  1. More good news!! Got the official letter in the mail today and it says [b]"your new card will expire in 10 years"[/b] :dance: Hurray! no more red tape from USCIS until he goes for citizenship.

    Hang in there everyone who is still waiting, your turn is coming. :yes: Our senators office made a difference once we got out of FBI background. so keep communicating with them.

    This was emailed this morning, does anyone know if the same wording is used for conditional permanent as it is for the 10 year card? We are just happy to have this done, but are curious whether it will be the 2 year or the 10 year. Also was is ADIT processing?

  4. No he is already a physician in his country and has passed 2 of the 3 USMLE tests here. He has to serve a 2 year residency here and is applying for that. He will take his 3 test in October. He does not need to go to med school again and I am not sure he has to have his green card to do a residency, but he does have to be here legally, which he is.

    He wants to enroll in medical school? You should call the school. Med school is different than just a regular university or college and he might HAVE to be a conditional or permanent resident before he even applies.

    Ok I got this from the uscis site and I think he may be considered immigrant

    A lawful permanent resident is a foreign national who has been granted the privilege of permanently living and working in the United States. If you want to become a lawful permanent resident based on the fact that you have a relative who is a citizen of the United States, or a relative who is a lawful permanent resident, you must go through a multi-step process.

    The USCIS must approve an immigrant visa petition, I-130 Petition for Alien Relative, for you. This petition is filed by your relative (sponsor) and must be accompanied by proof of your relationship to the requesting relative.

    The Deparment of State must determine if an immigrant visa number is immediately available to you, the foreign national, even if you are already in the United States. When an immigrant visa number is available, it means you can apply to have one of the immigrant visa numbers assigned to you. You can check the status of a visa number in the Department of State's Visa Bulletin.

    If you are already in the United States, you may apply to change your status to that of a lawful permanent resident after a visa number becomes available to you. This is one way you can apply to secure an immigrant visa number. If you are outside the United States when an immigrant visa number becomes available, you must then go to the U.S. consulate servicing the area in which you reside to complete your processing. This is the other way to secure an immigrant visa number.

  6. It would be nice if they did issue a 10 year card, but I will be surprised if they do. His interview was given 5 months after he applied for AOS which was only 7 months after they married. It is my understanding that they only issue a 10 year if the interview is done after the couple has be married 2 years?

    Still waiting, next month he will have been in this country for 3 years, 2 years 8 months since he applied for AOS, 2 years 3 months since interview. We have done all the right things yet it still keeps dragging on :wacko: Tomorrow is time for another letter to senators office.

    I still cannot believe they would request additional evidence of married life. This is years later! This isnt "another test" - this should have been cleared at the interview!!?? If the only thing they are waiting for is the namecheck to return why why why do they need this other stuff? I just don't get it.

    I'm guessing it's because they are going to have to issue a 10-year greencard at this point. But for some reason unknown to us, they are wanting the 'proof' as if journeyhelper were lifting conditions.

    Smells like discrimination to me. Or profiling.

    Would make a very interesting news story.

  7. Yes we are very disappointed that the Indy office got the FBI background check back in December and it has taken 7 months for them to do anything. We don't really have any problem with them asking for additional proof, it just seems like they could have let them talk to the officer when they went for the info pass appointment on July 17th along with bio metrics. at the appiontment he asked about renewing his EAD but the woman at the counter (who was all they were allow to speak to) said the green card would likely be arriving before the EAD. I think we are at the end of this but it is sure frusturating to keep dragging on.

  8. Went and did the supposed last biometrics . They said it is approved but just needed the biometrics since they were outdated. Then they said it may be 45 days before we hear anything. I hope not! Monday will be 2 weeks since he was there, so if nothing has changed by then we will contact the senators office again.

    I guess this is going to just keep dragging on and on :crying: its only been 2 plus years since the interview!

  10. Thank you for your words of support. Tonight there is an article in the paper about a man who has waited 5 years so far for his namecheck and how many are now turning to the courts for help. I will let everyone know as soon as we hear. Since we are trying to decide whether to get his EAD renewed before the 30th you can bet we won't hear before then :) I am very sure the reason there is movement now is because of Senator Lugars immigration assistant who is a truly persistant and dedicated person.

    My husbands' notice was also on white paper. And it came from the District Office, not from Missouri.

    USCIS is ready to produce a greencard for your husband. A lot of what will happen after he appears for re-printing will depend on the District Office. An AO now has to sign off on your case, and then a supervisor. If they handle it expeditiously, you should see your case status begin to change on USCIS.gov within a week, and you should receive the first of 3 emails which document each step of the process. If on the other hand they decide to drag their feet, you could still be in for a delay.

    I'm a great advocate of patience with this process. But not at this point. After your husband has appeared for his prints, I would give them about 2 weeks tops to see the card. After that I would become LOUD and PERSISTENT in my quest for a resolution to this delay. Should there be a delay, I would allow myself one INFOPASS, and after that I would engage congressional assistance.

    They owe you a ten-year card. And they owe it to you NOW. "Owe" is not a word I generally use with this process - but the namecheck has cleared and you otherwise met the criteria when you interviewed so long ago.

    They owe you.

    It sounds to me like they want prints for production of the card!! I think you are in luck!!

  11. What's sad is that our FBI namecheck was finished last December, we know that because the senators office sent us the email they received from the FBI. It's the local office that is the hold up now.

    Well just got a letter with an appointment for Biometrics on July 16. Dare we hope this is the end of over 2 years waiting?

  13. Thanks for the information on the fee increase. $180 to $340 is crazy. I thought once the FBI name check was complete the process would really speed up. But nooooooooooooo! now it has been in the district office since December. And yes they told us he was approved pending namecheck. I hope this is not the case for anyone else, but evidently there is no end to the waiting.

    The new EAD is $340 and the new advanced parole fee will be $305!!!

    I think the ones that have paid for these over 4 times should get a discount!!!

    We are also bugging the senators, ombudsman, etc. with no luck. October 2005 was our "approved" pending FBI namecheck and no one seems to want to help; standard response; you're not the only one waiting!!!! I just love the strange looks when someone who doesnt know better says : " But you married a USC"! \They think its that easy!!!! NOT

  14. Our FBI background check was sent back to Indianapolis last December after 2 years, and still we wait. Have a letter from them saying they will have a decision by May- nothing. The senators office is now making its second inquiry about this.

    Anyway my question is about the new EAD fees is it going up from $180 and if so when?

    good news...somebody told me that they are hiring 400 people just for take care of the namecheck backlog, they wanna get this done until the end of this year...i hope so!!!

    that would be great if its the truth and these 400 people dont take forever to be trained. lets just hope they can finish by the end of the year cuz we will have to apply again for ead in dec for my husband at the new rates which sucks big time.

    Update from michigan..

    I have never been involved with such a bureaucratic fiasco in all my 50 plus years. If we ran our lives as they run their business, we would be dead. We can only hope USCIS someday reaches a similiar demise.

    I guess the bottom line is...mistakes cost us...not USCIS...even when they make them. Be persistent...be vigilant...be patient...
