My wife was turned around from comming to visit me.She is Canadian and we had just got the packet from Montreal.She wanted to just fly to Cali to see me for a week.She went through hell at the POE and was told b/c we had applied for a k1 pettion she had to wait for it to be approved b4 she could come back to the USA.She had only visited me 2 times b4 and we had not started the K1 then.I mostly visted her.But I guess we were one of the unlucky ones.Its all up to the POE officer,if he/she dosent want to let you in they done have to.

    Just remember not everone is as lucky as the people above.

Yes you can have a friend as a co-sponsor.He/she will sponsor your fiance,not you.You will be the Sponsor and your friend will be the co-sponsor.Just remember your friend will also be responsible for your fiance for the next 10 years aswell.The INS wants to make sure they will not become a public charge,welfare etc.I had to use my sister as a co-sponsor since I had been living with my wife(then fiance) in Canada.We had no problems and by the time we went for our AOS we met the poverty line.

    Can you keep your questions to one post? You were already told in the other post you made that your 2005 requirements were fine for sponsorship.

    No need to be rude!The perosn only wants to make sure they do everting correct so they dont have to file again.Jeez you must be having a bad day!

  3. Just to add.. odds are they are not even going to ask you that at your interview. It's basically "How did you and your fiance meet? Have you ever committed a crime? Have you ever crossed over to the USA illegally?" and you give her your letter of intent and affidavit etc.

    Thanks Stina, I read all the documents and instructions very carefully and havne't seen anything that about not being allowed to visit while waiting.

    Anyone knows if there is such an instruction anywhere in the filing documentation?

    I havent seen one... its more a reccomendation than a rule.

    Speaking from experiance there is a good chance it wil come up at interivew.My wife(canadian) was turned around at Buffalo POE after her k1 was at montreal.They knew it was there and knew she was comming to see me.When she went to her interview they knew every time she had crossed and asked her about it.She was told you cant visit while a K1 pettion is in the works.Im just going by our experiance.Its not worth taking the chane IMO.

    And not the INS does not consider your fiance your friend.To them thats a lie.

I will be honest with you.My wife is also Canadian and tried to cross into Buffalo NY to catch a flight to come see me.At the time she was my fiance and we had already sent off for her K1 etc.The pettion was already in Montreal.She was stopped at the POE and had one hell(she was held for over 3 hours) of a time.She was turned around and sent back.She was also told that because we had applied for a K1 visa that she could not visit the US untill it was approved.He told her he could of gave her a 5 year ban.That really scared the hell out of us.When she went for her inerview in Montreal the officer new everthing and asked her about it.Once you are waiting for a K1 they think you are trying to move here and just marry.Im not telling you this to scare you or upset you.But if I was you I would 100% not try and come to the USA.From my understanding you are not suppose to visit while waiting for a K1.I know others will tell you different,but im telling you from experiance.Yes I would say you were flagged if they asked for all your information.They will see your K1 pettion in there computers.

  5. As long as your an honest person and have everthing in order,I cant see you not getting the visa.

    Remember just be honest.When we went for my wifes visa,this older lady was sittitng and talking to us.She told me they had lied and got caugt at the POE.She was worried it would stop her.Well after she came out from her interview she looked our way with tears in her eyes and walked out.My wife and I felt so bad for her.When my wife went for hers she was honest about her POE turn around and got her visa.Good luck you will be fine.

  6. Hi all. I arrived in the USA March 2006 on a k1 visa (originating country = canada). At the border they took my paperwork, and stapled a piece of paper into my passport.

    I haven't yet applied for EAD, Early Parole, SSN, ....or anything. We got married April 1st.

    Earlier this week I received a Welcome Notice in the mail from the Texas Service Center (Immigration & Naturalization Service Center).

    Then ... today I received a Permanent Resident Card in the mail that expires in 2016. Am I missing something, or is this right?

    My questions is how did they send you a 10 yr green card if you have never even sent in the passport style photos?Is there a picture on the card?If so where did that picture come from?

  7. Well... 7 months now an not a peep about my AOS application... yet I still come here and read about all sorts of people who've gotten their green cards already but filed after me - it's torture, but I can't stop myself :P

    Anyways, I know I have a whole boat-load of waiting still ahead of me...

    anyone else in the same situation - I know there's got to be tons of us!

    WE filed our AOS in July 2004 with the Atlanta office and received a transfer to CSC Sept. 2005 and we are still waiting????? Remember that if you do not receive an interview until after you have been married two years you should receive a permanent card and not the conditional card. We hope that our wait is for two more months then we will qualify for the permanent card. Sometimes a delay can be good!! Pray for all!

    Yeah we were also hoping for the same thing.Then we had out interivew like 2 months before it would had been two years.Then we could of just been done with the INS for 10 years or untill my wife went for US citzenship.OH well we just got her conditions lifted now..

When we filled to get the conditions removed for my wife last year,we got a letter back months later saying we were approved.Then we had to take passport style photos to our local INS office and finish more paper work.Then the officer told us 3-6months wait b4 the greencard would arrive.We asked about the AP and was told that she was now a US resident and she could no longer get an AP.But if the green cards had not arrived 30 days B4 we leave to visit her family in Canada that they would stamp her passport.From this point your not even approved for LPR.Im sure you will be,but you have to wait for them to let you know.If I were you I would not leave the country without some kinda of travel document.

Dont forget if you bring her here on a k1 you are responsible for her for 10 yeras.So if it dosent work out and she dosent move back to her home country,you will still have to support her.I was with my fiance for over 2 years before we applied for the K1.But We spent alot more time togother than you and your fiance.Months at a time!We both knew we loved one another and wanted to spend the rest of out life togother.You say you make enough that you can support her?Then why dont you staart by having her visit you for a few months(like we did)and get to know oyur family etc?That would give her a chance to brush up on her english and see what she thinks of this great country.There are alot of programs she can get for the computer that would help her with her english for starters.Id pass on trying for a work visa,cause she would never get it.As for the K1 if she doesnt get her EAD at the POE,it may take months to get it.So you would already be married and she still would not beable to work.

    Yes he will have to wait untill 3 years after his AOS interview.My wife is Canadian(also came in on k1) and we had to wait almost 3 years just for the AOS interview.She has been in the USA for 5 1/2 years and now she can file for her citzenship.I do know some staes (we are in Calif,she is from Ontario)are faster with the AOS stuff.We have been looking into her getting her citzenshisp stuff done and looks like it can take between 180-800 plus days before the interview.Then you have to take the Oath and that could be anywhere from the same day to 6 plus months down the road.So from start to finsh we are looking at 5 plus years b4 she can become a citzen.All cases are different, im just giving you our timeline since you were wondering about Canadians.But once he does become a US citzen then he can travel and work,to and from with no problems.You on the other hand would have to look into Canadian(look here http://www.cic.gc.ca/) immagration.On the other hand you would not be allowed to have dual citzenship since your the American citzen.American Born are not allowed to carry both.Unless you have kids etc.My American born daughter carries both and my Canadian born step daughter will beable to carry both in the near future.If I were you guys I would not move back to Canada untill he is a US citzen.Like the other poster said he would have to apply again if you wanted to move back.Once he IS a LPR he can only live outside the USA for either 6 months or a year?I cant remember.If over those times he will loose his green card.

My wife first got her CPR card in 2003.We filled towards the end of 2005 to get the conditions lifted and she was approved.We are not just waiting for the card to get here.The INS officer told her she was not sure which date they will use the 2003 or 2005?If they use the 2005 date then she has to wait untill 2008 to take her citzenship test.Anyone know if its 3 years from the CPR or LPR?She came here in 2001 on a K1 visa and it took two years before we had AOS.

My wife and I are due to travel in June to visit her family in Canada.She had her Conditions removed and we are waiting for her 10 r greencard.They say 3-6 months wait.My question is this.Her Canadian passport has expired.She dosent want to send her old one in to file for a new one,cause all her INS stuff is in there K1 visa etc..She is afraid of it getting lost.She would rather renew it once we are in Canada.Can she get back into the states at a land crossing without her greencard,but with her new passport?The INS office told us they would stamp a travel document in her passpoert once she got it.Can they see in the computer that she is a LPR?Or would she need to show the card or travel document in the passport?If so then we need to get her passport ASAP since we have no clue when greencard will get here.

    I think it would be best to mail in her passport now, get the new one and then make an InfoPass appointment and get it re-stamped. In Canada when you re-do your passport from the US anyways, they return your old passport (with little holes in it) along with your new one, so you won't loose anything. If not, then does your wife still have her old GC? Or did she send that in to the removal of conditions under the new rules? If she has it, then no problem, if not, then it all depends on the custom guards I think.

    Nowdays with all the rules and everything it's better to be safe then sorry. Last time I went back to Canada, on my way back with a valid stamped passport and my GC they still were questioning me big time. Without the passport, I'm sure they would have delayed me. If they have to look you up in the computer, then remember you will be pulled into the office most likely and then you will be on their time. They don't care how long they make you wait either. If you're flying you could miss your plane possibly, if driving, then you might just have to sit and wait for them to get around to checking on her status. They don't like to work more then they already do...

    To enter the US she MUST have evidence of her PR status. As a matter of fact, you have to have evidence of your PR status on your person at all times. If that evidence is in the form of a passport stamp, then she will have to have her passport. If you don't have it, they will be really pissed off. They could even deny you entry if they wished until you have it.

    I would get your passport renewed by sending it in to Passport Canada before you leave... if you're worried about it getting lost, then send it to them by courier. They are pretty quick and are really no slower than if you submitted it in person to a passport office.
