  1. I'm seeing a bigger problem with that other thread. Like that one, my wife took my last name but her previous last name is now her middle name. Every document is labeled the same way except her Philippines passport (which obviously has her names different).

    I guess I'm failing to see a problem. The other thread mentioned a conflict with another file, which shouldn't be a concern here. Everything we've done has been consistent and she has three names, not four like the other thread.

    Is she worrying too much here? I don't see a need to change her name. Everything was done the same (SSN, DL, Mil ID, Marriage Cert, Green Card, etc) after we got married...no discrepancies.

    Finally, her Philippines passport is expiring...is it necessary for her to renew it? She just wants to get a US one after her citizenship is finished.

  2. We are starting the naturalization process for my wife. A little background:

    - My wife has been a resident since 11/2007 (received 10 year card in Feb 10)

    - I am active duty military for over 20 years

    - My wife came here on a Fiance Visa

    - She has not left the country since she came here

    When we got married, my wife took her maiden last name as her middle name (as many Filipinas do). She took my last name as her last name. All of her documents are like this but her old passport from the Philippines lists her current middle name as her last name.

    My wife recently got a call from her friend about how someone got denied due to a similar situation...something about possible fraud. I told my wife that her case isn't unique and I'm sure there have been countless others like this. There has to be some other mitigating factors.

    Immediately after talking to her friend, she goes on an on how she needs to get a lawyer to change her name back. Obviously, this would present many problems since all of her documents since she got here have her previous last name as her middle name.

    My question is this: can anyone shed any light on this? Is this an issue or an obvious misunderstanding and overreaction on her friend's part? I tried to search the forum but admittedly, have taken a break from the process (until now) because it's draining working full-time, running a part-time business and dealing with all of this. Now that she's approaching her three year residence mark, we are trying to start her papers. To me this reeks of overreaction but I'd like to know if there is any validity in this. I told her that if she starts changing things then that will definitely look sneaky and that her situation probably isn't new.

    Thanks for your help. Sorry if this seems "newbie" like but I really don't want her stressing out and stressing me out in the process. Everything up until this point has been done without lawyers and I plan to keep it this way.

    Here's what the RFE states:

    "a review of the evidence submitted (lists all of my submitted info here) does not establish that the marriage between you and your spouse was entered into "good faith". Therefore, you are requested to comply with the following:

    Submit copies of documents indicating that the marriage upon which you were granted conditional status was entered into "good faith" and was not for the purpose of circumventing immigration laws. These documents should demonstrate the circumstances of the relationship from the date of the marriage to the present date. Examples include, but are not limited to:

    Then it talks about all the examples including all that other non-sense abut financial records, joint records, etc.

    This is why I am a little worried. So while someone mentioned they submitted less than me, it seems they may have gotten someone evaluating their case that had a better day than our evaluator. Who knows? There is no guidance exactly what to submit and I thought I submitted what they asked for the first time and we know that wasn't right.

    So, I'd rather have more than enough than not enough...that's my logic, at least. With that in mind, any more thoughts? It seems like a letter is a good idea?

  4. Ok...here's our situation. We filed for removal of conditions in September. Late in December, we received an RFE. Looking back, perhaps our package was a bit minimal. I followed the directions, included two affidavits, copies (my copies) of 07 and 08 joint tax returns (not complete), last two joint leases (not complete...just the front page showing we are on the least jointly), pictures from various weddings, family events, reunions, etc, a couple bank statements and some other stuff.

    So, here's the deal. Susie and I have been married since March 07. Our relationship is legit. I have been in the Air Force for nearly 20 years. I moved into our apartment about three months before she arrived, so all of our utilities are in my name. I did not have the hindsight to put them in both of our names, so I do not have bills in both of our names. It wasn't something I thought about. We just paid the bills and didn't think anything about them. Needless to say, I don't have joint utility bills to use as evidence.

    Since I submitted the initial evidence, we did renew our lease, so I have a third lease to send. This time I made copies of the whole lease and I had the leasing office type up a letter stating that they are official copies and that we have been tenants for over three years. So, I'll include that in the package. I also contacted the IRS for OFFICIAL transcripts of our 07/08 joint tax returns (the original instructions didn't say anything about official copies but the RFE said include official copies, which I have now). These will be included.

    I have vet bills (many) which I will include for both of our dogs which are in both of our names. I also have made a copy of our military ID cards (front and back) that lists Susie as my spouse. I also went to my personnel section and had them print out a copy of when she was entered into the system (right after we were married) and they gave me a copy of a print out of my life insurance that lists her as beneficiary and the eligibility date (March 07), which is another good thing.

    Outside of that, we don't have joint bank accounts for the ENTIRE time. We only recently added joint bank accounts. I had an old account that I always used JUST to pay bills. I added her to it this past July. We still only use it to pay bills. She made her own money and saved it, which was good and I supported that and we recently updated it to add me back around the same time. So, they weren't accounts held jointly the entire time. I know this isn't going to help our case in their eyes, but I can't do anything about this. It certainly wasn't something we did to be sneaky. It just worked out that way.

    Both vehicles are in my name because I get a military exemption. If her car was in my name, we would pay more money for registration (approx 100 more a year) for the vehicle. I included our vehicle insurance card with our original package, so I can't include that this time. Her name is on the insurance policy.

    I do plan on submitting a copy of her state driver's license that shows her address and submit a copy of my Record of Emergency Data, which lists her as my spouse and emergency contact in the event of my death. It also lists her as the beneficiary for a "death gratuity" if I die. Additionally, I plan to type up a letter, outlining basically what I have stated here about the utility bills and having it notarized.

    I know this is a little long-winded, but before I continue, is there anything else that you guys can think of that I can include that may help? I can't resubmit stuff that has been included before, but I am included stuff that was incomplete. Obviously, we are nervous and I know we have no right to be because we're not hiding anything. It's just that I don't have a lot of "joint" documents that others seem to have. I may have been remiss not to save a lot of things or connect all the dots for the past two and a half years, but surely someone should be able to see through that.

    Help?

  5. I agree with the fact that sometimes it is really retarded: I never kept much evidence although I have been married for 3+ years and been together for 5+ years. When it was time to do the removal I had to call utility companies and request copies of bills and stuff since we do everything online and never get any bills, so it was quite a struggle to collect everything: they should tell you to keep bills and other ####### somewhere when they give you 2 year card or something.. Plus many companies simply can't put 2 people on the contract.

    Did you send joint rental or mortgage? Were the taxes the tax transcripts from the government or just your own copies?

    I sent the joint rental but again, I only sent just the front page (or incomplete copies, as they listed). I thought the purpose was to show that we were leasing jointly. I guess I was wrong?

    The tax copies were my own (again, incomplete), but again, the instructions didn't say it had to be official copies from the IRS. It just listed copies. The RFE specifically lists official copies. It's kind of funny, I am on the phone right now requesting transcripts from the IRS right now...they say it takes two weeks. We'll see. Are the transcripts what most use? They are official, but I would think copies of tax returns would make more sense...again, I was wrong on that one.

  6. The RFE listed the stuff I sent and asked that I do not re-send that info again.

    I sent our joint 07 and 08 tax returns. I did not include the TOTAL return...just the front page, as I thought this was the only page needed because it shows that it was filed jointly and included the address and both of our names. They listed it as "incomplete". This was the same for our joint bank statement.

    I thought the point was to prove that the relationship was in good faith...I did not know they wanted to look at completed tax returns. They asked not to re-send the same info, so I'll re-send completed tax returns.

    I also sent in pictures...lots of them. I guess pictures with my family (Father, sister, aunts, uncles, weddings, best friends, my high school reunion, etc, etc.) do not prove anything...so I think those are fairly pointless as evidence.

    Additionally, I sent two affidavits. One was from my supervisor at work who is also a friend. We attended his son's wedding too. The other was from a family friend, whose wife, incidentally, helped teach Susie to drive (she has a lot of patience :lol:).

    I included some other documents as well. In hindsight, I followed the directions but could have included more. Perhaps I'll write a letter. I intend to include her life insurance beneficiary policy and she has a life insurance policy listing me as the beneficiary too. I also intend to include everything that lists her with this address I can find. I don't care if it's joint or not. I'll fill one of those priority mailing boxes full of documents...if they want evidence, I'll get as much as I can.

    Honestly, I haven't thought of this much the last two years. I haven't thought of ways at how this would look according to some pencil neck at USCIS. If things have been set up in both of our names, they've been set up in both of our names. That's just the way it is. Like I said, Susie's name isn't on utilities because they were pre-existing. She has her name on our insurance...she is on our telephone bill, we have joint checking accounts (but they weren't always joint...they only go back about six months. We used to just have our own...is that so bad?).

    Sorry, I'm off on a rant here, but we've been together going on three years here and all they have to go by is papers. I know it's up to us to provide proof, but it's pretty hard sometimes when you aren't thinking like that but just living without a thought about this nonsense.

  7. What did they ask for?

    More evidence. Apparently I didn't supply enough to satisfy their "good faith" requirement. It's pretty open and shut really. I did what they asked, included some extras and put it in a nice little package. That wasn't good enough.

    I don't have joint cable bills, joint water bills or any of that non sense. That stuff was all set up before she got here and I didn't have hindsight to go through the trouble to think about that. I wish I had now, but I don't. It just seems pointless. She gets all kinds of mail, but the document implies joint type of documents were best.

    We have no children, no loans. Even her car is in my name because it's cheaper that way because we get a military exemption. We save over 100 dollars on registration costs. How do I explain that to good old paper pusher at USCIS? I've got 20 years military service and this stuff is stressing me out more than anything at work.

    I'm looking at all kinds of stuff now. Receipts for money we sent her brother back home, receipts for money we spent on the dogs for medical costs (it has both of our names on it), anything...I'm going to include anything that has both or just her name and our address on it and send it in.

    Does anyone have any suggestions?

    Where did you submit your I-751 to? VSC or CSC? If you lived in Colorado when you submitted it, you should have sent to CSC.

    No, I submitted it to VSC because I live in MS. In June, I will move to Colorado. We've already done Biometrics.

    Certainly the paperwork doesn't stay with the VSC even though I live in Colorado, which falls under CSC. I'm sure the case is transferred. This usually comes with a extended wait time.

    Yes, by looking at the dates, one would assume we'd be approved by then if all goes smoothly. I guess that's the rub.

  10. In California, she is only entitled to half of what was obtained during the marriage. What was yours before the marriage will still be yours. In addition, if there is a threat of violence, you can obtain a restraining order against and get her out of the house. In the meantime, I would file for divorce immediately.

    I realize you're worried she's going to "go nuts" but if you document everything she breaks and damages, she will be liable for those assets (if they were yours before the marriage, she damaged your property). If she's unable to pay, then guess where it comes from? Her 50 percent obtained during the marriage....which is probably very little to begin with.

    Oh, and since you're retired military, she's not entitled to any of that. She wasn't married to you for any percentage of your military service, so her percentage is zero! I'm a military vet of 19+ years (and still going).

    Like others have stated, contact a divorce lawyer. Stand up to her. Maybe it's time you fight fire with fire.

    I have a question. I received the NOA on 28 September...which is about two weeks ago. I still cannot add the case through the USCIS login page and when I called and entered in my receipt number, it told me that my case cannot be found.

    What gives? Does this take a few weeks before I can check the status? Everything is entered in correctly as noted on my NOA.

    I see a couple of old friends are now moderators on the site.

    Jenn, it looks like things are going well for you. Removing conditions seems a lot easier than what we've been through, so this shouldn't be so bad.

    A friend at work has a wife from Panama. They met when he went down there for a few months at work. Coincidentally, I was stationed there at the time back in 1997. She's been over here since 1998 and she just got her citizenship in November. At least I have him to help me a bit in the long term process.

  15. It's been a while since I visited these forums. Susie and I married in Mar 07 after she arrived in the US on a K-1.

    The last two years have seemed to fly by. Susie is working two jobs...one as a waitress. I also work two jobs. I am eligible to retire from the Air Force in about 14 months and I also have a part-time job as a manager at an auto parts store.

    In addition, I'm also going to school...I'm trying to finish up my bachelor's in Business Admin.

    As you can see, we've been quite busy. Susie works close to home, so we've been getting by without two cars for a while, but we just bought her a car and she's learning to drive now. That's definitely another challenge and a nervous one for me. :yes:

    We've got a couple trips planned within the year...a cousin is getting married in Chicago in May and my 20-year class reunion is in SoCal in July, so Susie is pretty excited about those.

    I'm pretty anxious with the prospects of retiring from the Air Force. I'm pretty confident I can land a civil service job after retirement, so that has tempered the anxiety somewhat. At any rate, Susie is at work today and I took a couple days off to finish up some school work and to sit on the couch and veg out. Call it a treat for my weary body and mind. :lol:

    Susie's 2-year green card expires in Nov. so I'm starting to look at getting that paperwork together so we're not caught off guard. If anyone has any advice on that process, I'm all ears. Our journey has been real smooth up to this point...no issues. I'm hoping the removal of conditions goes just as smoothly.

    Also, our two-year anniversary is on the 9th of March, so I really need to get something for that or I'll be in big trouble.

  16. Ah, it's been a while since I've visited VJ and my recollection of the process is fuzzy, at best.

    My wife, Susie, arrived in the U.S. on a fiance visa back in Dec. 06. She got her 2 year card after we were married. Well, that card is set to expire in November of this year.

    I hate to sound like a newbie, but I'm lost again and I need to find my way. I want to start preparing for her 10 year green card but I don't know where to start or which document I am to file.

    It's been a while since I posted here...it's been a busy time for me. We've kind of held off doing the AOS paperwork and I am looking to get it all together before the rate increases. I need some major help.

    Susie came here on a K-1 and we fulfilled the requirement by getting married before her 90 days were up BUT we have not done her AOS paperwork. I am in the process of assembling her documents now but looking at things, I'm a bit overwhelmed. Here is what I think I need for her AOS based on the K-1 entry:

    -Payment (we plan on sending in EAD along with AOS)

    - Cover letter (is this just a table of contents or is there an example somewhere?)

    - I-485 AOS

    - Copy of K-1 Visa passport

    - Copy of NOA2

    - Copy of I-94 (front and back)

    - Copy of her Birth Certificate

    - Copy of Marriage Certificate

    - Two passport style photos

    - G- 325A

    - Vaccination record

    - I - 864 Affadavit of Support

    -copies of last three tax returns plus earnings statements for six months (I'm military, have this stuff)

    - Other evidence - copy of military dependent ID, phone bills, etc

    Also, Like I said, I plan to file the EAD. I am unsure what goes along with t he I-765. Does this get sent in the same package as the AOS package? Do we need two more ADDITIONAL passport photos for this?

    Thanks for your help...I should have come to you guys for help sooner, but admittedly, I've been dragging my feet. I would appreciate your help...I'm pretty stressed right now. Please tell me if I'm missing anything.

  18. Susie and I recently got married and we are in the process of filling out all the required paperwork for EAD and AOS. A few of my friends had told me that their spouses were able to get a Social Security Number while waiting for their EAD. The problem is, Susie's I-94 date has expired so she doesn't even have a temporary work authorization and the lady at the SS office told me that if you aren't legal to work, you can't get a number.

    I have read that an Alien that isn't allowed to work can still get a SS card. Has anyone had a situation similar to this? I'm not even sure I can get Susie's military dependent ID without a SS number.
