Okay so as long as NVC gets the application before October , beneficiaries with approved petitions should be okay right ?
I understand that all applications that go to NVC ( which is just a triage office) are set an interview and get a visa ( as long as anything is wrong with the application )!

After the case is sent to NVC priority date doesn't matter at all . And I was thinking it didn't matter after the USCIS approval if it is current .

Well I can contact NVC and tell them the priority date is current and the child will age out . And I thought if the priority date is current when petition is approved by USCIS we are good . According to you we aren't ? :-(

Child is 20yo ! Priority date is CURRENT and case was approved today by USCIS. What can I do to speed up NVC / consular processing (Brazil).

Hi! I just want to know what form did your husband filled up? I-864 or I-864a? Are you guys living with your mom?
I have the same situation. My mom(LPR) petitioned my sister and no income and we live with here and shares the same address.
I'm just wondering if the ff is correct:
Mom (petitioner)- file I-864
Me(daughter)-file I-864a
my Husband (son-in law of petitioner)- file I-864 as joint sponsor or I-864a as household member?
Is your case already completed? How did it go? Appreciate your response. Thanks.

The correct form is the I864A - attatched to the sponsor's I864.
Let me know if you have any more questions .

I am not sure... trying to understand CSPA myself.
According to ***removed*** calculator your child isn't eligible because you waited too long??! but his visa just became available...!! :wacko: I am confused, hope someone can help us

I am a f2a petitioner for the second time and you know what I just remembered ?
My brother's PD became current about 6 months before USCIS approved.
as far as I recall his interview was schedule and everything happened normal regardless his pd.
I did contact my congress man just to make sure.

I didn't read the whole thing . In YOUR case what I would do is to contact your congress man and ask them to expedite your case . They can do that if its out of processing time.
My congress man has helped me a lot .

Okay but 99% of times USCIS approves the petition way before PD becomes current .
I was just trying to say that a few months delay shouldn't cause any panic.

it doesn't really matter how long USCIS takes to approve your petition. What really matters is PD!

I know it would be only speculation but I would like to know your opinion about my little brother's application. Do you THINK its likely he will be eligible for CSPA?

Visa Bulletin is currently processing applications with priority date 10/2010.
is it better that USCIS takes about one year to approve his petition? It looks like he would be eligible for CSPA if yes. What do you guys think?

NVC told me not to translate if documents are in Portuguese but I think I will do it just in case .
A PDF printed certified translation should be fine or should I send a hard copy??

Sim vc precisa fazer a traducao...did you translate any document when you sent her I-130? Lembre-se that she will need her Police certificate from Brazil and you will need to translate as well...by the way anything that is not in english need to be translated!

See that's why I am confused . USCIS website says this :
"All documents not written in English, or in the official language of the country in which application for a visa is being made, must be accompanied by certified translations and submitted to the NVC"
So it can be in English OR the language of the Country that the petition is being made !!! In our case Brazil right ?

What do you mean by "copy"? We must send originals of everything . I have done petitions in the past and as far as I remember I didn't translate anything to the NVC .
Only time I translated was for my naturalization- because interview was held in USA.
Any other opinions ??? Please help me I just want to do everything as fast as possible :-)

I am about to send form DS 230 with all the required documents . My mother's interview will be held in Brazil where we speak Portuguese .
Do I still need to translate the documents like birth certificate etc that will be send to the NVC ?

But it would have eliminated the wait for the new I-130 for the Mother so that was probably the route that should have been taken (and maybe still could be taken)?
Why did the consulate say she's not eligible for the SB-1? How long ago did she abandon/lose her LRP status?
I don't know why... when I explained my situation they just said that she wasn't eligible. I asked why and they said if I needed more information I needed to contact uscis... It would save me about 5 months.... so not that much. .. I could apply but I can't prove that my brother didn't have anybody else to care for him. (how do you prove that?).
