Actually a couple weeks into her stay here we will be getting married. We tried the K1 fiance visa route, didn't work out. So we're getting married and want to apply for DCF.

I've been a long member here, but yeah. Sad things but you can never give up.
Anyway, my fiancée will be coming here. I would like to know if DCF is available in New Delhi, India because the new delhi embassy gives very vague information about it and what are the requirements really. When they say residence, how long would be considered a long stay really? 6 months?

We were in contact with Ellis Island, an attorney over here. He told us to exhaust all options and then if that fails, for her to come down and get married.

You guys may or may not remember me. Been busy over these many months. Anyway, I'll get down right to it.
This is the issue. My fiancée, Amanda, has been in correspondence with the senator's aide and today she said she received some information saying that our case cannot be refuted. To give you some history, I had my interview on December 12th 2006. Everything was all right, except they said they needed more financial backup showing on the affidavit of support. I got that. I sent it in. The next time they tell me that they want to see copies of our engagement ceremonies, guests, bills etc. We didn't have that because we had it at our house. They wanted 20 guests. Why be so specific? I don't know. Anyway, after giving them as much info as I possibly could, they said they couldn't review my case any further and had sent it back to the California Service Center. This was in February. Now it's going into August and said that our case cannot be refuted and was recommended to refile.
I simply despise the people who reviewed our case. We have been cheated out of being together. I want to take this further, to the next level. How do I contact the senator himself? The senator's name is Kit Bond. I am so tired of going through all of this. I need to know how I can get my visa and be with my fiancée. What other options can I utilize since the senator's aide didn't do much.

As most of you guys know, I was not given a visa because of section 221 (g) for the reason that the consular officer did not believer our relationship was valid. I'm in the process of appealing it and the embassy in New Delhi said it has been sent back, I'll quote what they said: It was returned to the National Visa Center (NVC) on 6 March 2007. Now of course we have got in touch with a congress liason. Thing is, I want to track this down and make it come faster. Is there any way of tracking this down?
I was speaking to ellis island he said that the congress person is the best to do it. Well apparently the people there doesn't seem to know of a way to track it down? So is there a name for it? Called something specific? I want to know so that I can track it down fast and work on a rebuttal. Thanks for reading.

I am also going through the same process as you are, and I'm sorry to hear this. Our petition according to the embassy is being returned back and yes we are taking the advice of a lawyer if the congressperson cannot do it. One of the best options is act on it ASAP. Spam them with evidence.

Hmm.. Well then I gotta ask mandi if she still has that number, to see if we can track it down on the website. That will give us some kind of vague idea whether it's in the US or not.

Surprised to hear all of this. You know, this makes me thing, all this scrutiny and unfairness to us, how can we battle against this? How can we find the officers who are the culprit or put some kind of charge against them? Not saying all visa officers are bad, but man certainly in your and mine case it was. They have no idea how to tell apart a real relationship from a fake one.

I dont want to add more stress to your situation, but the very same thing happened to me and my fiance. He went thru Chennai embassy, and we started this journey nearly two years ago. Our case was sent back to the U S in October of 2006 and it has sat without any touches, or anything since then. Yes! Five months just sitting there after being returned. I know very well the bia's and prejudices that the indian embassies are filled with. We gave them four years of proof of our relationship. Stacks and Stacks, and Im convinced that it doesnt matter how much you give them, once they decide something in their head they dont care.
Sadly, My fiance and I split up in December, after over four years. It was a heartbreaking decision, but I couldnt see putting our lives on hold any longer. It seemed no one wanted to help us. My lawyer wouldnt answer my emails. My senator wouldnt answer my letters. It felt so hopeless ! So I let them win. Maybe I was weak, but I did it with the intention of giving my fiance freedom to move on with his life.
It has been really hard for me to deal with and every time I think of the Chennai embassy Im filled with such anger . I hope and pray that some day this immigration process is made much easier for those who are sincere while being able to still weed out the fraud...

Wow, I'm real sorry to hear that. I feel for ya. This is not my job to pry into things but I really think you guys should be together. Keep trying. What keeps my faith alive is the fact that I believe in Almighty God and I know for a fact that He can make this happen. You want to talk, you can message me. You can't just let love go that easily. I know this post is about me but you also have to think, you can't let a person you love go that easily. It will tear you apart left and right.
I am also filled with anger from these stupid embassies, because no matter what you do, they have it in their stupid heads that you are a fraud case. Man I really wanted to, I could really screw with them but I just don't want to. I don't want to jeopardize anything. I love her and I want to be with her.

Well from receiving advice from multiple and helpful vj people, it's a very good idea to get in touch with your SO's congressperson. You have to take it multiple before they actually drill some sense into their heads, that is the Visa Officers head

Probably submitting a marriage license would be a good idea, if you got married at a church they should have given that as well.

Any advice on the following for DELHI:
1. where and how to get the police certificates from the district station and passport office
2. what is the specific request that i should make to these departments to obtain the document
3. rough idea of what the documents will basically say?

1) From the district station, it would be your local 'thana' or county station. For the passport, by default they take 3 months to send it and YOU MUST be a resident of your place for at least a year otherwise they charge. For me though, I had contacts in the passport office so I didn't have a problem, got it in a few days.
2) Tell them you need a document stating that you have committed no crimes and are not in any way shape or form liable to India, or something like that.
3) Umm... I'd have to look, pm me if you want to know.
As for the OP, yes I went through Delhi. The experience itself was all ready. Waited for an hour then the interview came. Asked me really obvious and simple questions, probably 5. All he had asked to see was photographs of us. That's about it. I also got a 221(g) and now I'm fighting my case to appeal it, I'm not going to stand back and watch these illiterate dicks tell me that I cannot be with Mandi

Just wanted to update the folks here, I think it has been send back to the NVC and they will send it to the DHS office. Here is what they said in response to the email I sent them:
Dear Ryan:This is in response to your e-mail regarding your K-1 visa case number ***.
Your fiancé visa application is no longer in our office. Please note that fiancé petitions expire four months from the approval date. The consular officer has the discretion to re-validate fiancé petitions if they expire during processing. However, since the consular officer was not convinced of the relationship in this case, the petition was not revalidated. It was returned to the National Visa Center (NVC) on 6 March 2007. Once NVC receives the petition, it will return it to the approving DHS office. Please direct all future inquiries regarding this case to the approving DHS office that has jurisdiction over your petitioner’s place of residence.

So I guess if the congressman is going to do anything, it will now have to be at the NVC side of things huh. I just really feel like slapping them. They have no idea what they have put us through.

Well yes, I'm going to have her call again and probably call the other senator and see. I'm going to try to catch them in the embassy if at all possible.
I'm just praying to God now and hoping for the best. This is not in my hands but I wish it was.

I am also in the same boat as you guys. I got a 221(g) 3 times and this last time, they said they were sending it back to the NVC. According to the letter, there wasn't enough credible evidence to prove our relationship and I don't understand why. I guess this happens in the New Delhi embassy as well. 1. Where is your case? Are you sure it has been sent back to NVC?Well I just received the packet today stating they are going to send it back to the NVC. I'm not sure where it is but Mandi has contacted her congresswoman, Joanne emerson I think her name is. They sent her a privacy form to fill out and copies of info that we sent it and other stuff.
Our service center was nebraska but for some reason at the time they had sent it to california to be reviewed.

I'm the beneficiary but Mandi, the petitioner, has made only 1 visit here. Frankly speaking she didn't have a lot of funds at the time to make another visit. We documented our visit quite a lot.
I'll add some more info here once she finds out where our case is.
Also, confirm this to me but she spoke to a lawyer, and he gave some advice. One of the advice he gave is that he said if nothing works out in this case, then to go to India and stay for 3 months at least, because it's mandatory and it's guaranteed that I would get to go back with Mandi. Now I'm not sure how that exactly works, that might be DCF [Direct Consular Filing] but I'm not sure.

Oh and get this, not only did they want to get 20 engagement guests at least, they wanted their addresses, phone/fax, etc.
That sounds ridiculous to me. I'd be in trouble if they want that from me, my fiancé didn't want an engagement party or anything, we just agreed that it was time to get married and that's it!
Same here. I didn't have that either. Mandi and I just wanted a small family gathering to save on money anyway. I sent them a letter stating why I didn't have that, I guess they did not take that into consideration.

MENA forums? Where's that. If that's in these forums I'll search for them. If all else fails yes I think mandi will have to come to India and we get married though that's not how we want it. I'll try to contact the members you guys mentioned.

Well I did some searching and Mandi is in the 8th congressional district of missouri in Stoddard County. I think I'll have to find another senator, unless really senators can do it.

Technically you're right. It doesn't mention anything about that, the stay of how long the person intends to stay. We will have to see how best to go about this actually.
