  1. Hello everybody, thanks a lot for your help. Indeed, I´ve not lived for 5 or more years in the US after I was 14, so my son doesn´t qualify for a CRBA .

    On the other hand, the American Consulate in Guayquil-Ecuador told me to go for a K3 first and then go to the US and go for a AOS.

    In sum, from what I´m reading option number 1) (going with a toursit visa and then stay in the US and go for a AOS) would be considered fraud.

    For the IR-1 visa I don´t know if it is a problem if I´m not living in US territory?

    I´ve filed my taxes for the 2014, before that I was a college student, I think I should need another US citizen to sponsor financially, even though I have earned an income more than 35k last year?

  2. I´m a US citizen living abroad for more thant 20 years. I´m living in Ecuador. I got married to an Ecuadorian woman. We have been married for 2 years and 9 months by now. She has a B2 tourist visa, she got that visa before we got married and the visa is valid for two more years.

    I was addmited to a US University to do my masters degree. The duration of the masters degree is 10 months. Since we want to stablish in the US after I finish my masters then we have been wondering which is the best path to go.

    I need advise in which is the best path to go, I have two options:

    1) We travel together, she has a tourist visa, she could enter the US and then apply for an Adjustment of Status. I have to mention that my wife is two months pregnant and we were planning to travel to the US by August 2015.

    2) I was going to ask for a one year deferral to my university and then go for a k3 visa, here in Ecuador, for my wife and I guess I should ask for a k4 visa for my son, when he is born. However we should have all these papers approved by August 2016.

    Please let me know what is the best option. We don´t want to fall under a visa fraud or something like that.
