Hi,
I am at the beginning of my process, now planning to get married and do DCF in London.
I am Spanish/Argentinean, I have lived in London since 2010.
My partner is American by birth, and has lived in London since 2000.
We are a gay couple.
We met in July 2010.
In 2000 I moved to the US on a tourist visa, which I overstayed. And left the US in 2004 (didn't hand in the I94 at the airport which I think is irrelevant). Never went back to the states since then.
My partner was previously married, in the US, to a UK woman. They were married for over 15 years, she became a US citizen eventually.
They both moved later back to the UK, that is how he ended up being here.
A few questions:
Can my overstaying the visa cause problems when filling our case? As far as i am aware it shouldn't cause it has been more than 10 years since I left.
Does the fact that he was previously married to a foreign woman and now is marrying a foreign man could be seen as a problem?

I read the links you sent, but I am still not clear regarding THE I864 and requirements of residency.
He (USC) would be going back to the US with me, not before, so how can he fulfil the requirements for residency?

Hi,
Me and my partner live in the UK.
We want to move to the US (He is american).
I feel pretty lost. I know we would have to marry, either here or there. for either a marriage visa or a fiancé visa.
My question is:
Does he need to be in the US before me, for my visa to be approved?
I also have diabetes and I am quite worried that would be a problem for my medical to be approved. Does anybody know what happens intros cases?

Hi,
Can a newly arrived person to the US be a co sponsor for the AOS?
This person is a unconditional permanent resident, who arrived a few months ago, employed at the moment, but no tax return yet...Can a person without a tax return but employed sponsor someone?
