Aaron, also, would you happen to know that if my brother is under the immigration process, can he still apply for non-immigrant visa and visit us during Chinese new year and then return back to China when his school starts? I remember I saw it somwhere that if he is under the process of immigranting to the US, he cannot apply for a non-immigrant visa to visit. is it true? I can't seem to find the same article online anymore. Thanks!

  2. Hi,

    After your mom immigrates and gets a green card, she can file for her son and also get a Re-Entry Permit. With the Re-Entry Permit, she can go back to China for up to 2 years. When her son gets his visa, they both can come to the U.S.

    What you are thinking is called immigratin fraud, will not work, and cause lots of legal problems for your brother. To be blunt, this is a stupid idea. First, your brother would need to be in legal status to qualify to adjust. With a visa overstay and no Immediate Relative (legal term), he can not adjust. He would be put into deportation proceedings. Second, an I-130 approval does not qualify him to adjust without a current PD. it's currently a 2 years wait in the F2a category.

    Follow my advice if your brother needs mom to watch him.

  3. This is David by the way. But Lian went ahead and filled out her ds-160 once we received our case number. We also made sure that the information matched what I submitted on the I-129F just to be extra safe. She also signed up for the visa application website where you pay your fees and schedule your interview. Here is the website if you don't already have it.

    You can get to it through the CEAC website. Lian received her first letter from the consulate yesterday. She was so excited!!!!! That was one week after we got our case number from the NVC. One more thing, I had a few questions for the Guangzhou consulate and I emailed them through their information page and they responded back to me in one business day. So that sounds like a good option if you need information. They seem to be nice and prompt. Here is that address. I found it on the Guangzhou website.

    My apologies on calling you Lian. I believe K-1 visa might be different from IR-5 but thank you very much for the thorough information. I will definitely take a look at it now and see if I can fill out the DS160 online.

  4. Hellp Everyone,

    I'm hoping to get some answers from someone who has been in the same shoe as I am now. I currently petitioned for my mom and I'm a US citizen.I was under the impression that once the petition is approved, my brother(under 21) and my dad can come with her under the same visa. However, i was informed by the NVC that her visa category does not allow her to bring relatives with her. Her case was just completed last week.

    I'm not too worried about my dad as I could apply for him and he will be here in no time. But I know if I apply for my brother, he has to wait for a very long time to get his priority date. I know the best way right now is for my mom to apply for him once she receives her green card. But I'm very worried about my brother being in China all by himself.(my dad does not live with us, long story) My brother is only 15. I was thinking if I could apply for him on a tourist visa and file for 485 to change his status once his 130 is approved. anyone has any suggestions?

    I just really want all of them to be here at the same time. :(

  5. paper or electronic, it's the same queue times currently. you'll gain 5 months of the wait time, cut it out, when the case is complete, as NVC will set the appointment (not Guangzhou IV, 4 months later)

    so - as long as you are submitting stuff under the new GZO #, don't sweat the time in the queue at all. Sure, it's a boondoggle, and a bad one, but it's not changing this season or next.

    submit something under GUZ #? resubmit it under GZO # quickly (submit = email the pdf file attachment)

    and get all the civil docs sent in if you missed something earlier, don't wait for anything about the IV/DS-260 ..

    Thank you so much for your reply. So you think that's the reason that my case is delayed. On the second submittal, I did change the case number to GZO instead GUZ. Should I keep calling them and checking if it will take less than 42 days for the supervisor review? Thanks!

  6. Hello everyone! I'm in the process of bringing my parents here since last year.

    I've submitted all of my civil and financial documents on May 6th and received a confirmation email from NVC on the 11th that it will take them at least 60 days from the date they received my documents to review and complete my case. BTW, I need to mention that I chose to do it electronically because I thought it would be a lot faster! But apparently, it's not the case. On the first email I sent, I guess my paychecks that I downloaded were password protected(I was able to open it but they said they couldn't). So they sent an email and asked me to send again without password encrypted. So I did on the same day they replied and that's when I received the confirmation email. So I thought every was good to go.

    I've waited for over 60 days now so I called NVC yesterday and at first the operator said that they sent me the email and asked for non password protected documents. And I told them that I replied the same date and even received the confirmation email from you that all the documents are received from you. so the operator checked again(which I was on hold while he checked for like 10 minutes) and he said that oh I see your case number was changed because you chose to file electronically so that's why it takes a little longer. We will review the documents and get it moving for you!

    OMG, they haven't even looked at my documents yet! So I called again later today becasue I really don't trust a word they say anymore. Another operator said that it's under supervisor review and it will take up to 42 days! Is it really 42 days? anyone on the same boat as I am that could help shed some lights on it? I am so sad and irritated. Thank you!
