  1. Did you fill out the 864 correctly? If you didnt you could have the wrong household size which would mean they are looking at a different income level requirement which you may not meet. Many people fill the form out wrong and get an RFE saying they dont have enough income in that case. And the RFE doesnt state what household size you claimed or what income level they are using- so you have to figure it out on your own.... Have you sponsored before?

    I have not sponsored before. It did state on the RFE that based on documents submitted with form I-864 that the income did not meet 125% of the poverty guidelines for our household size. But I only claimed my husband and I, the way as directed so I am not sure what They could be looking at??

    My RFE for income did state that I needed to complete a new page 4 for household size and then submit income documents.

    I think that if it was a question of household size that would have been mentioned in the RFE like it was in mine.

    It did list that on the second page :-/

  2. They scrutinize self employed petitioners more than those with an employer and that is why I needed more proof such as

    proving how long I have had my business (20 yrs) and what I base my future income on. I send bank statements, transcripts,

    bank letter, professional state license, business card, projected income business ledger etc, but this does not pertain to you

    since you are employed.

    That makes sense. I have paycheck stubs, w2's and a letter of employment. So I am thinking I should be good!

  3. I don't see bank statements listed in your post but either way is ok whatever is easiest for you.

    I am self employed so we also included a bank letter showing the account, opened since (date) and the total amount of the past

    12 months deposited. I really think the pay stubs are the missing link in your situation.

    It was on there, I just didnt type it out. But thank you! I see on your timeline that you listed you submitted a great deal of financial evidence, what did you submit and they accepted it all as sufficient?

    But thank you! I am having my employer prepare paycheck stubs now.

  4. They listed other incomes as options, you can't send all because you do not have other income so proof to them

    the income that you do have with the missing pay stubs, a new employment letter and the official IRS tax transcript

    which has all schedules attached.

    Have your employer include every item mentioned.

    I just got an RFE and I sent every item they mentioned. I did not want to take any chances. So, if you have something they listed, send it. If not, you can only send what you have available.

    The RFE's are so stressful! Hopefully yours gets sorted out smoothly! And thank you so much for your help.

    For the Bank statements: Should I just print out my statements or go into the bank and have them pull everything together??

  5. You should send W2s and paystubs for 6 months along with your tax transcript again.

    Does your employment letter list all the things pointed out, dates of employment, hours per week, salary, etc.?

    My letter of employment did, I'll get them to create another one just in case. How do you know which point to pull from on the letters for what they're wanting or is it better to attach everything that is outlined to be on the safe side??

    Sounds like the paystubs are what is missing. Was the letter from your employer detailed enough?

    I can get that together again, but how do I know what they are wanting since they gave several different options?

  6. Good Morning! Yesterday, I received a letter that the request for initial evidence is required for my haitian husbands AOS. Stating : "The petitioner/ sponser lists their current income on Form I-864 as an amount to be sufficient, however, no evidence has been submitted as proof of current income. Submit evidence of the petitioner/ sponsor's current income. Such evidence should include:

    *Pay stubs or other documentation of pay for the last 6 moths

    *Evidence of other income, such as tax-exempt interest, qualified dividends, IRA distributions, pension Annuities and social security benefits.) None of which I have.

    Letter of employment

    *Dates of emploment

    Number of hours worked per week

    *Nature of Job

    *Yearly salary earned

    *Prospects for future employment and advancement

    Submit all Supporting Tax documentation ( W-2's, 1099's, Form 2555 and all supporting tax schedules) Submitted to the IRS for the most recent tax year.

    The petitioner/ Sponser must submit all supporting documentation for the most recent tax year.

    And then it moves on to the second page, stating if we choose a sponsor, what is required.

    But I am at a loss of what they are needed as I make well over the 125% requirement for income. I submitted the last 3 year of tax transcripts although they only asked for 1. I sent in letters from my employer, basically everything off the checklist. So what would be the best possible idea to send, evidence wise to keep the process moving? Do I have to submit everything that they outlined on the form?

    Any help and advice is greatly appreciated. Thank you!!

  7. There is no deadline to file, so nothing to look out for. It is possible they may ask you at some point to provide a new medical from a civil surgeon.

    The K-1 visa became null and void the moment it was used to enter the US. It does not expire upon marriage. When you enter, you are granted a stay of 90 days. Your I-94 shows the date for the duration of your stay. It does not matter that the I-94 is expired. Your eligibility to file for AOS is still based on the K-1 entry and marriage within 90 days. You still put K-1 visa holder for your status on the forms.

    I think you can still type in "K-1 Visa Holder" in the status field.

    Just be ready to answer why it took you so long to get the paperwork submitted IF THEY ASK. Usually they don't ask this unless it has been YEARS since he first entered the country.

    Thank you both so much! Those help alot. In regards to the civil surgeon and shots- do we have to do that before or after we submit the petition? I hear they give recommendations but ive never heard anything stright forward in regards to having that with the paperwork as you submit it.

    It has been awhile since I have been on these forums. In the summer of 2015 I was petitioning for my then Fiance to come to the US on a K1 visa. He arrived IN September and we were married by November, Due to unforseen circumstances and financial difficulties, My husband and I were unable to start the AOS process until just now. That being said, as I am filling out the paperwork some of the questions pertain to what is current visa status is. Since we were married on a K1 and the K1 expires after marriage, what do I list there? What do I need to be looking out for since we did have to wait so long to start the petition? Any and all advice is greatly appreciated!

    Just to note the visa expired when your husband entered the USA. As long as you were married within 90 days, you have time to file the AOS. His I-94 expires 90 days after entry to the USA, so technically he's deportable but I've never heard of that happening. People are generally just told to do the AOS asap. So don't rush if you don't need to.

    Thank you!! I haven't found a lot of advice about that and started getting nervous because I felt they didn't give you a whole lot of Time between getting married and getting all of the appropriate things needed. Do we run any risk of waiting too long?

  10. You can have the shots given anywhere (recommend the local health department). The CS transcribes the shot records, seals the record, and gives it to you to submit. If you fail to submit it with the initial filing you will receive an RFE.

    When my husband received his medical for

    The k1 visa, the paper he received said applicant will receive vaccines in the US. Well, we just married 2 weeks ago and are now 2 weeks away from the visa expiring and I feel that we are running up against the clock in order to have everything completed in time. What are the cons if we run out of time getting everything together for his AOS before everything is together? How do we go about locating a civil surgeon for these vaccines? Do we have a round about cost for the vaccines and what he may need? Cons to not getting the vaccines before submitting the AOS? I know everything needs to be together, just curious on the best way to go about getting everything done. Thank you all for your help ?

  12. You can go with him to the nearest Social Security Office and request his social security card/number. However for work permit (EAD) and Advance parole documents, they cannot be done before marriage and as someone else mentioned, you can apply for them free of charge when filing for his Adjustment of Status (AOS). My fiance in haiti received an email today letting him know that his passport was ready to pick up from the DHL, every time he has gone in there today they have told him that he cants use that email to pick up his passport, that when setting up USTRAVELDOCS there was some kind of picture or informative pop up that came with setting up the profile that he needed to save in order to pick up the passport. I set up the profile for him and there was never any pop up. Has anyone that has gone through the haiti k1 visa experienced this recently or know what they are talking about? I am so confused because this isnt the information I have gathered!

  14. My husband was able to pick his passport with visa in less than a week

    Our traveldocs profile says that the passport is ready to be picked up, and he received an email saying that the documents have been collected and out for delivery. Is there another email that they send out saying that the passport has been delivered with a confirmation number? Or can he use that email?

  15. Good Evening all!

    I just booked my fiances flight to the states and he will be arriving at the FLL airport, and I was wondering if anyone has gone through immigrations there and if they have any advice for me to pass along to my fiance. He is more nervous that hes not going to know where to go more than he is about meeting with an immigration officer! Ive only flown out of FLL once before and even I was a little confused on the way their layout was, so any advice would be appreciated!
