. I want to have all the information on the I-130 filled out when I travel there in a couple months and get married. The only thing I will need to put on the forms then will be the date & place of our marriage & (then) my husbands original signiture.

    I'm just trying to get things a bit ahead so to speak and to make sure everything is in place when I return to the usa and send in the petition.

  2. Hi everyone,

    I'm a bit confused here, so please i need help with the G-325 form. First let me say, I'm filling out the form G-325 prior to me getting married (which is gonna be in Nov) so everything will be in place after the marriage.

    ( I have looked at the guides, but still am unsure) This question is for my bio form. It ask for my family name, will I put my married name there or my birth family name?

    I need to know this because I will need to provide a co-sponsor (to meet the 2006 income guidelines of 125% above poverty level) when I file either the fiancee or spousal visa.

  4. Lagos does not accept co-sponsors. My K3 was denied for this very reason and a previous K-1 for another VJ was denied as well. It doesn't matter if the co-sponsor is a relative or not. We tried to fight this with the senators/congress person and Lagos responded to them explaining that they only allow it for the I-130/CR-1. In the past they have. If there is a way for you to get a job before your interview then that would be the best route. Otherwise, u can take ur chance cos it is possible that you might get a CO that you can convince to allow the cosponsor. There just needs to be proof that you solely can sponsor your fiance like evidence of your sufficient yearly income for the last three years etc. They did tell us though that everything else is fine and when the I-130 comes through, they will grant the visa because that allows us to use a co-sponsor. If I had known this, I would have delayed/asked for an extension for the k3 interview because now I make enough money and don't even need a cosponsor but they are not willing to reopen the k3 case and they want us to wait for the I-130 which in lagos right now is taking 8-9months to get an interview date after case completion.

    Thanks for your response to my question. So what the I-130 petition is, a petition i need to file AFTER we are married, instead of the spousal visa, right? Then if and when the I-130 is approved, i can then file the spousal visa and use a co-sponsor. Please correct me if i'm wrong here ok. This is all new to me here, because for the past year my fiance and i have only been looking at the K-1 visa. So i'm very confused as to all this new info.

    I have read some conflicting post here about Lagos not accepting co-sponsors for the k-1 now. Also some say not even the k-3. Please, if anyone HAS used a co-sponsor with Lagos consulate, please contact me.

    I have emailed lagos consulate, but no reply as of yet.

    I'm very distraut and worried about this, because I will need to use a co-sponsor to sponsor my fiance, who lives in Nigeria.

    Please any assistance with this will be greatly appreciated.

  6. Thanks everyone for your comments and assistance in concerning a co-sponsor for my petition.

    First, to answer the question of how i know Lagos, (Nigeria) doesn't accept co-sponsors, is only from post that i have read from other VJ members here gone through the Lagos consulate. So was just assuming their post are accurate. one post says Lagos stopped accepting co-sponsors for k-1s last june. Another post says they do accept for k-3. Then another says they were approved with co-sponsor by using their mother etc. So theyre are many conflicting post here, and i'm very confused on which route to take.

    I also know that the k-1 and k-3 are similar visas, and either may not make any difference whatsoever when it comes to a sponsor.

    Thanks for the consulate info, i will try reach them by phone on monday. I have emailed them in the past with a question concerning birth certificate, but was sent a mail ststing they don't open emails. Anyways...

    I'm yet to file the k-1 for my fiance (he lives in nigeria), and i just found out that the Lagos consulate doesn't accept co-sponsors on k-1 visas. So have decided to marry him and file k-3, because i DO need a co-sponsor to meet the requirements. So my question here is...

    Can anyone tell me what documents are needed to start the process of getting married in nigeria? Do these have to be registered a required amount of days before the marriage takes place? Please if anyone has gotten married in nigeria please send me a list of the required documents need to do this. I appreciate all help and info anyone can give me.

  8. Unless the petitioner is a part of that household, no, the petitioner would not be counted. Only the co-sponsor, the members of that co-sponsor's household, and the beneficiary would be counted to make up household size.

    For example: my father co-sponsored for us. I do not live at home and have not since I was 18. So, the household size listed was 4: mom, dad, my brother, and the beneficary-my fiance.

    That was the answer I got, way back when I asked the same question long ago! Hope that helps.

  9. Hi Everyone,

    I'm a bit distraut and hurt currently due to the fact that i was previously gonna be able to count my aunts income (i live with her) as a means of "Total Household Income", to petition my fiance here. She has changed her mind and will not allow me to use her income to do this. So now, I'm needing a "co-sponsor" and I need clarification on something please.

    When a co-sponsor is used, does the co-sponsor have to count the petitioner and their dependents along with the intended immigrant when figuring the "income guideline" or is it just the co-sponsors dependents along with the intended immigrant?

    Example... co-sponsor + 1 household dependent +immigrant for a total of 3. Income requirement of $20,750.00.

    Please qlarify if this is correct.

    I'm a bit confused about this new IMBRA law.

    Does this new law only effect (men) as the petitioner of a foreign bride, as in extensive brackgound checks, or does this also apply to women petitioners as well?

    Was just wondering due to the fact that I'm a woman applying for a foreign man fiance, he lives in Nigeria.

    ( I have not submitted my fiance petiton as of yet)

    Please if anyone can enlighten me I will be so greatful.

  11. Hi,

    I'm unsure of what to put on the employment history section of the K-1 visa. The petition ask for my fiances employment history. I have already put my fiances present employers info down. But there is a time gap between the present employer and his previous employment date. This is due to fact that he was attending college.

    My question is...should I just put (none) between these two employment histories, or should I put (attending college) so as to explain why there is a gap between employment?

    I had read here somewhere on a post before that one should not leave a gap. Please advise.

    I live with my aunt and am going to include her income on the Affidavit of Support to meet the guidelines.

    I know she has to fill out a seperate form (I-864A) as I do myself. But my question is, "what document do I need to submit to prove her relationship to me? I have proof of her residency as in electric bills, phone bills, etc. But am wondering how and what I need to prove she's my aunt, my maternal aunt. She is 78 yrs old and I may have a hard time getting birth records or other documents to prove this. Please advise.

    I need to know how to assemble my emails for the K-1 petition. Do I put our first correspondence (the beginning of our emailing online) on the top and then follow with emails that establish our relationship on down the line to present? Or should I put our relationship as it is now, and work my way back to our first emails etc.

    Thanks for all input on my topic. I appreciate it soo much.

    I have rewritten my declaration of meeting letter and cut out all mushy info and stuck with basics of our meeting online, and from there on up to our first face-face meeting. I also do have pics with my fiance's brother and with his coousin that i will submit as evidence, along with boarding passes, a few emails i chose, phone bills etc. Am only inclosing a few of each.

    I'm really dishearted now because of one reply about nigerian visa scams they view on tv yesterday. I'm soo worried now more than ever that the k-1 will be denied. As for hiring an attorney in nigeria, neither my fiance or myself have money to fund this. What do we do now?

    Is this in response to the question asking you to describe the circumstances by which you met? If so, then the content and context needs to be more along the lines of, "we met online and chatted...." etc.

    Looks fine. Mine was much more literal than yours and less the lovey-dovey stuff but yours will suffice to get the point across.

    Hi thanks for your quick response here. I'm a bit confused now.lol, is monday you know. But i think what i'm asking here is when i write the letter of meeting, pertaining to question 18, is this suspossed to be like you said "we met online, emailed , phone talks etc," and all leading up to our physical meeting with submitted evidence?

  17. Hi,

    I'm not sure of which address I need to use on all the documents needed for the K-1 visa and letter of intent etc.

    My fiance gets his postal mail at a different address ( A Catholic parish address) than his physical residency address, ( b/c postal service is not reliable at physical residency address) so which address do I need to put on all documents involved?

    I'm concerned that if I put 2 different address they may question this. Please advice.

    I need to know if disability social security income qualifies as being able to sponsor my fiancee on a k-1 visa.

    Along with my aunts income(I live with her) we have a total of way more than the 125% required to sponsor him. Also since i don't file an income tax return(ss disability not taxable amount) what do i need to get from the IRS to substantiate this?

    Please if anyone can advise me i will be forever thankful.
