  1. Yeah, I'm aware of all of this and know what paperwork needs to be filled out. I want legal assistance because I don't want to make any possible mistakes myself, and want someone who is experienced and can work quickly on filling out the paperwork and getting the waiver sent in. I know that a pregnancy isn't something the USCIS cares about, I actually don't believe they care at all, but I was just looking for lawyer suggestions.

    The denial is expected at the interview. You have to get the denial before you can file the waiver. They will tell you right then if you are eligible for the waiver and they give you the instructions. Did they give you the waiver instructions?

  2. My husbands visa was unfortunately denied yesterday due to his overstay.

    If anyone out there who has suggestions for a lawyer with REASONABLE prices

    and a sense of actual care for the situation they are dealing with, I would greatly appreciate it.

    There is no way we can qualify for a expedite from the USCIS, but with a baby on the way, I need someone who will do anything they can to get the paperwork moving for us.

    so here's a quick update, this is so exciting! This is so worth a try if you're all ready for the interview but have awhile to wait-

    we were originally scheduled an interview for February 25th, which is just too far away if you ask me- so yesterday after he finished his medical, my husband emailed the embassy in Bulgaria (using the wonderful outline posted by dwheels76 in the first post of this forum) and literally within a few minutes they replied back and rescheduled the interview for Feb 10th!!!!

  4. I finally have gotten a case complete!! I'm so relived. I'm so ready for my husbands interview. (Being 12 weeks pregnant can make you feel a little crazy!!!) so I know that interviews scheduled depends on the embassy, but my husband was explaining how they process certain work visas by the end of the month in February. Is anyone familiar with this? And is a CR1 visa a priority over a work visa? Does this affect the interview scheduling?

  5. I'm so annoyed with the NVC and how little information they seem to know about anything and how they aren't helpful at all. I called to see the status of my case and they gave me the typical bs answer of " oh well you have to give us a little more time it's taking about 30-45 days to review cases" and I asked if that's all he could tell me, like there is nothing else? He replied "it's under review". I seriously imagine them all sitting around on Facebook all day and eating popcorn.

    But both sent together in one envelope.

    I-864EZ
    Tax Trascripts (2014, 2013, 2012)
    W-2s (2014, 2013, 2012) ; (we filed 'married filing jointly' in 2014 and 2013, that's why included these)
    Employment Letter (although not required)
    Pay stubs for the last 6 months (again, not required but we included them)
    Copy of Marriage Certificate
    Copy of U.S. passport

    IV docs:
    Document Cover Sheet (from the Welcome Letter)
    IV Document Cover Sheet
    Written Cover Sheet
    Translation in English of the birth certificate and the birth certificate in Bulgarian (translated and legalized)
    Translation in English of the Court/Prison Records and the doc in Bulgarian (translated and legalized)
    A note that Police Records are not obtainable
    Copy of Marriage Certificate
    Two passport pics
    Copy of bio page of the passport
    Translation in English of 'Marrital Status' doc and the doc in Bulgarian (translated and legalized) - this is required by the U.S. Embassy in Bulgaria

  7. Okay, I've looked through a lot of the resources, and forums and there's just so much information that I'm a little overwhelmed and confused.

    I've paid the AOS & IV bill, they both show as paid

    Now that it's time for me to turn in the AOS and IV package, I'm confused about this process.

    Is it possible to send them both in at once?

    If so, how do I assemble this?

    Do I need two separate mailing packages or can they be in the same package?

    Any guidance through this would be greatly appreciated!

  8. He will have to do a waiver. The ban isn't at the adjudicator's discretion. He will go to his visa interview and get a paper denying him and saying he's able to file a I-601 waiver for a 10 year ban due to overstay of 6 years. Start preparing the waiver packet now. Its not just a form to fill out. You have to show 2 things:

    1) why you can't live in Bulgaria with him for 10 years

    2) why you can't live in the US, alone, without him for 10 years

    You can use economic, health, social, educational, and other hardships to show extreme hardship. Please do check out immigrate2us.net, where there are many approved waiver letters and examples of evidence to prove your case.

    He can submit the waiver to USCIS, to a lockbox in the US, right after he's denied. It takes about 6 months to adjudicate. You absolutely can visit. It could potentially strengthen your waiver if you're able to say you've spent time in Bulgaria and know for certain that you cannot live there.

    Once the waiver is approved, he will need a 2nd visa interview and medical exam. Once he is approved, then he can come back. Good luck!

  9. Yes there is a chance he won't be denied. Anything is possible. I don't understand why you guys got married and then he left the U.S. If he was still here it would make it easier on you. Maybe I missed something. Good luck.

    We didn't get married in the U.S., unlike others, we didn't marry in the US just to fix his status, we married overseas because we wanted to be married, and form a life together- not fix paperwork.

  10. I would truly appreciate any feedback that I could get about this

    I'm a US citizen and my husband is Bulgarian. He came to the states on a work visa, and overstayed by quite some time. He took a voluntary departure from the States last October. While here, he stayed out of trouble and paid his taxes every year.

    We got married in February, and our I-130 was approved this past week!

    I'm just worrying about the interview stage.... will we get all the way up to the interview and they deny him his visa? even though I'm a citizen, and we're married?

    I've heard this might be an issue, and a waiver will have to be filed. I hope this is not the case and I'm hoping that they will overlook his overstay; this time apart from each other is literally unbearable.

    is this possible? What could be possible outcomes?
