  1. It looks like Vermont is actually preparing to send out RFEs and California is just now opening mail that was transferred from Nebraska on June 1.

    It definatly looks that way, I agree.

    Has anyone who either originally filed, or was transfered to CSC gotten a case update acknowledging that an RFE will be sent to them? It seems it is only Vermont who has taken this step.

    Since Vermont has all the recalled cases it makes even more sense to me that they should start sending the RFEs to these cases at least at the same time as the pending ones...

    Just trying to get a sense of how far behind CSC will be with all of this, compared to Vermont, and in that wondering if anyone who filed at CSC got a case update about that today.

  3. That statement is a bit strong.

    Not at all.

    I am a EE that these days mostly writes software for industrial controllers (PLC's) and PC based GUI front ends (mostly visual basic) for robotic applications. About 99% of my business is for the automotive industry. I work with difficult customers under ridiculous deadlines and I always get the job done. If I and others in my field performed like the government, you all would be driving model "A" type cars that were falling apart, if they ran at all.

    If someone in my line of work is incompetent or can't keep up with the fast pace, he is gone in the blink of an eye. The problem with government is that the normal selection process that weeds out the incompetent does not exist.

    Do you think the people responsible for this monumental screw up that has held up 10,000 visa applications are going to pay any kind of price? I think not.

    Funny you say that, my fiance keeps asking me the same question you just asked (he is one frustrated Englishman these days) and I can't come up with an answer! We are both currently in the restaurant industry, he's a chef and I'm in management, and I think back on my days of waiting tables in a restaurant. If I kept people waiting this long, responded so inadequately to their requests/questions, and was even slightly rude in the process, I would get written up, and tipped like ####; and this is just FOOD we are talking about!!! The difference between your job now/my experience waiting tables, and the people who work for the USCIS is this... their incomes are not at stake if their job performance is evaluated as mediorce by their clients/customers/us.

    I am sure it is the same with the USCIS as with an corporate environment. You have 7 different bosses, and 7 different levels of expectations (seen the movie Office Space?! :) ). If you happen to work to only the standard that is required of you, you will always squeak by, with no criticism.

    Of course I have no idea how USCIS works, and everytime I try to guess how this whole K-1 process will go, I am always wrong!

  4. I used to feel the same way, about being touched, that it would be wonderful and all, but it's really not! I have had 4 touches this past month, due to being transfered from NSC to CSC, and it doesn't make me feel like I am getting anywhere because I know I am waiting for this RFE!!

    I can completely relate to your feeling, because I feel like that too. I wonder why this has to be so hard, and it seems everytime I get excited about something (which doesn't take much, with all the IMBRA speculation, transfers, etc.) it all ends in more waiting. My fiance has gotten to the point where he is so frustrated that he doesn't want to hear it anymore, he just wants to know when the petition is approved! I can't really blame him.

  5. I am going to hope that this means that the RFEs can be expected before the new form is approved later this month. That is what the wording implies to me.

    That's the impression I had too... that we won't have to fill out the revised I-129f, only respond to this RFE. Do you think we will be able to see online when the RFE template is approved by OMB?

    Maybe this will all be cleared up by the end of June. Here's hoping!

  6. I spoke on the telephone with a woman who is a caseworker for my House Rep. in Michigan. I had emailed my Rep. about IMBRA, and the status of K-1 petitions filed after March 6th. I got a letter from this caseworker asking me to call her, and she would tell me what she knew. So... this is what she said.

    -She reiterated the new IMBRA law, and what it's purpose was.

    -She attended an immigration forum held by DHS and the State Dept. last week, in which congressional members and the like could ask questions. The topic of IMBRA and how to implement it came up, and said many congress members had concerns about it; apparently they have has a lot of constituents write or contact them in regards to this law.

    -DHS said they are in the process of creating a form (didn't say what form, new I-129F or a completely different one) that would be sent to petitioners who filed after March 1st, 2006 (the date she said was the cut-off). They asked about a timetable of when to expect this form to be created and sent to petitioners, and they wouldn't say.

    -She said I knew about as much about this whole thing as anyone does. Apparently I am one of three people in my congressional district that have files with my Rep.'s office in regards to this exact issue.

    -She would keep me posted about anything new, and that I could call her anytime if I had other questions.

    I gave her all of my information, case number, etc. but stressed that i was not concerned about my status, as my petition is still within the processing dates. I told her I just wanted to know what was going on!

    So, nothing new really. Just thought I would share this with you all.

  7. In their FAQs which I just read, they stated registration is not mandatory. Plus, I put in our receipt number and it gave us a status.

    You should register anyway. If you just put your case number in everytime you check, you can be blocked if you do it too often in a short period of time. This happened to me, I went through an obsessive, check-all-the-time phase! If you register and create an account, all you have to do it type in your user ID and password, and you can check all the time, without risk of being blocked for too frequent checks. Plus, they will send you email notification if anything changes with your petition.

  8. No waiver needed for a "denied entry", on 1 of the later forms he will be asked if ever deported or denied entry, he must be honest, but a few on VJ from the UK have been "Denied" entry & got Visa's NO PROBLEM :thumbs:

    Thanks for the advice! I figured they would ask him, and you are right, there is no point in lying about it, especially since he has forms from the incident, so I know it is well documented. The forms say exactly what questions were asked, and all of the responses he gave, and the final result of the "interrogation", which of course was a deferment (Deferred, banned, deported, rejected, etc... hard to keep up with all of the jargon used to imply different levels of rejection into the country! Though they all have very different meanings). It's even stamped on his passport, so I doubt he could lie, even if he wanted to.

  9. Ha, I just got 5, yes, 5 identical emails from USCIS saying the same thing your did! (Obviously mine was originated at NVC also).

    So, I wonder where our petitions fall in line with those that are already at CSC.

    The kicker? (I think this is funny, in light of the processing time discussion)

    Yeah, ok, they said 90 days on mine... you only have 6 days left CSC!! Such BS.

    I heard they were consolidating some of the visa's but they just sent mine to the SLOWEST service center of them all!!!!OMG!!!

  11. Oh yeah, I definatly agree. Their dates really don't seem to mean much. It seems that it's all about accountability, not wanting to give an estimate that something will be done by a certain time, then when it isn't, having to deal with a boatload of complains from people wondering why their petitions haven't been approved. I just interpreted that the change in how they advise people to estimate the wait for an approval was done for that reason. Maybe the 110 day figure is not so accurate anymore. I'll believe their estimates, and online status ####### when I have the NOA2 in my hand!!

    I sure do hope that USCIS has finally done away with the useless time estimates. The advice to use the processing dates to estimate case completion is a step in the right direction, unfortunately it omits the crirical element of how to use the processing dates. Too many people read the words 'we have begun processing' and their mind jumps ahead to 'we have completed processing'.

    I checked my status online on the USCIS website. It is now saying

    I am sorry if this question has already been answered. I have been staring at a computer screen for a long time, and just can't seem to find the answer to my question, even if it's obvious!!

    My fiance and I are waiting for our NOA2.

    He was denied at POE on Feb. 7th, 2006, about a month before we filed the I-129. (He is from England.)

    He was NOT deported, removed, or banned, just just denied; in fact they called it "deferred" (that is what his forms from the incident say). They even let him stay the night with me, but I had to have him back to the airport the next day.

    They told him that he couldn't enter the US again without a valid visa. No more VWP.

    Does he need a I-212? My inclination is to say no, but I am not sure. I have not seen anything on VJ that would acknowledge that he would, but I am just curious. probably a bit too late in the process to be quantifying this, but there ya go.

    Any knowledge anyone has with this would be great, and I again apologize if this has been answered, I really did make an honest attempt to find this information out, but have been having a hard time. Even if it's just a link to a previous post/reply, I certainly understand.

  14. My NOA1 is March 13th. I know exactly what you mean though, I keep thinking, "What if my fiance would have just sent me his paperwork ONE WEEK SOONER?!?!"

    Too late for that though. Good luck to the the rest of you that came oh so close!!

    My receipt date on my NOA1 is March 14th........crikey thats tough.

    I can only imagine how it must feel for people with a receipt date of march 7th or 8th or something!!

    Im trying to remember what i was doing for the week BEFORE I sent in my petition.

    I made an appointment for Feb 21st with an International Institute in Lawrence Massachusetts which helped me get some of the paperwork together and provided me with the G325. At the time the Institute was my only help, it would still be weeks before Id find VJ. Hmmm, There were a few delays with some of the paperwork like birth certificate and passport. Also I was waiting for quite a while for snail mail to arrive with my fiances papers and things. Certainly none of it is her fault, she did a really good job in collecting all of her information. I was really proud of her in how she packaged everything up and wrote me a few letters and.......I love her very much. Man....actually I think I may have actually sent out my petition ON March 6th...I still may have the receipt from the post office, Ill try to find it...cant wait to see my sweetheart.... :hehe:

  15. My sweetie has spoiled me, I know that. I speak to him every night for one year. And the last 2 months we spoke 3 times a day, morning, afternoon and evening. Last Friday he went to Mykonos to work during the summer. The last time I spoke to him was Weds. night. I tried calling him this afternoon and after he said "Hello" the line died and then the call went to voice mail. I know that his phone doesn't work that great when he is on the island. But I am freaking out because two nights have come and gone and I haven't spoken to him. I know this is crazy but just the fact that he is in Mykonos which is a big party island with women laying around topless, and he goes out for drinks after work FREAKS ME OUT!!! I tell myself everyday, "he loves me, he is coming here to be with me, we are getting married" but we are entering our 5 month apart and I am going through a mental melt down. HELP!!!!!!!!!!!! ADVICE PLEASE ON HOW TO COPE WITH THIS!!!!!

    I totally understand how you feel! It is hard not being with your fiance, especially when they are so far away.

    You have two choices... you either trust him, or you don't. Plain and simple, nothing in between.

    The fact that you two are going through all of this says a lot. it is a very discouraging process, and I don't know how anyone who doesn't truly love each other would make it out alive!

    You must decide to trust him, or not trust him. When you are in limbo of this, all you will do is drive yourself crazy. You will never really know what he is up to, as he won't with you. It's just impossible, and trying to speculate is not going to do you any good... or give you any concrete answers or justification of your paranoia.

    I am sure he will call you, and everything will be ok. My best advice is to focus on YOU, and your immediate life, NOW. Don't worry about things you can't control. Only live your life the happiest you can, even while you wait for your loved one to be with you.

    Also, you are totally normal for feeling this way! I think we all go through it in some way, shape or form.

  16. This is what I just sent to Department of Homeland Security

    Recently I filed a K-1 visa petition. Recently I have been reading where the I-129F application did not meet the requirements for the recently passed law International Marriage Brokers Regulation Act which requires that questions be asked as to the petitioner's criminal background as to things like domestic violence. I want to know since I filed my petition before the I-129F application required any questions as to the petitioner's criminal background can I expect additional papers in the mail to fill out and how many days, weeks, or months will this add to the process?

    Fantastic idea! I just now followed your link, and sent a message to them. I basically said the same things you did, and asked the same questions ("My petition was received March 13th, when will I get this new form, who long will it take, any answers you can give me would be greatly appreciated, etc.).

    If I hear anything back I will let you know, and please do the same!

  17. It sounds like him visiting for the summer is definatly a viable option.

    I went through the same thing, except my fiance from England got put back on the plane :(

    So let me tell you what happened to us, and hopefully you can get some sort of advice out of it!

    He stayed with me for 90 days in the US. He doesn't have a job, but had the funds to cover his trip.

    He left without violating the VWP.

    He tried to enter again a month later, with the intent of staying with me for another month.

    The problem was, neither of us really had a good idea of what the procedures were for the whole thing, and he failed to provide documents to support his binding ties to England, and his financial situation. He was questioned for 4 hours about his visit. They even came into the lobby at international arrivals and asked me questions too.

    I guess our answers to their questions weren't enough to overcome the assumption that he was trying to immigrate. They let him stay the night with me (this was on the good grace of the officers that questioned him) and I had to have him back to the airport the next day). They told him he wasn't allowed to enter the U.S. unless he had a visa.

    So, here we are, waiting for our NOA2 (NOA1 date is March 13th. That's another rant!) Funny, once you make it through such a devestating thing as being turned away at the border, you realize how strong your love really is. This made us decide to speed up the marriage plans.

    My advice, congruent with what everyone else has said, is to be totally honest about his intentions while being here. He must show binding ties to England, and an intend to return home. Use all of your resources.

    Your situation sounds totally legit, and if you a prepared for any questions they may ask, I think you will be ok.

    It's not like they didn't know this was coming but they still couldn't get it together enough to send the questionnaire? They couldn't be smart enough to send an email with this information directly to each petitioner who set up an online account and provided an email address?

    No wonder there is no email address to contact the service center - we would bombard them with hate mail.

    I would like to find out who I can send this "hate mail" to. Cause I sure have a few words to say about the incompetence :bonk: of our immigration system, especially if the law was signed a YEAR EARLIER!!!!! :ranting:

    I just e-mailed my senator from Michigan. I just needed someone to complain to! I told her all about how peoples petitions are being recalled, and interviews being cancelled, petition approvals being delayed, and how badly we want some answers, and accountability from our government agencies. Who knows if it will help, but at least it's a voice heard (maybe!).

    I think we should get the address at the white house and email BUSH in big black bold letters: "We knew you weren't the smartest of them all.....but really did you bother to read this law or at least inform your subordinates on how to properly implement it damn it!!" :protest:

    Oh yes, I agree! There is incompetence on all levels of government... including the level that deals with extra-terrestrial/english translation with our president.

    Piggybacking at it's worst... and don't you feel so helpless at times to do anything about it all?

    I am almost beyond hope at this point. It just seems that right when I get excited about something (so close to getting our NOA2), there is another roadblock (we tried the H1-B route before... even more painful, impossible, frustrating, and time-consuming).

    I would love to walk into someone's office at the USCIS, and simply waste THEIR time, as they do to all of us.

    Do you guys think the petitioners will receive only these documents to provide their criminal records or a whole new I129F will be needed later on?

    Ha, I hadn't even thought of that. Best-case senario, we will recieve an updated I-129 to fill out. I couldn't imagine sending the whole damn thing again! All those photocopies!!!

    What I am concerned with is the timliness of this new, updated I-129... they still have to create it, then send it out to everyone (this should have been done months ago), apparently. Not to mention process it when they do get it, then finally issue an approval. Who knows? Time will tell I suppose.

  20. Ah!! It's just one thing after another, isn't it??

    I feel awful for those that have interviews and had their petitions recalled... or even people who had the joy of getting the NOA2, then being disappointed by yet another roadblock.

    I am curious how this will affect all of us who have NOA1 between March 6 (My NOA1 is dated March 13th, from NSC).

    If they knew this was coming, how hard would it have been to generate a new form that people who filed after March 6th would fill out??? Sounds like a pretty basic task to me!!

    This is just horrible, and so frustrating!!! I wonder if there is a way to get some more answers... (though I won't hold my breath!)
