    I submitted a SR on Mar 3rd (for Outside Normal Processing Time).  I received a response letter on Mar 22nd stating "Your application is still pending considerations".  The letter was addressed from USCIS Chicago (101 West Congress Parkway, Chicago, IL)

     

    Today, I called customer service again.  A tier -2 customer service rep called me back telling us that our case had been transferred to Chicago local field office, despite the automated machine says our case still in Lee's Summit.   

     

    However the tier-2 rep couldn't give us more specifics such as when the case was transferred to our local office.  Besides patiently wait, I don't see what else I can do at this stage.  Frustrated.

    The way it's phrased suggests the service request did prompt the approval, so I would recommend trying a service request if your case has been pending more than 6 months! 

    Congrats & thanks for the info.  Just submitted a request for my wife and my step daughter respectively.  Hope to hear back from USCIS soon.

    We are in IL.  My wife just walked in to take the written test.  In order to prove that she is the resident in IL, She had to bring 2 documents (from either government, bank, or utility companies) sent to her with address in IL besides bringing her passport (official ID)

    For your second question about the local office, in my case, it required no interview and it looks like it's the NBC that sent my green card right away. The sender address on the envelope was Lee's Summit and not my local office in Milwaukee.

    How does one tell whether his/her case requires interview or not?  Anyone knows?

    Thanks for the information.  I just checked for my wife & my step-daughter.  According to the automated response, their cases are still being processed in NBC @ Lee's Summit, MO field office.

    Q1: How do I find the processing timeline?  USCIS NBC doesn't have processing dates for I-485.  Q2: Once NBC finishes my case, it will then transfer it to local office, right?  Thanks.

The Child Status Protection Act protects them from "aging out" as long as their AOS petition is accepted by USCIS before their 21st birthday. However, the CSPA only applies to K2's if the K1 marries the US citizen petitioner before the K2 turns 18. If the marriage occurs after the K2 is 18 then their AOS must be approved before the K2 turns 21. 

    This can be a big problem because a K2 is eligible to receive a visa right up until they are 21 years old, but if it's too close to their 21st birthday when they come to the US then they might not have time to finish AOS before aging out.

  8. The receipt date for my wife & my step-daughter is Aug 10th, 2016.  They had biometrics done on Aug 31st, 2016.  On Oct 11th, 2016, they both were approved for I-131, and subsequently received EAD/AP card on Oct 28th, 2016.  We haven't heard any status update for their AOS since then.

     

    The USCIS status check still shows:

    Fingerprint Fee Was Received

    On August 10, 2016, we accepted the fingerprint fee for your Form I-485, Application to Register Permanent Residence or to Adjust Status, Receipt Number MSC1691449xxx. Our National Benefits Center location is working on your case.

    It has been almost 7 months.   The critical question is:  My step-daughter aged out on Feb 10th, 2017 (her 21st birthday).  The time between AOS receipt date and her 21st birthday is exactly 6 months (that is plenty long, IMO).   What is the chance that her case could be denied due to her aged out?  What shall we do?  Please help.

  11. Should be any day now. I see it takes anywhere up to 2 weeks. You probably will get them by this weekend. I filed for my wife and step son too so best of luck.

    My checks never got cashed until day 19 of them recieving my documents... I signed up for text and email but I never recieved the notification... I was stressing out cause everyone around me had there cashed within days... the day my checks cashed was the day before I recieved my noa1 in the mail

    Don't worry, I sent mine on 19 July - Didn't get there until 28th July because of USPS delaying my package :(

    Got the texts early Tuesday morning followed by the emails and then the check was processed that day too! It's going to be any day now. It can take up to 3 weeks for them to send NOA1/cash the checks. So, try not to worry :)

    I finally got emails/texts from USCIS last night...in my case, it took almost 2 full weeks.

  12. I sent out I-485/I-765/I-131 for my wife and step daughter on 7/29/2016 via USPS priority mail to USCIS Chicago. Based on USPS tracking, it was delivered on 07/30/2016 (Saturday). I guess I probably belong to August filing group. :)

    I still have yet received any emails/text from USCIS, no hard copy of NOA either. And checks have not been cashed. Should I concerned? Please advise. Thanks.

    I checked my bank account this morning, and saw the checks were pending cashed...Hurray! But I still have got any email/text. But I am not worried.

    Welcome to the forum. :) it's actually really quiet here right now as there is NO much progress in out cases. But hopefully we'll have some good news soon. :)

    Nope. Definetly nothing to worry about right now. It takes a little time so we need extra patience. It could take up to 2 or 3 weeks before you can here from them, well at least as far as I've rear from other experiences. But hopefully we'll all have progress sooner than later. :)

    Got the texts and emails for AOS, EAD, AP this early morning at 2 AM! Such a weird hour for USCIS. Lol

    I did not expect to be notified until next week but Praise God.

    Also, the check was not cashed yet.

  14. Thanks...You are right. Per you suggestion, I went through I-864 Inst. and I-864P. For a household size of 3, 125% of HHS poverty guideline is $25,200. And I am an USC sponsoring my spouse. So the total value of assets must only be equal to at least 3 times of $25,200 (~= $75K) provided my current income is 0.

    Here are a few more questions:

    • What supporting evidence needs to be submitted to demonstrate my assets? Would 1) 12mo bank statements for my savings and checking accounts & 2)12mo statements for my investment/mutual fund accounts be sufficient?
    • Can I include my retirement account (currently invested in mutual funds) as part of my assets to supplement income shortage? Please confirm.
    • My wife has an apartment in China values about $380K (currently is on the market for sale). However, I don't know how to get any supporting evidence showing the apartment is worth $380K. Then, Is it a good idea for NOT including it in my I-864? I am afraid It might trigger RFE if I do. Besides, I myself alone already has enough assets to sponsor. Any opinions?

    Regarding Q1, Would you or anyone else mind shedding a light how $75K figure is obtained?

    And for Q2, various sources gave different answers...some, like you, said the number should be only sponsor's income alone, while others suggested that it should just copy off the number directly from joint return, which is the adjusted gross (combined) income.

    I am petitioning my wife and her daughter's AOS. (they came here with K-1 and K-2 visa respectively).

    I divorced with my EX last year. Shortly after I started my own business by registering a LLC. In 2015, I didn't make any business income. The only income from 2015 was Interests and dividends (~$7,300). Therefore, I didn't file 1040 (as not required). I filed 1040 with my EX as a joint return in both 2014 and 2013.

    This year (2016), the foreseeable income from interests and dividends should be about the same as last year. However, I don't have any business income yet.

    As such, I am trying to use my assets to supplement the income shortage.

    Currently, I have 1) $331K in savings and checking accounts and 2) $407K in mutual funds including $312K in my various retirement accounts (IRA, Roll-over IRA, and Roth IRA).

    My wife (the principle sponsored immigrant) owns an apartment in Hangzhou, China that is currently on the market for sale. The expected cash value should be around $380K. However, I don't know what evidence we have to support this.

    The household size for my case is 3 (me, my wife, and her daughter)

    Q:

    1) Do I need a joint sponsor? I can ask my sister (with a very high salary) as a joint sponsor. But she and her husband are quite sensitive/reluctant about disclosing their financial material, such as 1040, and etc. I will ask her be a joint sponsor if we don't have a choice.

    2) On I-864, I put down total income for 2015 ($7,300), 2014 ($xxx,xxx - adjusted gross income taken directly from the joint return by me & my ex), 2013 ($xxx,xxx - again, adjusted gross income taken directly from the joint return by me & my ex). Is this correct?

    3) On I-864, I checked myself as self-employed, and put down $7,300 as my current individual income. Is this correct?

    4) I will attach a statement explaining why I was not required to file 1040 in 2015. In that statement, I will also clarify that I filed 1040 in both 2014 and 2013. Should I also attach the IRS 1040 transcripts for 2014 and 2013? I have both 2014 and 2013 prepared.

    I am currently filling I-134 form: Affidavit of Support for my fiance(e) and her daughter. Line #9 asks: previously submitted affidavit(s)...and I am not sure what should I do with the following 3 cases

    1) I submitted an I-134 for a family friend over 25 years ago (I am sure he is a USC now. He is a Doctor who has been practicing Medicine here for many years in US). Do I need to list him?

    2) I submitted an I-864 for my Mom (in 1990) and my Dad (2000) for Green Cards. Both of them are now US citizens. Do I need to list them?

    When should I send the materials before the procedure teminates/expires as late as possible ?
    If I send them between Nov 17,2015 and Aug 18,2016, does the NOA2 expire? and I have to reapply for K1?
    I really dont want to go through this whole procedure AGAIN ,am quite afraid that it expires.

    I'm in need of some advice on the LASTEST DATE to SEND MATERIALS BACK to the CONSULATE.
    I am the benificiary of K1
    Received the NOA2 Jul 17 and it states: Approval notice valid from 7/17/2015 to 11/16/2015.
    Received the packet 3 on Aug 18 requesting my completing DS160,passport information page and 2 photos, and the notice says: Failure to take the requested action within one year will result in your application being terminated.
    In my understanding it seems that the expiration date for sending materials back to consulate is Aug 18,2016, am I right ??
    I plan to go to the US later 2016 or early 2017 and I have to stall the procedure.

    NOA2 validity date refers to when it is going to expire...however the embassy should be able extend this expiration date.
