  1. My wife an I just got back from our interview at the Honolulu USCIS office.

    We arrived at about 9:30 for our 10:00am appointment. We passed through security and presented our appointment papers to the woman behind the desk. We were then told to take a seat in a long intimidating hallway. 10:00am on the nose we were called... We followed the woman down the intimidating hallway into an "examiners" office.

    We were somewhat nervous due to some of the horror stories we read about this process. At the same time we had nothing to hide, which was reassuring. We sat down at a desk and opened up our large folder of evidence that took about a week to prepare.

    The woman asked when my wife's due date was... "6 weeks" my wife replied, and we all smiled.

    The woman went over the original forms we had sent in, section by section. All info was still accurate, then on to questions about our relationship. The woman asked:

    • Where and how did we meet?
    • Had we visited each other and who came to see whom?
    • Had we met each others parents?
    • Where was the wedding?
    • Who attended the wedding?
    • Where was the reception?
    • Do you have pictures?

    After viewing all the pictures the woman complimented us on the photographs and continued to mention that our application for Lawful Permanent Resident was granted. She mentioned the card would be in the mail in about 3 weeks, but could not stamp my wife's passport since it has expired last year.

    We checked the time as we exited the USCIS office and to our amazement it was only 10:20am. Overall this experience was not even a 1/4 of hell that we read about. The people at the Honolulu USCIS were pleasant to deal with. The quickness of the process is also amazing.

    well, i'm glad the the largest part of the process is over. I figured i'd share my experience.

    Received a "Request for Initial Evidence" Letter from the USCIS for my wife. The letter states they are requiring a I-693 and a I-693s (supplemental).

    We have an appointment with one of their Dr's this Saturday, but can anybody explain to me the difference between the two? Which does the Dr. fill out?

    BTW, had to laugh at the 87 day time limit... Who comes up with "87" days!? lol

  3. I-130 and I-485 can be filed concurrently, i.e. in the same envelope. If you look at my timeline signature, you'll see this is what I did. The only requirement is that the check for the I-130 have your name on it.

    You can fill out all these forms with your wife and send them to the Chicago lockbox. Concurrent filing of I-130 and I-485 will make you get your GC quicker than filing seperately I believe. From what I have seen some people have had their interviews before recieving approval for the I-130.

  4. If she is not Canadian you may well have issues.

    Of course you may have issues anyway.

    Sorry, i forgot to mention that she is canadian...

    After reading some of the materials i have here, it states that she can submitt the I-485 with a completed relative petition, which if apprevoed would make an immigrant visa number imediately available. This info was located under the who may file section.

    This now brings me to another question. Do i send the I-130 alone and send a copy with my wife's I-485? or do i send my original I-130 request with the I-485?

  5. Hello...

    Went to the honolulu USCIS to ask for some info on how to get my wife to stay here in the US. They handed us a package of many forms. These included the I-130, I-485, G-325A, I-765, and the affidavit of support.

    From what i understand from what this women told us, is that i have to send in I-130 along with myself and my wife's G-325A (Biographic). Then my wife will send in a copy of the I-130 I filled out with her I-485.

    Questions:

    Does my wife have to wait until my I-130 is approved to send in her I-485?

    Do my wife have to send the affidavit of support with her I-485?

    The women at the USCIS couldn't comprehend how my wife entered the states with just her drivers liscence and a birth certificate. weird...

  6. Looks like we better get moving then. She does have a passport, although its expired recently. We had no intentions of marrying when she came to the states. She also has full medical coverage as of yesterday through my plan.

    The tough part is, i don't think we have anything to prove she was intending to return. She came over on a one way ticket to Boston in March. I moved to Hawaii in April and she decided to come with me. We planned to just buy her a one-way ticket back when August/September came around.

    If she goes back for a month and comes back in the states, they probably won't allow the AOS on that trip. Is that correct?

  7. Hello all...

    I'm a US citizen residing in Hawaii. I was recently married (05/26/06) to a canadian resident. She is currently in the states. She arrived in the US with just her birth certificate. No visa was issued. Her 180 days are up Sept. 23, 2006.

    Are we eligable to apply for an AOS under the circumstances i've listed? I plan to go to the local USCIS to ask for assistance also.

    Does anybody have any info on the conversation i had below... just curious on other's thoughts. BTW, i get married on the 26th!!! w00t!!!

    I am from hawaii also and doing a K-1 with a vietnam lady However I had a friend in

    your same situation almost she came for a visit got pregnate so they marriaed and did a AOS she never had to go back but did have to wait in hawaii intell paperes all set took 6 months so I would do that if you both can marry right away and she doed not have to get back to canada for several months and it is perfectly legal

    I'm curious about your friends situation. My fiance' is here visiting. Unfortunatly she does not have a work or school visa. I think that reason won't let her simply adjust her status.

    Can you verify for me if your friends wife was visiting or here on a visa?

    Sorry I missed this YES SHE WAS HERE ON A Tourist VISA Do not let your fiencee go home you did not intend to marry this time and you have just changed your mind so POP the question again and get the documents taken care of at the court house you then co down to the immigration building on nimitz and file a AOS since you did not plan this it is perfectly legal

    I've run into another issue that i may need some guidence with. (or at least some opinions)

    Now after some of the comments in this thread, i thought we were going to get married and file for the K3. I recently checked the timelines though. Do to living in Hawaii, i have to go through the USCIS California Service Center.

    Processing times are as follows:

    I-129F -- Feb. 03,2006 (Processing Cases with receipt Notice Date)

    I-130 -- Oct. 17, 2006 or Jan. 01, 2005

    Can't make determination of I-130... between "US citezen filing for spouse, parent, or child under 21" or "US citezen filing for spouse or child under 21"

    iether way it seems that processing the K1 will be faster... Should i go K1 instead?

    The K-1 would go faster. However, if you want to get married within the next couple of weeks in Hawaii, then the K-3 could also be an option since you can start the process right away (file the I-130, then the I-129F). Since your fiancee isn't going back to Canada until July, she can just stay with you for almost 3 months. If you get your K-3 application in by June, you might get your K-3 approved by September. However, if you are not getting married right away, then K-1 would be best... this is just my opinion.

    We've actually had talks about getting married sooner than later. My parents are coming out to the island in the middle of may and it would be perfect timing. Thanks for the info, and pointing me in some kind of direction. Is there any more important info or tips using the K3 route you mention?

    Because she is Canadian, she can visit for 6 months at a time. If she wants to stay as a "tourist" while you apply for the K1, she can, returning to Canada only for the actual interview - as long as the process takes no longer than the 6 months she is there. If it takes longer than 6 months, she will have to return to Canada.

    understood. Thats actually why she has to go back to Canada by the end of July. :thumbs: Tough part is she's from the east coast of Canada, which ='s expensive plane tickets. :(

  12. If she's there on a student visa or work visa and you've met and just want to get married, you can go right ahead and get married, but then for the AOS you'll have to prove your marriage was a spur of the moment thing, and that she didn't travel to US just to marry you.

    If that's not your case, then you can either send her home and file for a K1, which takes around 6 months, or you can go and marry her in Canada, and apply for a K3. If you marry there you don't have to apply for either, just for AOS, but it's like I said above, will depend on how long she's been there and what's her situation.

    She is here on niether... She is just here visiting me. We actualy met here about a year ago.

    I'm currently living in Hawaii and am a US citizen. My fiance' is a Canadian citizen and is currently here in hawaii with me. She is visiting and has to return near the end of July 06. We plan to marry but are quite confused in the options we have. We are both worried about being apart, due to me not able to leave the island. (new job)

    Any opinions or possible time frames that are usually seen with this process. We are debating wether to go through the K1, or marry here in Hawaii and apply for the K3.

    I think I read here that some people applied for the K1 visa, and the foreign fiance just had to fly home for the interview..It seems to me like the best way not to be away for longer than necessary...

    If that is really the case that would be great. For some reason though, i don't think it will be that easy. I've been doing alot of reading on this site and it doesn't look like we'll be able to get around not being with each other for at least a few months.
