  1. Dear gurus,

    I am a US citizen petitioning for the green card for my wife. We have an interview date set already. I have been a graduate student overseas for the last 5 years and just got my first "employment" at the start of 2015 overseas. I have not filed tax returns for the last 5 years because my income (a scholarship stipend, <$30,000/yr, no W2s or anything issued by university) is too low when foreign-earned income exclusion is considered (comes out to a "total income = 0 $" on the 1040 line 22). However, I have assets (bank account statement) over 5x the poverty minimum for a household of 3, like mine. I also have a job offer in the USA with good salary that I signed/accepted. Should that be sufficient? Or should I consider filing "late tax returns" even though I owed nothing and take the slips with me? Thanks!

  2. Hi all - a general question for the gurus:

    My wife (Jordanian) and I (American) were married in Jordan and lived in Saudi Arabia for 5 years together. I-130 is complete, and our case is set up for immigrant-visa interview in the Saudi US Embassy. We will have to leave Saudi because I have a new job in the USA, and the start date is like 5 days after the set interview date. It is really close, but we understand the pressure on the Embassy. As per law, when you terminate work in Saudi Arabia, you have to do a "final exit" (can't come back into Saudi after that) all together as a family.

    So a question: Suppose the interview goes well and visa is approved - can we keep her passport, travel back to her home country (i.e., Jordan), send her passport via mail back to the Saudi US Embassy, let the processing be completed in Saudi, visa be issued, and passport be returned to her in Jordan. Then she would be able to enter the USA with her immigrant visa.

    Any one heard of such an approach? Is it acceptable by an Embassy normally.
