  1. Hello all and happy new year!

    First of all my apologies if this post is redundant. I have searched the posts on here looking for whether someone already posted about this but found nothing.

    We are just about to send in our AOS and IV packets and my brother has volunteered to be our joint sponsor as I have been living out of the country and needed someone with adequate income. He has the income requirement covered as he owns his own business.

    The only thing I'm worried about is the fact that my brother went to jail more than 17 yrs ago for 1 night...it was related to breaking into some cars something really stupid however, this remains on his record until today.

    I really don't want to go through all of this only to discover that he is denied. I went through the affidavit of support form and not once does it ask about criminal record....I know they want to know all about the beneficiary and we already have the reports required for the beneficiary and it should not be a problem....

    Please give me your advice...will we be denied based on the joint sponsor issue? Do I need to find a new joint sponsor?

    Thank you! Well in the process of doing all of this...I overlooked the fact that my brother (our co-sponsor) went to jail and has a couple of offenses on his criminal record!!

    The offenses are stupid..one night he got drunk and broke into a couple of cars and spent 1 night in jail....I think he has 2 offenses now on his record. This took place maybe 15 years ago (more or less)..would this mean we could be denied based on this fact?

    I would rather know this now than send in his papers and find out later.

    Any advice on this would be appreciated...I cannot believe we overlooked this before..

    I am in the process of sorting out requirements for a joint sponsor and I want to make sure I do everything correctly here....

    I filled out my I-864 and since I do not have enough income (am living overseas), my brother will be the joint-sponsor.

    He has two dependents including himself and my husband (the beneficiary) will make a household size of 4, so we need to prove $30,312.

    I understand that the total income must be from line 22 on his 1040.

    My question is do I need to send tax information from the last 3 years? (2012, 2013, and 2014?) OR, will just 2014 suffice?

    Also, my brother is self-employed. How do I prove income for him besides his tax form?

  4. hmmmm..this one is difficult because our decision about when we will re-locate is entirely dependent on how long this visa process takes.

    Since we do not know how long it will be until we are granted the visa, we have not made these types of decisions yet. Regarding starting the house search.....I do not want to rent something up there until we have met our obligations down here. How would I pay two rental payments per month? Maybe copies of inquiries into homes up there would suffice? I'm not going to be ready to sign a lease agreement on a house until I've moved my family up there. So, maybe a letter from the people we intend to stay with and some copies of the inquiries we've put in on homes up there ? It's just difficult because we do not have a date on when we will move yet.

  5. Hello, thanks for all your advice on this...this step is not easy....

    I have a joint sponsor lined up already. My brother is going to do it. Actually, my brother owns a company and can show the required income. This is where we will live once we go back to the US.

    The job I started was with the understanding that I will be moving to the US so my job is dependent on this fact. I was thinking I could have my employer sign a letter showing that the condition of my employment is based on the fact that I will be moving to US once my husband's visa is approved.

    DOMICILE- Does this not prove that since the condition of my employment is based on my ability to return to US?

    Can my joint-sponsor also prove Domicile or do I also have to prove this? I have been living abroad for 5 years and have no home in the US. We would do this together once the visa is approved.

    Basically, right now, I'm waiting for a letter from my employer stating my estimated income and the fact that my employment is based on being able to re-locate to the US and the I-864 and tax forms of my joint sponsor...after this is done, I think I will be able to send all these papers in...I think I'll have everything I need?!

  6. The job is 100% remote but since most of my clients are based in the U.S. it will beneficial to the company for me to reside in the U.S.

    I will have my company write a letter showing the amount of commission made so far and state that it will be beneficial to reside in the U.S. Do you think this is sufficient?

    I am a US citizen filling out the I-864 form for my spouse. My employment situation is a bit complicated so I need some advice.

    I plan to file with a co-sponsor in order to guarantee we have adequate income for the requirements.

    My doubt is that I just started working as an independent contractor for a US based company 2 months ago and my salary is 100% commission based. When it asks for my annual salary, how can I put this value in when I do not receive a monthly fixed income? I also do not have W-2s nor have I filed taxes for this job yet because I just started working there in Sept. 2015.

    Can I just put an estimated amount for annual income and get a letter from my employer? Or do I just use my employment information from last year and tax docs from 2014? And use this new job as proof of domicile?

    Please help!!
