  1. Thanks all for the replies. Does the notice for interview come via email through the USCIS? It seems like it is at least a month ahead of hte interview date which I could then just fly back home early for the interview. Or does it come only via letter with a notice online that says a letter was sent?

    Also, Yodrak, are you suggesting I change the address now before the trip via an AR-11 and then again when I come back in?

    Kezzie, how do I find out/call the local office that is holding my case? I live currently in Manhattan.

  2. here's my situation. I currently live in New York under an H1B and have filed for the AOS process. I recently got my AP travel documents and my EAD is allegedly on the way.

    On August 1st, my wife and I are going on an extended 2 month trip around the world as a honeymoon and celebration of the fact that we got the AP :) When we come back to the states we are landing in SFO and moving there to live.

    So the problem is that I need to change my address with the USCIS. I will not have a permanent address in San Fran until I get back from the trip which is in late september. What should I do in terms of changing the address with the USCIS?

    Should I just forward my mail from the USPS from my current address to a friend's house and only do the AR11 things when I get back and have a place?

    OR

    Do I change the address officially now with an AR11 to a friend's place in San Fran and then change it again when I arrive in town?

  3. Hey all, love this forum with all the useful information and such.

    I have a question. My wife and I got married last year and didn't have much time to take that long honeymoon we always planned because I was slammed at work and couldn't get it. My boss (for the firm that is sponsoring my H1B) made a deal with me and said I could take August & September off this year to make up for the lost time. It's a slow time at our financial firm that time of year anyway.

    My question is, is there a problem to travel for so long under and H1B? I am still fully employed by the company but didn't know if there would be problems being out of the country for so long. Also because I'm currrently filing at the same time for AOS.

    Anyone have any thoughts? Thanks!!!

  4. Hey all, love this forum, been mostly trolling (apologies) since I filed my AOS papers on May 8, 2006. Here's my situation and would love to get some help from you guys.

    I am currently in the US on an H1B work visa. I am married to beautiful US citizen (my college sweets). We filed for AOS at the beginning of May using a local attorney. At the same time we filed for an AP so that we can travel in August and September.

    I am leaving my current job at the beginning of August since we are both moving from NYC to San Francisco. That means that I lose my H1B sponsor as of August 2nd (although the visa does not technically expire until next year). The trip is kind of an important thing because my wife is taking the bar exam and this is the only time we'll get to travel for an extended period.

    My question is that I filed for the AP in May 8, 2006. Online, I've been touched a couple of times but the last time was June 3rd. Both online and on the phone state that the processing time for my type of case is 30-60 days. How accurate is that estimate?

    If the estimate is accurate then I likely won't have to worry as I'll get my AP before having to leave on a trip at the beginning of August.

  5. If you are already in the US then you can file for I-130 and AOS at the same time.... you can also file for AP (so you can travel) and EAD to work... but your H1B may already allow for work (I am not up on H1B visa).

    Read the Guides at the top about doing AOS from inside the US....

    Kezzie, thanks for the quick reply. My only question with the AOS is really related to the travel. What happens if I stop working and no longer have the H1B valid. Is it possible to get the travel document quickly or is it a 3-4 month process?

  6. Hey all, found this fantastic site while just searching around the Internet. Can't believe such a resource exists, this looks great. So here's my situation:

    I'm a Canadian citizen who go married to my college girl last summer (we'd been going out for 5 years). She's American and I'm currently in the US as an H1-B holder for work. I would like to start the process of getting permanent residency. I am waffling between hiring a lawyer to help me through the process or rough it myself. I thought I'd at least ask for some suggestions here first.

    1) I think my situation (i.e. H1-B currently living in the US to green card/permanent resident) requires me to follow the guide as outlined here: I-130 Guide

    Is that correct? Is there some other process I should be following?

    2) What is the timing expectations? How long should I think that the process in my situation should take?

    3) Can I travel while the process is in motion? I think if I file a I-131 I would be able to travel (we are thinking of travelling for 2 months in August and September if possible).

    4) I've heard about this InfoPass option which is to go to Dallas and get an interview through the online system. Has anyone had any experience with it, is it worth it? I'm willing to go to Dallas if need be and it expedites the process.

    Anywho, just wanted to throw out some questions first, any help would be greatly appreciated.
